PROJECT SUMMARY: The applicant proposes to reconfigure and expand an existing private docking facility. Bruce Cameron IV Page 2 9. PROJECT DESCRIPTION The project site is located at 79 Beach Road South on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel approximately 0.5 miles until you reach the property of interest located on the right side of the road. The property is adjacent to residential properties on the south and north sides. The property is bordered on the east side by Beach Road South and Banks Channel to the west. The project site is approximately 0.63 acres in size and ranges in elevation from approximately 12' to 6' above Normal High Water (NHW) on the upland portion of the property. It is vegetated with maintained lawn grass and ornamental landscaping. The project site has approximately 120 linear feet of shoreline frontage along Banks Channel, which is currently stabilized by a timber bulkhead. Waterward of the existing bulkhead is a small strip of sandy uplands with an area of sparse Salt Meadow Grass (Spartina patens), and Sea Oats (Uniola paniculata), and the land slowly transitions downward to the open water area of Banks Channel. Extending in a northwesterly direction from the existing timber bulkhead towards Banks Channel is an existing private docking facility, which consists of an access pier (78'x 6'), landing on an uncovered "L -head" fixed platform (20' x 12'). From the fixed platform, a ramp (16' x 3') extends in a northeasterly direction, landing on an existing floating dock (24'x 6'), in the same orientation as the ramp. There is one existing boatlift (12'x 12') located on the southern (landward) side of the floating dock (see Sheet 1 of 3). The application states the existing docking facility currently accommodates up to two (2) vessels in water depths of approximately -5.8' at Normal Low Water (NLW). The current docking facility was authorized under CAMA General Permit No. 69048D which was issued 3/24/2017. The docking facility currently extends approximately 80' into a waterbody measuring approximately 460' across. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to reconfigure and expand an existing private docking facility. The applicant proposes to remove the existing boat lift from its current location. The applicant also proposes to add a ramp (16' x 3') to the west side of the existing fixed platform, extending in a southwesterly direction, landing on a proposed floating dock (26'x 6') extending in a northwest direction (waterward). The applicant proposes to add a boatlift (12'x 12') on the north side of the proposed floating dock, even with the mostwaterward edge of the proposed floating dock. With the removal ofthe original boatlift, the facility would result in a total of four slips, including one boat lift, and three additional slips alongside the floating structures. The other aspects of the docking facility would remain the same. The docking configuration would provide water depths of approximately -5.8' at NLW. The docking facility would extend approximately 20' further (100' total) into a waterbody which measures approximately 460' across and would meet the established pierhead line (see Sheet 2 of 3). 10. ANTICIPATED IMPACTS The structures would incorporate approximately 300 sq. ft. of additional Estuarine Waters and Public Trust Area. The proposed structures would extend approximately 100' into a waterbody which measures approximately 460' across and would meet the established pierhead line. This distance would conform to the r/4 width distance rule. The proposed structures would allow the existing docking facility to accommodate up to four (4) vessels in water depths of approximately -5.8' at NLW. Based on the application, the existing floating dock does encroach into the adjacent 15' riparian corridor setback area to the north (see Sheet 1 of 3), but the applicant has provided the proper adjacent Riparian Property Owner Statement and Waiver signed by Robert E. Long, Jr. There is no proposed encroachment into the southern riparian corridor setback. Minor increases in turbidity should be expected during construction. It was received as complete on April 23, 2019 and appears to be adequate for processing at this time. The projected deadline for making a decision is July 7, 2019. An additional 75 -day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from April 23, 2019, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A -119(b) requires that Notice of an application be posted atthe location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
