Dear Mr. Klimek:
Our office is in receipt of a 401 Water Quality Certification Permit dated
February 6, 2003. As one of the conditions of the approval, a written stormwater
management plan specific to the proposed storm water wetland shall be approved
by your office in writing before the impacts specified in the Certification occur.
The approval letter states that the storm water plan should be submitted within 90
days of receipt of the Certification. This letter acknowledges and accepts all of
the conditions of approval; however, the written stormwater plan may not be
submitted within the 90-day limit as set forth in the conditional approval. The
storm water management plan will be completed and approved by your office
prior to the occurrence of any of the approved impacts.

APPROV AL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Martin:
You have our approval, in accordance with the attached conditions, to place fill in 0.43 acre of wetlands in order to construct the
Trinity School and associated soccer field in Durham County, as described in your application received complete by the Division of Water
Quality (DWQ) on January 9,2003 and in additional correspondence received February 3,2003. Please note that this Certification also
includes up to 149 linear feet of perennial streams and 0.12 acre of isolated wetlands filled at this location prior to requirements for
notification to DWQ of such impacts. After reviewing your application, we have determined that this fill is covered by General Water
Quality Certification Number 3362, which can be viewed on our web site at http://h20.enr.state.nc.us/ncwetlands.This Certification allows
you to use Nationwide Permit Number 39 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner
must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification, as well as the additional conditions
listed below:
1. Waste or borrow sites shall not be located in streams or wetlands;
2. All culverts must be designed, constructed and placed to allow aquatic life passage;
3. Construction activities shall be conducted in such a manner as to prevent significant increase in turbidity outside the area of
construction or construction related discharge (50 NTU's in streams and rivers not designated as trout waters);
4. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order
to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any
wetlands, waters and/or buffers approved for impact under this Certification. A sample deed notification format can be downloaded
from the 401/Wetlands Unit web site at http://h20.enr.state.nc.us/ncwetlands ;
5. All future impacts to streams and wetlands, including isolated wetlands, shall require written concurrence from this Office;
6. An additional condition is that a final, written stormwater management plan specific to the proposed stormwater wetland shall be
approved in writing by this Office before the impacts specified in this Certification occur per Condition NO.3 in GC No. 3362. The
stormwater plan should be submitted within 90 days of receipt of this certification. The stormwater management plan must include
plans and specifications for stormwater management facilities that are appropriate for Class C surface waters and designed to
remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices
Manual. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly
approved by the DWQ. All stormwater from tees, greens, fairways, clubhouse and maintenance areas shall be directed
to flow to permanent stormwater management facilities in the approved plan. No direct discharge of stormwater to
streams is allowed from the golf course. Also, before any permanent building is occupied at the subject site, the
facilities (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this
Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices
shall be made without written authorization from the DWQ;
7. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification
has been completed.

If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.

The purpose of this memo is to respond to your 1/ 17/03 letter
regarding the above named project. I will respond to your questions in
the same numbering system used in your letter.
1. "Confirm acreages of delineated wetlands."
I believe the confusion arose over the labeling of the impact map.
Wetland Area 2 is a total of 0.43 acres, 0.3 was to be impacted
(impact A) so 0.13 would be preserved. Wetland Area 1 (all to be
preserved equals .32 acres). The delineation was surveyed and
acreages confirmed by the John R. McAdams Company.
However, since that time the USACE has contacted S&EC and
advised that the plan as shown would effectively isolate the 0.13
acres and remove it from their jurisdiction. Therefore, they would
consider the entire 0.43 acres impacted. Based on this
determination, please consider this letter a revision to our original
request and that total impacts currently requested will be 0.43
acres (all of wetland Area 2). The Corps has requested 1: 1
mitigation for this impact and based on a conversation with Ron
Ferrell at NCWRP they would accept payment for the mitigation. A
copy of this information is being sent to WRP along with site
vicinity maps for them to process acceptance of the headwater
forest mitigation.
2. "Provide greater detail of p'ast impacts."
As stated in Section IV of the application, previous impacts
occurred prior to the requirement for notifying for such impacts.
Specifically less than 150' of channel was impacted for
construction of the existing asphalt drive and ~ewer line shown on

the previously submitted plans. Also, four isolated wetland
pockets shown on the approved wetland delineation were impacted
prior to DWQ's requirement for notification. Specifically a total of
0.12 acres of isolated wetlands ranging in size from 0.01 to 0.06
acres were impacted. Therefore, even if the past impacts were
combined with currently proposed impacts, the totals are below
DWQ mitigation requirements.
3. "Provide design specification for Stormwater wetland." Mr.
Amos Clark of the John R. McAdams Company will provide this
information to you. However, please note that we proposed the
Stormwater wetland not due to a 401 condition (i.e. the
proposed impacts are for athletic fields which will be 0%
impervious). Rather, it is to aid in meeting the minimization of
adverse impact requirement. Preservation of the 0.32 acres is
to meet the avoidance requirement.

