Hi David,
Thank you for reaching out. After speaking with the engineer (Brett, copied), We acknowledge that there will be an
additional indirect impact of 0.01 ac to the Linear Wetland. Would you like us to revise the impact exhibits to that
effect?
As for the SHPO consultation, Brad Luckey (copied) from Pilot Env has also been coordinating with the SHPO for the
entire development. We just spoke with SHPO and they have requested that we do not respond to the information
request below because they don't want to process it as two separate projects. Renee will be sending you an email to
that effect.
Please don't hesitate to reach out if there is anything else that I can do for you!
Best,
Patrick

One additional item related to note C) of the email I sent yesterday (see below):
After speaking with SHPO this morning, they indicated that they had not received the information they requested in
their letter dated 1/17/2019 (see attached). The Corps does not currently have the information necessary to make a
determination other than the "adverse effect" determination referenced in SHPO's letter. Please provide the
information to SHPO as requested to further the Section 106 consultation process.
Please let me know if you have any questions.

Thank you for your PCN and attached information, dated 5/7/2017, for the above referenced project. I have reviewed
the information and need clarification before proceeding with verifying the use of Nationwide Permit 39 (http://saw-
reg.usace.army.mil/NWP2017/2017NWP39.pdf). Please submit the requested information below (item 3 in particular)
within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or
consider your application withdrawn and close the file:
1) Based on Plan Sheet 2, it appears that grading activities and rerouting of stormwater for the senior living facility
project would eliminate the current drainage area for the remaining linear wetland, resulting in a reasonably
foreseeable reduction in hydrologic input to this area. The Corps will consider this reduction in aquatic function as an
indirect impact that would be included in the overall proposed wetland impact total for the senior living facility project
as well as the overall "The Pilot at Sedgefield" development (i.e. 0.07 acre wetland impacts rather than 0.06 acre). Please
provide any information providing justification that hydrology to this area would be maintained. Otherwise, please
acknowledge that the proposed impacts would include the additional 0.01 acre of indirect wetland impacts as described.
Please also note:
A) Please refer to Action ID: SAW -2018-01939 for all future correspondence related to this project. I apologize for any
confusion resulting from the earlier email referencing a different Action ID.
B) As noted previously, any impacts authorized for this project as well as other activities associated with the overall "The
Pilot at Sedgefield" development would be considered part of a single and complete project; these impacts would be
considered cumulative with impacts permitted during future phases regarding compensatory mitigation and Nationwide
Permit thresholds.
C) As you are aware, informal consultation has been initiated with the State Historic Preservation Office; they require up
to 30 days to respond to our coordination request. To this point I have not received concurrence that the project will not
result in an adverse impact on historic resources. Please note that I cannot verify the use of any Nationwide Permit until
consultation pertaining to Section 106 of the National Historic Preservation Act is complete.
Please let me know if you have any questions.
