WATERQUAUTY WETLANDS AND STORMWATEft 8RAHCH Dear Ms. Karoly: Please find attached our response to the request for additional information in your letter dated August 7, 2009, regarding the wetland fill for the subject Project. Responses to each of the requests are noted. 1. Request - Per the requirements of the Neuse River Riparian Buffer Rule, you must show that this site meets diffuse flow requirements with a level spreader or other BMP per Chapter 8 of the BMP Manual (see http://h20.enr.state.nc.us/sulbmpforms.htm). Response - Presently the runofffrom this siteflows to a drainage channel that drains in a southerly direction leaving the site, to eventually enter an unnamed tributary to Crabtree Creek ojJsite (there are no buffered streams on the site). Up-gradient drainage is collected and managed from an existing development on the adjacent lot. This up-gradient drainage is detained in a pipe storage system and is released over an existing level spreader, which flows into a dedicated easement (Natural State Preservation Easement) located on our site. The runoff will be collected at the end of the easement and conveyed by pipe to a release point where the drainage channel leaves the proposed site of Carpenter Village Commerce. As a result, the up-gradient runoff has been detained, level spread, and passed over the vegetated easement before being conveyed to the drainage channel leaving the Carpenter Village Commerce site. Thus, the up-gradient runoff from off site is sufficiently managed to not require further treatment or control by Carpenter Village Commerce. On-site stormwater runofffrom the proposed development of Carpenter Village Commerce is to be collected and conveyed to a proposed stormwater BMP that will provide removal of 30% or more of nutrients rather than using a level spreader. This is in accordance with Section 8.3.6 of the BMP Guidance Manual. The proposed BMP is a sandfilter, which is given regulatory creditfor 35% removal of Total Nitrogen and 45% removal of Total Phosphorous (Chapter 11 of the BMP Guidance Manual). The discharge from the BMP is being directed into an existing drainage channel exiting the site. In addition, the most recent guidance for sand filters issued March 3, 2009, provides vegetated filter strips are not required as a downstream measure below sand filters. Thus, the runoff from the development of Carpenter Village Commerce conforms to the requirements of the Neuse River Riparian Buffer Rule and the guidance of the BMP Guidance Manual. LAND PLANNERS + CIVIL ENGINEERS 2. Request - This Office believes that the building and parking areas labeled on the plans can be moved or reconfigured to minimize the impacts to the wetlands. Please revise the plans to minimize the impacts or show why alternative configurations are not practicable. Response - The impacted wetland area is located diagonally across the development and greatly diminishes the area for potential use. Natural and planted buffered areas located around the perimeter of the property also place additional limits on useable landfor development. The Town ofCary places significant emphasis on landscape design and the inclusion of natural or vegetated buffered areas within the proposed development and, as result, this particular site allows for approximately 55% of total impervious area. The site configuration coupled with the Town's environmental limitations barely allows a building yield that would be considered a viable funded project. In an effort to minimize wetland and environmental impact the site parking and drive isles have been kept to a minimum of the Town's prescribed limits. The overall site layout was carefully and primarily designed to allow for emergency response access (fire) to the proposedfacilities. The layout has considered the minimization of wetland impacts while allowingfor functionality and accessibility. Significant time, coordination and effort have been made with the Town ofCary to create a sustainable environmentally functional site that complies with local ordinances and guidelines. 3. Request - Please provide documentation of the local government's approval of the stormwater management plan (SMP) for this project by providing EITHER: · A valid approval letter and one copy of the approved SMP (including plans and calculations), OR · One set of stormwater plan details and calculations stamped as "Approved" by the local government. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. Ifwe do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project.