Dear Sirs:
On January 9, 2003 the Division of Water Quality (DWQ) was notified by receipt of your
application regarding your plan to fill waters for the purpose of constructing a soccer field in Durham
County. Approval from DWQ is required to disturb these wetlands and waters. Please provide 7 copies
of the following information and refer to the DWQ # listed above in your reply. Please show these on
maps of suitable scale (for instance 1" = 1 00 feet) so we can begin to determine your projects'
compliance with 15A NCAC 2H .0500.
1. Please confirm that acreages of delineated wetlands, according to site plans, are accurate.
Polygons for wetland areas 1 and 2 (to be preserved) appear equal or smaller than wetland
impact despite greater reported areas.
2. Please provide greater detail regarding past impacts as referred to in Section IV of permit
application including total area previously impacted.
3. Please provide design specifications for the proposed stormwater wetlands as indicated on
the site plan.
Please telephone John Dorney at 919-733-9646 if you have any questions or would require
copies of our rules or procedural materials. This project will remain on hold as incomplete in
accordance with 15A NCAC 2H .0505(c). The processing time for this application will begin when this
information is received. If we do not hear from you by writing within three (3) weeks we will assume
you no longer want to pursue the project and will consider it withdrawn.

Dear Mr. Dorney and Mr. Tugwell:
On behalf of Trinity School of Chapel Hill and Durham (property owner), we hereby
request authorization from the US Army Corps of Engineers to use Nationwide Permit 39
to cover impacts a wetland area. We also request written concurrence from the NC
Division of Water Quality (NC-DWQ) that the project complies with the 401 Water
Quality Certification associated with Nationwide Permit 39. A Pre-construction
Notification Application (pCN) is attached, as well as an agent authorization form.
The proposed project, which consists of a private school, is located immediately west of
the intersection of Pickett Road and Cambridge Road, on the Durham County - Orange
County line, within the Triangle Township of Durham County. Please see the attached
USGS topographic map for the exact location of the project. S&EC conducted a detailed
wetland delineation on the property in 1998. Mr. Tugwell approved our delineation and
provided a jurisdictional determination for the site on 6/10/98. This site is located in the
Cape Fear River Basin.
The applicant plans to construct a soccer field on the western site of the Trinity School
property, for the purpose of recreation and athletic activities. In order to construct the
field, the applicant proposes to impact 0.3 acre of jurisdictional wetland with fill material.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and may require

compensatory mitigation to offset unavoidable losses of waters of the US when impacts
exceed the requirements for notification (0.10 acre) or if a discharge to a special aquatic
site such as wetlands is proposed. The applicant plans to construct a soccer field that will
impact 0.30 acre of wetland. Due to spatial configuration considerations and building
and property line set-backs, the proposed soccer field location is the only area remaining
on-site that can accommodate a soccer field. The only other open area on-site large
enough to contain a soccer field is located on the northern-central portion of the property.
However, set-backs from existing buildings, coupled with an existing French drain, make
this location unsuitable for a soccer field. The applicant is planning to construct extended
detention wetlands to provide on-site stonnwater treatment. S&EC believes the proposed
on-site stonnwater treatment will provide adequate mitigation for the proposed impacts.
NC-DWQ's current policy requires mitigation for wetland impacts greater than 1 acre in
size. Because the proposed impacts are below this threshold, S&EC believes wetland
mitigation should not be required by NC-DWQ. In order to treat stonnwater generated
from the Trinity School site, the applicant plans to construct an extended detention
wetland on the western side ofthe property (see attached plan). Please see the attached
calculations, provided by Mr. Amos Clark, of the John R. McAdams Company, for
further infonnation regarding the proposed extended detention wetlands. If further

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

been timbered.

The proposed project consists of constructing a soccer field on the western portion of the
project site. Conventional heavy equipment will be used.
11. Explain the purpose of the proposed work: The purpose of the proposed wetland impacts is
to allow the construction of a soccer field for the Trinity School.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with

A jurisdictional determination was issued for the subject property by Mr. Todd TU2Well of the
USACE on 6/10/98 (Action ID #199820609). Isolated wetland impacts and less than 150 linear
feet of channel impact previously occurred on-site at a time prior to the requirement for
notification of such impacts.

VI. Proposed Impacts to Waters ofthe United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide

site layouts, and explain why these design options were not feasible. Also discuss how impacts

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc. us/ncwetlands/strm~ide.html.
