Bartlett, 143 Milltown Rd., Shiloh, NC 27974 Authorizing development in Camden County at Pasquotank River, 128 Lauren Lane, Shiloh , as requested in the permittee's application dated 04/08/04. including the attached workplan drawings (2), dated 03/05/04 This permit, issued on March 31, 2005 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 2), Excavation shall not exceed -3.5 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands shall not be authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any, maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2008 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Bartlett Permit #46-05 Page 2 of 4 ADDITIONAL CONDITIONS 4) No excavation shall take place at any time outside the alignment of the area indicated on the workplan drawings dated 03/05/04. Spoil Disposal 5) All excavated materials shall be confined above normal water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 6) No spoil material is to be placed within_30_feet of the normal water line, except-that which shall be used to backfill the area behind the bulkhead. Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). 9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Shoreline Stabilization - 10) -- The bulkhead alignment-will follow the-shoreline of the authorized basin and entrance canal. An on-site meeting with a representative of the Division of Coastal Management shall be conducted prior to any excavation in order to discuss the bulkhead alignment. The permitee is urged to have their contractor present. 11) The bulkhead shall be constructed prior to any backfilling activities. 12) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 13) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 14) The backfill material shall be clean and free of any pollutants except in trace quantities. Bartlett Docking Facility Permit #46-05 Page 3 of 4 15) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application dated 04/08/04 and the attached workplan drawings dated 03/05/04. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 16) The docking facility shall have a minimum setback distance of 15 feet between any.parts; of the structure and the adjacent property owner's riparian access 'corridor, which is determined by drawing a` line ' parallel to the channel, then drawing a line perpendicular, to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 19) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 20) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 21) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Boat Ramp 22) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. s Forrest L. Bartlett General Permit #46-05 Page 4 of 4 23) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any. such removal or alteration. 24) No vegetated wetlands shall be excavated or filled. - - NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. The Permittee is prohibited from performing any of the following activities on the property: Filling; grading; excavating; earth movement of any kind; construction of roads, walkways, buildings, signs, or any other structure; any activity that may alter the drainage patterns on the property; the destruction, mowing, or other alteration of vegetation on the property; disposal or storage of any garbage, trash, or other waste material; or any other activity which would result in the wetlands being adversely impacted or destroyed. b. Prior to beginning work authorized by this permit, the Permittee shall execute and cause to be recorded a conservation easement prohibiting those activities listed in condition a. above. The holder of this easement shall be approved by the Corps of Engineers prior to recordation of the easement. PROJECT SUMMARY: The applicant proposes to excavate a boat basin with an entrance canal and channel, bulkhead the basin and channel, construct a boat ramp, and construct a boatlift. FORREST L. BARTLETT FIELD INVESTIGATION REPORT PAGE 2 Project Setting The site of the development proposal is a 25.35-acres parcel that is located adjacent to Bartlett's Landing, which is a single-family unit subdivision off NC 343, Shiloh community, in Camden County and adjacent to the Pasquotank River. The property address is 128 Lauren Lane, which is a private street within the subdivision that intersects NC 343 at SR 1123. The property consists of approximately 19 acres of uplands that are mostly flat and vegetated with pine, gum, maple, and yard grasses, and six acres of 404 wetlands that are vegetated with cypress. The upland area has an elevation of approximately 4 to 5 feet above normal water level (NWL), and the soils are a Chowan type of fine silt mixed with sand. A portion of the wetland area lies adjacent to the Pasquotank River and has broken concrete along the shoreline. An upland ridge, approximately 20 feet wide at the shoreline, separates the wetland areas. The remainder of the wetlands are located along the northwestern property line and