This permit, issued on August 17~ 2009 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Discharge/Diffuser Structure
1) Unless specifically altered herein, this permit authorizes only the discharge/diffuser structure and
associated warning pilings, all as expressly and specifically set forth in the attached permit application
and workplan drawings. No other structure, whether floating or stationary, shall become a permanent
part of this discharge/diffuser without permit modification. No non-water dependent uses of structures
shall be conducted on, in or over public trust waters without permit modification.
2) The alignment of the authorized discharge/diffuser structure shall adhere to the alignment depicted on
the attached workplan drawings. Any proposal to change the alignment may require a modification of
this permit. Contact a Division representative at (252) 264-3901 for this determination.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.

ADDITIONAL CONDITIONS
The warning piling shall be installed as indicated on the attached workplan drawings, and shall conform
with any and all appropriate regulations governing such structures, including but not limited to marking
and lighting requirements of the N.C. Wildlife Resources Commission and/or the U.S. Coast Guard.
. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

6) The permittee shall maintain the authorized warning piling in good condition and in conformance with
the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.

Spoil Disposal
8) All materials resulting from the directional boring shall be confined to the areas indicated on the
attached permit application behind adequate retaining structures to prevent spillover of solids into any
marsh or surrounding waters. Any proposal to change the disposal site may require a modification of
this permit. Contact a Division Representative at (252) 264-3901 for this determination.
Upland Development
9) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, all as expressly and specifically set
forth in the attached permit application and workplan drawings. Any additional land disturbing
activities and/or construction may require a modification of this permit. Contact a Division of Coastal
Management representative at (252) 264-3901 for this determination.
Sedimentation and Erosion Control
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials resulting from the excavation of the estuarine shoreline for the directional
boring drilling site do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion
swales or berms, etc.).
11) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. '

ADDITIONAL CONDITIONS
Stormwater
The Division of \Vater Quality approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW7080503,
which was issued on 5/29/08. Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit.
General
13) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

14) The water line must be directionally drilled a minimum of 10 feet below substrate of all jurisdictional
wetlands and waters.
15) No Coastal Wetlands shall be excavated or filled, even temporarily.
16) No work shall take place on any property until such time as the permittee has obtained legal authority
(i.e. deeds, easements, right of way encroachment agreements, etc.) for said property.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including, but not limited to, an authorization
to construct from the Division of Environmental Health, Public Water Supply Section.
NOTE:
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE:
The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3641 (DWQ Project No. 090527), which was issued on 6/18/09.
NOTE:

PASQUOTANK COUNTY REVERSE OSMOSIS FACILITY
Hobbs, Upchurch & Associates, P.A. is in the process of designing and permitting a new
Reverse Osmosis (RO) water treatment facility that will be constructed on land adjacent
to Forman Bundy Road in the vicinity of Okisko Road. Ultimately, the water treatment
facility will be capable of producing 5 million gallons of water per day. The water source
will be withdrawn from a series of wells drilled into the brackish Castle Hayne aquifer.
The brackish water will be trea,ted by RO membranes, which are designed to reject the
dissolved salts in the feedwater stream and produce a product suitable for potable
drinking water purposes. In this process approximately 75% of the feedwater will be
recovered for potable uses called permeate and the balance is rejected and called
concentrate. The concentrate will be pumped 18+ miles along the NCDOT right-of-way
to a discharge header assembly located in the Albemarle Sound off Rebellion Point.
There will be a temporary discharge location off of Halls Creek Road in the vicinity of
the Halls Creek Bridge. This site will be used to dispose of water pumped during the well
acceptance phase of the project. The construction of the temporary discharge is complete.
The second phase of construction will extend the discharge force main from Halls Creek
to the vicinity of Rebellion Point. A directional bore, which is the subject of this permit
application, will begin approximately 100 feet landward from the shoreline and extend
approximately 2,036 feet out into the Sound where the water depth is 7-foot. A bore pit
approximately 10ft x 6ft x 3ft deep will be constructed where the bore begins. The
discharge header will be attached to the bore pipe where emerges offshore. The discharge
header will consist ofHDPE pipe with diffusers spaced to obtain maximum mixing of the
concentrate effluent with the receiving body. The header will be anchored with three
concrete blocks and one piling at the distal end. The piling will be driven into the bottom
and extend 8-feet above the waterline and equipped with a USCG approved reflector.
Other than the directional boring component, bottom disturbance will minimal; involving
installation of the piling and concrete saddles associated with the discharge header.
