Walnut Island Subdivision, as requested in the permittee's application dated 11/15104, including the attached workplan drawings (2), dated 11/15/04, and (1) dated 11/12/04 This permit, issued on April 1, 2005 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead 1) The bulkhead shall not extend waterward more than 12 feet from the normal water level at any point along its alignment at the time of construction. 2) The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 3) The bulkhead shall be constructed prior to any backfilling activities. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Louis Eller Permit # 33-05 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation shall be permitted except for that which shall be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 8) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Docking Facility 9) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 10) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. To meet this condition, the proposed pier shall be moved 15 feet to the west and consists of the same dimensions, or be terminated 15 feet from the adjacent owners common riparian access corridor. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 14) This permit shall not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) Development in the 30-foot buffer is limited to the proposed 110-square foot deck. The deck shall be slatted, wooden, elevated and unroofed. Any additional development proposed will require permit modification and must be consistent with 15A NCAC 7H.0209. T Louis Eller General Permit # 33-05 Page 3 of 3 16) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim-shall be made against the United States "or the state of North Carolina `on account z of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3490 (DWQ Project No. 041946), which was issued on 01/18/05. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 19820277 (COE Action Id. No. 200510470) which was issued on 2/20/05. q r Michael F. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and LAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. PROJECT SUMMARY: The applicant proposes to construct a bulkhead, dock, single-family dwelling, and driveway on his property. LOUIS ELLER FIELD INVESTIGATION REPORT PAGE 2 Project Setting The site of the proposed project is a 6,445-square foot parcel located at the end of Seward Court, Walnut Island Subdivision, off US 158, Currituck County, and on a man-made canal system that connects to Currituck Sound. The property is flat, has an elevation of approximately 3 feet above normal water level (NWL), has sandy soils, and is vegetated with pine, wax myrtle, and lawn grasses that are mowed. The property has approximately 160 feet of shoreline along the canal system and 55 feet of the shoreline has a bulkhead that is connected to the bulkhead on the adjacent property to the ' west. The remainder of the shoreline that has no bulkhead has eroded approximately 7-9 feet landward of the existing bulkhead alignment. Additional man-made features on the property include a water line, sewer hook up, power pole, and survey markers. The adjacent property to the west is a single-family dwelling with a bulkhead along the shoreline and the adjacent property to the east is a house trailer also with a bulkhead along the shoreline. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. The water depth in the adjacent canal ranges from -3 feet to -4 feet. There appears to be no known archeological sites on this property; however, State archeological sites CU 24 and 38 are located within the Walnut Island Subdivision. Development Proposal In order to prevent further erosion, the applicant proposes to construct a bulkhead to connect with the comer of the existing bulkhead on his property and run in a straight alignment for 72 feet, turn back towards the property for 6 feet, then turn parallel to the shoreline for 32 feet and connect to the existing bulkhead comer on the east side. The bulkhead will average approximately 8 feet waterward of the existing NWL and will have a maximum distance of 12 feet from shore. In order to provide water access, the applicant proposes to construct a 6-foot wide and 40-foot long wood walkway at ground elevation and parallel to the proposed bulkhead. The walkway will end at the 6-foot indentation of the proposed bulkhead where a ramp or stairs will lead down to a 6-foot wide and 22-foot long dock along the bulkhead and ending at the eastern property line. The applicant proposes to construct a 600-square foot octagonal shape single-family dwelling on pilings and a 600-square foot concrete parking area. The proposed house will have 253 square feet of elevated deck and stairway and 176 square feet of ground level deck located underneath the proposed elevated deck. LOUIS ELLER FIELD INVESTIGATION REPORT PAGE 3 Anticipated Impacts The construction of the bulkhead along the proposed alignment will result in the filling of approximately 775 square feet of Estuarine Waters (EW) and Public Trust Area (PTA) Areas of Environmental Concern (AEC). The proposed dock and ramp/stairs will shade 168 square feet of EW and PTA AECs. The proposed wooden walkway along the bulkhead will shade 240 square feet of Estuarine Shoreline (ES) AEC. The construction of the house and parking area will result in 1200 square feet of impervious coverage within the ES AEC, which represents 16.6 percent coverage in that area. The construction of the decks and stairs associated with the house will shade approximately 270 square feet of ES. The intent of this project is to provide a single family vacation home and one dock. Since all but 12 SF of the 10191 SF property lies within the AEC, CAMA AEC impacts are unavoidable. A 110 LF Wooden Bulkhead wall will be constructed along the alignment of the 30 ft canal easement to regain the uplands lost due to the unprotected shoreline. The extent of the loss is evident when viewing the bulkheaded shorelines to the east and west of the shoreline. Geotextile fabric will be placed on the landward face of the bulkhead to prevent turbidity and sediment release into the canal waters. This bulkhead alignment will also allow for the home to be constructed outside of the new AEC. All activities lie outside of the 30 ft canal easement boundaries.
