S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated November 4, 200S. The applicant, the Town of Emerald Isle, has applied for a Department of the Army (DA) permit to fill jurisdictional water and construct other facilities for Emerald Woods Park. The proposed work is being considered under Regional General Permit # 191W00291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.c. 661- 667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)( I) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection offish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.c. IS31-1543). Project Area, Proposed Activities, and Anticipated Impacts The project area, proposed work, and anticipated impacts area discussed in the Field Investigation Report (FIR), dated, October 2S, 200S, of the North Carolina Division of Coastal Management (NCDCM). The project area is an undeveloped 37.SS-acre tract between Coast Guard Road and Bogue Sound within the Town of Emerald Isle. The waterward edge of the tract has both high marsh and low marsh bordering the sound. Bogue Sound adjacent to the project area is classified as SA- ORW (Outstanding Resource Waters) by the North Carolina Division of Water Quality. The area is not a designated Primary Nursery Area (PNA). The appl icant proposes to construct roads and parking areas. A system of nature trails and wetland boardwalks would be constructed. The FIR states that boardwalks would be constructed of slatted wood and elevated a minimum of three feet above the wetland substrate. A public observation/kayak pier would be constructed. The pier, six feet wide by 168 feet long, would extend from a nature trail into the waters of Bogue Sound. A floating dock, six feet by 16 feet, would be located at the tem1inal end of the pier. The permit application states that water depths at the waterward end of the pier at mean low water (ML W) are IS-20 inches. 2 Construction of a cul-de-sac and parking lot would require the fill of 871 square feet (fe) of freshwater wetlands. The pier and dock would incorporate 984 ft2 of non-vegetated open water. No dredging or filling of estuarine waters is proposed. Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located in the Swansboro quad. Occurrence data of special status species within these quads can be obtained on the internet at < http://www.ncnhp.org/Pages/heritagedata.html >. While pier construction can pose a risk to the West Indian manatee (Trichechus manatus), water depths in the project area, even at high tide, appear too shallow to provide good habitat for manatees. Therefore, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements of section 7 of the Endangered Species Act would be fulfilled. However, the Corps must reconsider its obligations under section 7 of the ESA if: (1) new infornlation reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations The Service supports the conservation of barrier island habitats for recreational use. The proposed nature trails should benefit the public and provide important wildlife habitat in a rapidly developing area. The Service recommends that all structures built over wetlands and open water be elevated to a sufficient height to avoid detrimental shading. We are pleased that the boardwalks would be slatted to allow some sunlight to pass through the structure. However, the use of a slatted design is not mentioned for the pier which would have a minimum elevation of three feet above the substrate (Exhibit E). While the three-foot minimal elevation is a useful baseline standard, the actual elevation should be based on site conditions. The Service supports the language given in the Wilmington District's Regional General Permit (RGP) 197800056, which became effective on March 16,2005. The RGP requires (Special Condition i) a minimum elevation of three feet for docks and piers over wetlands, but also stipulates that these structures will be elevated sufficiently to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. Therefore, the amount of elevation is determined by the height necessary to prevent total shading. The required elevation will be dependent of the character of the wetlands covered and the stated minimal elevation may not be appropriate in all cases. An adequate height may be part of the current plans since some cross- section drawings (Exhibits E and G) indicate that the actual height "varies." 3 With adequate design features to minimize the adverse impacts of shading on freshwater wetlands and estuarine waters, the Service does not believe the activities described in the PN and FIR would have significant adverse and/or irreversible effects on fish and wildlife resources. Therefore, the Service has no objection, from the standpoint of fish and wildlife under our jurisdiction, to the issuance of a DA permit for the proposed activities. The Town of Emerald Isle and its authorized agents shall conduct its activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303( d) of the Clean Water Act) and any other appropriate requirements of State law and federal law. The Town of Emerald Isle shall require its contractors (and/or agents) to comply with all of the terms of this Certification, and shall provide each of its contractors (and/or agents) a copy of this Certification. A copy of this Certification shall be included in the construction contract and available on the job site at all times. