Application for Discharge to Surface Waters

Durham County
The Division of Water Resources (DWR of the Division) has reviewed your application for
discharge to surface waters, and hereby requests additional information. We note that this
proposed wastewater treatment system is subject to Neuse River Basin permitting Rules.
Existing Facilities. We understand that Bailey's MPH currently consists of a subsurface sanitary
sewer system supporting approximately 28 mobile homes. This system utilizes three (3) septic
tanks and leach fields with a design flow capacity of 3,000 gpd. We note that treatment is
currently "failing" (day -lighting to ground surface) and has been condemned by the Durham
County Health Department.
We note that no municipal sewer service is available to connect within one (1) mile of the site.
Records show a history of notices of violation, and health and odor complaints ranging in age
from 2002 to the present.
Existing; Regulations. While the surface -water flow and stream classification may allow a
discharge to the UT to Stony Creek [15A NCAC 02B .0206 (d) (1)], your proposed discharge is
further subject to permitting Rule 15A NCAC 02B .0279 governing nutrient discharges in the
Falls Lake watershed.
These Rules currently require any proposed new treatment system to meet limits for Total
Nitrogen (TN) of 3.0 mg/L and Total Phosphorus (TP) of 0.1 mg/L) to protect water -quality.
Moreover, the rule requires the applicant to purchase TN allocation from an existing NPDES
discharger or nutrient offset credits from an approved mitigation banker prior to permit issuance.

It follows that your client must be able and willing to procure Total Nitrogen (TN) allocation or
credits. Without one or the other, this discharge cannot be permitted. Please advise within 60
days of this notice as to how we should proceed with this project. In the absence of additional
information, the Division must return your application for surface discharge as incomplete.