are part of a swamp drainage slough. The applicant has constructed a single-family dwelling with a septic drain field system and a paved driveway, as well as approximately 720 feet of wooden bulkhead along the shoreline adjacent to the upland area. Other man-made features on the property consist of a pier, platform and two boat slips, and riprap along the shoreline to protect the adjacent wetlands. The property has approximately 1630 feet of shoreline along the Pasquotank River. The adjacent property to the west is a continuation of the swamp area and the adjacent property to the east is a subdivision lot that has a shoreline bulkhead. The applicant indicates that wetland. delineation was done at the site by William Wescott and Tracey Wheeler, US Army Corps of Engineers (USACOE), on January 22, 2004. There are existing flags along the designated wetland area at the development site. The waters of the Pasquotank River in this area are classified as SB and are closed to shellfish taking. The river bottom in this area consists of sand and silt material and the water depths range from -1 foot at the shoreline to more than -4 feet deep at the existing pier platform. No SAVs were observed at the site. No archeological sites were observed at the site. Development Proposal The applicant proposes to construct a boat basin approximately 40 feet by 68 feet by -3.5 feet, an entrance canal leading to the boat basin approximately 96 feet long, 20 feet wide and -3.5 feet deep, and an entrance channel in the Pasquotank River approximately 45 feet long, 20 feet wide and -3.5 feet deep. The proposed basin and entrance canal will be located on the upland ridge that separates the adjacent wetland areas along the Pasquotank River. The proposed excavation of the entrance channel will reach connecting water depth of greater than -3.5 feet. FORREST L. BARTLETT _ FIELD INVESTIGATION REPORT PAGE 3 The applicant proposes to position the excavation equipment on the upland ridge and dig from the shoreline back so equipment will not impact wetlands. All spoil and excavated material will be removed from the site and deposited on an upland area of the applicant's property or on a nearby farm the applicant owns located on SR 1113. The applicant proposes to install 410 feet of sheet piling (vinyl or steel) bulkhead along the excavated basin and canal to prevent erosion. No tie back rods or cables are proposed for the bulkhead in order to minimize impacts to the adjacent wetlands. The applicant proposes to construct a 16-foot by 16-foot concrete boat ramp to provide trailer access to the basin. The applicant proposes to construct a 12-foot by 15-foot boatlift adjacent to his existing pier platform. Anticipated Impacts The excavation of the entrance channel will disturb approximately 900 square feet of shallow water habitat within the Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC), and approximately 75 cubic yards of bottom material will be removed. The excavation of the entrance canal and boat basin will disturb approximately 1930 square feet of uplands within the Estuarine Shoreline AEC and approximately 3030 square feet of uplands outside of the AEC. Approximately 872 cubic yards of material from above NWL and 648 cubic yards from below NWL will be excavated to create the canal and boat basin. The proposed boat ramp will result in 256 square feet of impervious surface in the upland area. The proposed backfill for the bulkhead along the upland sides will result in approximately 1000 square feet of upland fill. The proposed boatlift will capture 180 square feet of PTA and EW AECs, will not infringe on any riparian corridors, and will result in the applicant having a total of three slips. Also to be excavated will be an area of river bottom 20' wide and approximately 45' long to reach a NWL depth of 3.50'. It is desired that the depth below NWL of entire excavation be 3.50'. Also to be constructed at boat basin will be a 16'X 16' concrete k?e$e1.45v??T?•t•N The purposed excavations are to be dug from a ridge of high ground extending from upland areas to the Pasquotank River. The areas adjacent to this ridge have been declared as wetlands by Mr. 40 Wescott. It is in the intent of the application to position excavation equipment on this ridge and dig from shoreline back so equipment will not impact wetlands. Sheet pilings will be utilized for bulkheading material to eliminate "dead men" further decreasing impact on wetlands. Total acreage for the tract where proposed activity is to occur is 25.35 acres. Applicants home is the only other structure located on the property. He has no desire to further develop this property. There are no submerged aquatic vegetation (S.A.Ws) within proposed excavation area. Surrounding areas consist of Cypress swamp with sandy beach fronts where trees have blown down. These areas can be considered to be low but no stagnant water exists. The total length of bulkheading for project is 410 linear feet.
