SUBJECT: Proposed Bridge Replacement, Bridge No. 144 Over Sandy Run Creek on State Road 1327,
TIP No. B-4468, Cleveland County, DWQ #09-0769
Dear Dr. Thorpe:
The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application, in association with a site visit on July 27, 2009, revealed it
is lacking the necessary information required for making an informed permit decision. The permit application
was deficient in the following areas:
The application proposes to relocate approximately 90 linear feet of perennial stream. The permanent
stream impacts are associated with fill for the road slope. The application indicates that as part of the
required avoidance and minimization measures, the stream will be lined with permanent soil reinforcement
matting (PSRM) instead of riprap. The plans indicate that the slope of the relocated stream will be
approximately 10%. The site visit indicates that the existing stream is underlain with bedrock. Based on
the proposed slope and the existing site conditions, DWQ staff is concerned with stream stability (use of
matting on a 10% slope) and the constructability (presence of bedrock) of the relocated stream channel.
Additional details must be provided to demonstrate the stability of the relocated stream as well as proposed
construction techniques related to the presence of bedrock.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we
are supplied with the necessary information. You have 21 days to respond in writing with the requested
information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this
office has not received this information in writing, we will assume you are withdrawing your application and it
will be returned.
Furthermore, until the information is received by the NC Division of Water Quality, we request, by copy of this.
