Sullins Director Dee Freeman Secretary August 18, 2009 DWQ # 09-0778 Iredell County Mr. Kevin Craft BEK Properties, LLC 191-A West Plaza Dr. Mooresville, NC 280117 Subject: Hold, Gold's Gym Expansion Dear Mr. Craft: On August 17.2009 your response was received concerning the issues raised by our letter issued on July 23fd for the subject site. We understand that the Town of Mooresville requests our approval prior to giving their approval for the project. This office can accommodate this request. However. the matters regarding the length of stream impact and storm water discharge needs to be clarified prior to issuance of the 401 certification. Mr. Carpenter of Meade Gunnell stated that the project is still in the concept phase, thus the exact stream impact was unknown, but the "worst case scenario" was submitted. We appreciate that fact; however that does not meet the "avoidance and minimization" requirement. Based on the initial submittal it appears that the culvert length could be reduced to be flush with the proposed retaining wall. If there is no actual planned use for the site, the application should be withdrawn. Mr. Carpenter also stated that the storm water outlets/measures details requested in the previous letter would be handled during the design phase. This information should be shown in the site diagram/layout and included in the submittal. Should the 401 submittal be approved you will have 60 days to submit a copy of the approved storm water management plan by Mooresville to the Division of Water Quality. Be advised that even with approval for the stream impact, the approval does not override the buffer required along the stream per the water shed water supply guidelines required by the Town of Mooresville. Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold. Failure to submit the requested information by September 30. 2009 may result in the application being withdrawn from consideration. You may reapply, but a new fee and application will be required. In addition, this office is requesting that the Army Corps of Engineers withhold processing the 404 permit until the requested information is provided.
