The site drains to Maple Branch, which is currently classified as Class C, Sw Waters in the Cape Fear River Basin. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) Submit a Stormwater Pollution Prevention Plan (SPPP) to this office. Is the mine in compliance with the Operating Conditions of the Permit? ❑ Yes ®IN'o If no, explain: Operating Condition 3A: Sufficient buffer (minimum 50' undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. Additional land has been disturbed within the buffer on the southeast corner of the mine. OC 4A: Adequate mechanical barriers including but not limited to diversions, earthen dikes, sediment check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. o Containment berm is not installed in the southeast corner of the property. On the east side of the mine, there has been breaching of the containment berm. o No measures exist on the north side of the currently disturbed area to direct stormwater to the dewatering basin or effectively treat the stormwater. o Matting has not been installed on slopes of the entrance per plan detail. ® The weir has not been installed per plan on the dewatering basin. The basin is not effectively working as there is no settling time or filtering. © The apron below the settling basin is not installed. ® The settling basin is not sized with calculations. OC413: All drainage from the affected area around the mine excavations shall be diverted internal to said excavation. Several areas drain outwardly of the mine excavation. OC 5: All mining permit boundaries shall be permanently marked at the site on 100' intervals unless the line of sight allows for larger spacing intervals. Mine boundaries are not marked. OC 6: The angle for graded slopes and fills shall be no greater than the angle, which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. The slopes of the entrance are not stabilized, per the approved plans, by matting. 14. Is the mine in compliance with the Reclamation Conditions of the Permit? ® Yes ❑ No If no, explain: 15. Did any of the above deficiencies result in offsite damage? ® Yes ❑ No If yes, describe the type and severity of the damage: The entrance crossing has very steep slopes and is eroding into a stream. Several areas on the east side of the mine have breached the mine containment berm. 16. Corrective measures needed and/or taken: o Steps should be taken to continue to stabilize the entrance slopes. o Install, repair, and maintain all measures as per approved plan. a Demark all mine permit boundaries. o Reclaim all areas that have been disturbed within the undisturbed buffer. o Submit a revision detailing sizing of all dewatering basins. 17.
