Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Community Access Facility 1) This permit authorizes only the access pier and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this community access facility without permit modification. No non-water dependent uses of strictures shall be conducted on, in or over public trust waters without permit modification. 2) The access pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2008 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee First Flight Ridge ADDITIONAL CONDITIONS Permit #37-05 Page 2 of 3 3) The Town of Kitty Hawk maintains a 5-foot right of way on either side of the Moor Shore Multi-Use Path. Therefore, this permit does not authorize any development activities within this right of way. 4) \o attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee shall not be not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit does not authorize any boat slips. 10) Any portion of the permitted access pier built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The portion of the high-round access walkway falling within 30 feet of the normal water line shall not exceed 6 feet in width, and shall be slatted, elevated and constructed of wood. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to Town of Kitty Hawk for approval. 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). • ' r First Flight Ridge ADDITIONAL CONDITIONS General 14) NOTE: NOTE The permittee is reminded that, in accordance with approvals granted by the Town of Kitty Hawk, no other water access facilities will be permitted at the subdivision site. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 041919. Director Division of Water Quality January 18, 2005 DWQ Project # 04-1919 Dare County First Flight Run and Kitty Hawk Bay Approval of 401 Water Quality Certification (GC3490) with Additional Conditions Dear Mr. Gomez: You have our approval, in accordance with the attached conditions, to shade or otherwise impact 0.02 acres of waters to construct a pier with platform to provide water access for the First Flight Ridge Subdivision in Kitty Hawk as described in your application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on December 1, 2004. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). PROJECT SUMMARY: This project involves the construction of an 80-foot long pier with a 400-square foot platform to provide water access for the First Flight Ridge Subdivision in Kitty Hawk. First Flight Ridge, L.L.C., Dare County FIELD L `VFSTIGATION REPORT Page 2 Project Setting The application site is located at First Flight Run and Kitty Hawk Bay, First Flight Ridge Subdivision, in Kitty Hawk, Dare County, North Carolina. The site consists of a 34.88 acre, 83- lot subdivision located between US 158 and Kitty Hawk Bay. The subdivision includes several paved streets and a portion of the shoreline area of the subdivision has been bulkheaded. The NC Division of Water Quality issued Low Density Stormwater Permit No. SW7040209 to the First Flight Ridge, LLC, on August 16, 2004, for the stormwater concerns of the subdivision. The Town of Kitty Hawk has previously constructed a 10-foot wide concrete multi-use path along the shoreline of the area known as the Moore Shore access easement. An open space area is located at the end of First Flight Run and also follows the shoreline of the subdivision. The shoreline easement includes an area dedicated as `open space' and also includes a utility easement, as well as the above-mentioned `Moore Shore' access easement. The area landward of the bulkhead along the shoreline is upland and vegetated in upland grasses. The subdivision ranges in elevation from 4 to 25 feet above the NWL and consists of several sand ridges that are aligned from north to south. The majority of the subdivision is vegetated in upland beach grasses and shrubs. A coastal marsh wetland fringe of Spartina alterniflora and Spartina cynosuroides is located west of the bulkhead structure along the shoreline. Some areas of submerged aquatic vegetation were observed along the shoreline west of the wetland fringe during the application site visit. The water depth in Kitty Hawk Bay is 1.55 feet below the NWL, at a distance of 80 feet west of the shoreline. The waters of Kitty Hawk Bay connect to the Albemarle Sound. The North Carolina Environmental Management Commission has designated these waters as `SC' waters (suitable for fish propagation). During the site investigation visits, no shellfish were observed along the water bottom in the vicinity of this project. Some juvenile finfish were observed along the shoreline. The Coastal Resources Commission (CRC) has designated these waters as Public Trust Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the designation of the CRC, the Coastal Shoreline AEC extends in a contour of 75 feet landward of the NWL. The CRC has also designated coastal wetland vegetated areas, like the one described above, as a Coastal Wetland AEC. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Albemarle Sound as Joint Waters. Project Description The applicant proposes to construct an 80-foot long pier (beyond the NWL / bulkhead) to provide water access for the residents and guests of the First Flight Ridge Subdivision. The pier structure will be 6-foot wide with a 400-square foot platform. The platform will be 20 feet by 20 feet in dimension. A 6-foot wide walkway path, to be made of either gravel, concrete and / or wood, or a combination of these materials, will be constructed east of the multi-use pathway along the easement to connect- from the street to the pier walkway. Any portion of the pier structure that will cross over wetlands will be elevated at least 3 feet above the marsh substrate. A 6-foot wide by 24-foot long elevated wooden walkway will be constructed to connect from the multi-use pathway to the pier/bulkhead area. First Flight Ridge, L.L.C., Dare County FIELD INVESTIGATION REPORT Page 3 Anticipated Impacts The proposed pier structure will result in the shading of 60 square feet of coastal wetlands and 880 square feet of estuarine waters and public trust area. Since the shoreline area is part of an open space area associated with the subdivision and the Moore Shore access, the pier will not infringe upon any adjacent riparian access. The pier walkway will result in the filling, grading and land disturbance of 450 square feet of estuarine shoreline and will not impact any wetland area. The pier structure installation will result in a minor increase in water turbidity during construction. The development consists of eighty-three (83) lots. Twelve (12) of the lots are adjacent to Kitty Hawk Bay. The final plat for the development has been recorded with Dare County and can be found in plat cabinet F, slide 276. The purpose of the pier is to provide pedestrian access for those residents located in the interior portions of the development to Kitty Hawk Bay. The structure consists of a 6'x 25' walkway or pier and a 20'x 20' platform. The structure will be constructed by driving 6"x6" piles as shown on the framing plan. (Embedment to be determined from test piles driven during construction since area has not been probed) The structure will then be framed with 2"x10" girders, 2"x8" joists, and decked with 2"x6" decking. There will be a 3'-6" handrail along the perimeter with verticals spaced no more than 3" apart for child safety. The Town of Kitty Hawk has constructed a multi-use path along the sound in this area within the Moore Shore access easement. The overall tract built-upon area percentage or lot sizes for the project must be maintained at levels at least as stringent as the low density levels specified in the stormwater rules. 3. The development must demonstrate that no areas within the project site are of such high density that stormwater runoff threatens water quality. 4. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 5. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and approved by the Division. 6. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as'a road b. That minimum amount needed for driveway access to lots. 7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. In addition, projects in the Neuse and Tar- Pamlico River Basins must comply with the Riparian Buffer Rules. 8. The permittee shall submit recorded deed restrictions limiting built-upon area per lot in accordance with Part I, item 9, within 30 days of the date of recording. 4. The Permittee shall submit the Engineer/Owner/Designer/ Permittee Certification in accordance with Part 1, item 10, within 30 days of completion of the project. 5. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 6 4.