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d). PROJECT DESCRIPTION Hayes, Seay, Mattern and Mattern, Inc., on behalf of the Town of Emerald Isle, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located at 9414 Coast Guard Road, adjacent to Bogue Sound, in Emerald Isle, Carteret County. To find the property, take Highway 24 west from Morehead City towards Cape Carteret. Turn left onto Highway 58 and travel across the Emeral Isle high-rise bridge. Turn right at the first red light past the bridge (Coast Guard Road) and the property will be located on the right hand side of the road approximately 0.5 to 1.0 miles. The subject property is bordered by residential properties. The site is currently undeveloped with the exception of a municipal water tank that is located in the southeast corner of the property. Vegetation associated with the high ground portion of the property, consists primarily of Live Oaks, Magnolias, Long Leaf Pines, Sweet Gums, Holly's Maples and Cedars. Understory vegetation includes: Wax Myrtles, Cedars and Red Bays. Transitional species, including: Sea Oxeye (Borrichia (rutescens) and Grounsel-bush (Baccharus halimi(olia) are located on the waterward side of the recently constructed bulkhead. High coastal marsh vegetation, including, Cattails (Typha sp.), Black Needle Rush (.Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. The area of coastal wetlands vegetation varies in size and ranges from 120' to 350' in width, and spans the entire length of the shoreline. Elevation at the site ranges from approximately 2' to 30' above Mean Sea Level. According to the Town of Emerald Isle, the CAMA Land Use Classification for the area, within and around the project site, is Developed/Residential. Residential properties border the site to the east, south and west. The property is border to the north by Bogue Sound. The waters of Bogue Sound, adjacent to the project site, are classified as SA-ORW by the North Carolina Division of Water Quality. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to the Division of Environmental Health, Shellfish Sanitation Section, the area located in this area of Bogue Sound is OPEN to the harvesting of shellfish. PROPOSED PROJECT The applicant proposes to develop the 37.55 acre tract by constructing a paved driveway (Amberjack Drive) with associated parking, a maze of boardwalks, a public pier, a two-stall restroom building and a cul-de-sac/tum around. In addition, the applicant proposes to fill approximately 0.02 acres of "404" type wetlands for driveway construction. The entrance/exit drive (20' x 1,300') would run from south to north along the central and eastern section of the property and would consist of paved asphalt with a 24" curb and gutter system. A 40' right-of-way (20' on each side) would be provided for driveway and utility maintenance. Three parking areas are proposed along AmbeIjack Drive and a fourth parking area is proposed at the terminal end of the cul-de-sac/tum around. The applicant has indicated that a small area of vegetated "404" type wetlands would be filled (approximately 0.02 acres, or a 20' x 47' area) for cul-de-sac and parking lot construction. Clean, off-site fill material would be used to fill the 890 sq. ft. of "404" type wetlands and the area would be contained by a silt fence that would be installed around the impacted area. A maze of nature trails and wetland boardwalk crossings would be constructed on the property. Please refer to Figure 11.1 for the location oftrails/boardwalks. A total of four boardwalks would be constructed for wetland crossings and would vary in width (from 8' to 10') and length (from 30' to 168') to allow for emergency vehicular access. As proposed, the boardwalks would be constructed of wood (slatted) and elevated a minimum of36" above the wetland substrate. A picnic area and bathhouse (45' x 25') would be constructed in the northeast comer of the property, east of the cul-de-sac. The bathhouse would be located just within the 575' Area of Environmental Concern (ABC). In addition to the high ground work, the applicant is also proposing to construct a public observation/kayak pier in the northeast corner of the property. The pier (6' x 168') would span in a northerly direction from the nature trail, and terminate in the waters of Bogue Sound. A 6' x 16' section of floating dock would be located at the terminal end of the pier. The applicant submitted an Express High-Density Stormwater Permit application to the North Carolina Division of Water Quality, however a permit has not yet been issued. The applicant has also submitted, and obtained approval of a Sedimentation and Erosion Control Plan (SECP) from the Division of Land Quality. The plan was modified and approved on 8/23/05, and was issued under Carte- 2006-038. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 2.95 acres of high ground. The proposed boathouse would result in the creation of approximately 1.125 square feet of impervious surface within the 575' AEC. The proposed wetlands fill would result in the disturbance of 0.02 acres of "404" type wetlands. The construction of the proposed pier and dock would incorporate approximately 984 sq. ft. of Estuarine Waters and Public Trust Areas. The applicant has not yet received an Express State Stormwater Permit from the Division of Water Quality. The applicant has not proposed any development within the 30' Estuarine Shoreline buffer and the majority of the development would be located outside of the 575' AEC. Other than the 0.02 acres of proposed "404" type wetlands fill, and the temporary wetlands disturbance resulting from the construction of the proposed pier, no other wetlands would be impacted as a result of the development.
