The address for the project is 205 Lands End Road, Morehead City, NC 28557. The property's upland shoreline is 105 LF along coastal wetlands that are part of Bogue Sound, Stream Index #: 20-36-(8.5); Class SA;HQW. The lot has an existing single family dwelling outside of the 75' AEC and an existing pier that has been damaged, is unusable and will be removed. The owner received a CAMA General Permit#: 73420 on January 28, 2019 for construction of a 400 LF pier with two boat lifts, a T -head platform and two floating platforms. The owner is requesting a CAMA Major to construct this pier approximately 581 linear foot to avoid impacts to sub -aquatic vegetation (SAV) and to achieve greater water depth (approximately 10.5") for its furthest boat lift. The SAV have been located with aerial photography and extend from the shoreline to approximately 404 LF from the shore. If construction were to occur in accordance with the General Permit, all of the boat lifts and floating platforms will potentially impact the SAV in this area. The Cullipher Group performed a hydrographic survey to determine NLW depths for the length of the proposed pier as well as locate existing piers near to the property in order to establish a pierhead line (please see plansheet 1— colored aerial). The proposed pier has an access structure on highground that is 6' in width and approximately 30' in length. It will be constructed with wooden planks or other slotted material and raised in order to meet the minimum clearance once over wetlands. The waterward pier is 6' in width with one 24'x16' fixed platform (384 sf) at the end. There are also two 16'x10' floating platforms (160 sf each) and a 2'x6' cantilevered fish cleaning station (12 sf) proposed for a total shaded platform area of 716 sf. There are three lifts proposed. A 15'x5' lift and a 10'x10' lift are proposed for two boats and a 10'x6' lift for a jet ski. There are three additional tie piles proposed. Two are at the end of the pier for visiting boaters to tie to and one is located 40' north of the fixed platform for tying a jetski. Considering the three proposed lifts and the tie poles used for temporary mooring there are five total wet slips proposed with this application. There are no oyster rocks or SAV in the vicinity of the proposed platforms or lifts. The platforms are beyond the extent of the coastal wetlands near shore. Dredging is not part of the proposed application and it is understood by the Owner that it will not be allowed. There is currently a property boundary dispute ongoing with this property and its adjoining owner to the west. Two separate property corners have been installed by two separate surveyors. The outcome of this dispute has yet to be determined. However, both property corners, riparian lines and 15' riparian setback lines are shown on plan sheet 2 with the proposed pier encroaching into neither setback. A CAMA general permit was issued for a 2 -slip docking facility previously (1/28/19) for a maximum of 400 feet from NHW, however the applicant wants to extend to a maximum of 581' from NHW. 9. Narrative Description: The Edward and Rachel Cozart project is located at 205 Lands End Road along Hwy 24 Morehead City, Carteret County. The site is found by following highway 24 into the Morehead City town limits. Turn right at the stop lights adjacent to the Walmart shopping center (Harbor Drive) and follow to the stop sign then turn right onto Lands End Road. The property will be immediately on the left (approximately 245'from the stop sign). The residential property is .638 acres (27,782 sf) in its entirety and an average of 9' above nhw. Bogue Sound runs along the south side of the property. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There is a 50' x 105' section of coastal wetlands (Spartina alterniflora) and (Juncus roemerianus) along the 105' of shoreline on Bogue Sound. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. According to Google Earth spacial data, the ICW W is located approximately 410' waterward (south) of the most southern proposed platforms and the most southern proposed slips (3&4). Water depths within this project location are-2.5'nlw/mlw to - 3.1' nlw/mlw. The bottom substrate is sand and no SAV were observed within the proposed slip areas and floating platform areas. Bogue Sound is approximately 1.6 miles wide at this location. There are SAV within this location approximately 400' from NHW. No SAV were observed beyond this point. 10) Proposed Development: The applicant was issued a CAMA general permit on 1/28/19 for a 2 -slip docking facility but wishes to add 3 more slips (total of 5 slips), 2 floating platforms, one fixed platform, three tie pilings, three boatlifts and extend to a maximum of 581' from NHW to achieve deeper water depths and remain outside of any SAV habitat. They feel this will help ensure the SAV are not disturbed and will also achieve deeper water depths. There was an old dilapidated pier that was damaged during Hurricane Florence but has not been replaced at this time and will be torn down if not already done so. The current proposal is for a 6' x 30' access above NHW that would extend to a 6' x 565' pier (a 6' x 360' portion of the pier would be over SAV habitat). It would intersect a 16' x 24' fixed t -head platform. There would be a 15' x 15' boatlift (slip #2) along the east side Field Investigation Report Edward and Rachel Cozart 205 Lands End Road Page 3 of 3 of the fixed platform with a floating 10' x 16' floating platform along the west side of the fixed pier and a 16' x 16' wet slip ( slip # 3) with two mooring pilings along the west side of the floating platform. They are also proposing a to a 10' x 10' boatlift ( slip # 1) along the east side of the pier (50' landward of the fixed platform), a 6' x 10' jet-ski lift (sip # 4) along the west side of the pier (app. 23' landward of the fixed platform) and a 10' x 11' wet slip ( slip # 5) with one tie piling immediately landward of the jet-ski lift along the west side. The final portion of the proposal is the placement of the second 10' x 16' floating platform along the west side of the pier approximately 100' landward of the proposed fixed platform at the end of the docking facility. The closest 'section of the proposed platforms and boatlifts are approximately 35' waterward of the edge of SAV habitat. The most waterward portion of the proposed docking facility would not exceed a maximum of 581' from NHW and 535' from the edge of coastal wetlands. All parts of the docking facility would be landward of the ICWW channel (approximately 410' landward) and a minimum of 20.19' from the western riparian corridor and 15.44' from the eastern riparian corridor. There would be a total of five slips (2 boatlifts, one jet ski lift, and two wet slips with three mooring pilings with a boat size of 20' to 37' and an open runabout design. The water depths within the slips and floating platform areas are -2.1' nlw to 3.0' nlw/mlw depending on location, with connecting water depths of -3.1' plus nlw/mlw. The water depths beyond 400' only fall an additional .7 from 400' to 500' and an additional .4 from 500' to 600' however the additional length will allow for slightly deeper water access and would help any slip areas remain outside of the SAV habitat. This should help reduce any prop scarring within the SAV area. There is currently a property line dispute along the west side, however the current proposal will meet the 15' setback in either instance. 11. Anticipated Impacts: The proposed pier would shade and incorporate 180 ft2 of coastal wetlands above NHW and 264 ft2 of coastal wetlands below NHW. The pier portion waterward of the edge of marsh would also shade and incorporate 2160 ft2 of SAV habitat. The platforms, wet slip additions with mooring pilings and boatlifts would incorporate 2600 ft2 of shallow bottom habitat while shading 1634 ft' of the shallow bottom habitat. The development would increase the number of slips from zero to five. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed docking facility should not be a hindrance to navigation due to the fact all portions would be located landward 410' from the ICW.
