Atlas Environmental, Inc. is submitting this package in response to comments received
by DEQ by a link through an email from Stephanie Goss on May 21, 2019 for the Royal
Creek nationwide permit 29 application request that included the following:
1. Please provide the most recent bound and published Wake county soil survey.
Please clearly draw or delineate the site boundaries on the soil survey. [15A NCAC 02H
.0502(b)]"
Atlas Response to Soil Survey:
Please see the enclosed digital copy of the Wake county soil survey that includes the
project boundary.
"2. DWR's file review revealed that a portion of the riparian buffers received formal
verification by the Division on January 7, 2014, NBRRO# 13-385. However, the buffer
determination letter expired on January 7, 2019 and the property boundary depicted on
the January 7, 2014 buffer determination letter does not depict the same project
boundary submitted in the application. In the Neuse River Basin, intermittent streams,
perennial streams, lakes, ponds and estuaries depicted on USGS maps and NRCS soil
survey maps are subject to the Riparian Buffer Rules. Impacts to the riparian buffers
must be identified on your plans [15A NCAC 02B .0233 (8)(b)(iv)]. If a stream is
depicted on either map it is subject to the riparian buffers. [Note: If the permittee
believes the maps inaccurately depict surface waters he or she must consult the
Division to secure a formal on-site determination.]"

Atlas Response to Buffer Determination:
Please see the enclosed USGS map, photograph location map, and representative
photographs taken on May 23, 2019. The USGS map depicts two streams within the
project boundary. The Wake County soil survey depicts five streams within the project
boundary. The Corps approved delineation concurred that one stream was located
within the project boundary. The stream which is in the middle of the property is
perennial at the lower reach and intermittent at the upper reach. The submitted project
plans include the requested buffer impacts located along this stream. Included is a
photograph location map and photographs that were taken on site last week (May 23,
2019) in the locations where the USGS and/or Wake County soil survey depicts streams
that are in fact wetlands in the field. Atlas requests an updated buffer determination.
"3. Please provide documentation for review that the U.S. Army Corps of Engineers has
verified all stream, wetland, and/or open water locations for the project. [15A NCAC 02H
.0502(a)(7)1"
Atlas Response to Corps Jurisdictional Determination:
Please see the enclosed Corps 404 and approved delineation approval for the project.
James conducted a site visit on March 6, 2018. The 404 and delineation approval were
issued April 26, 2019.
Please let me know if you have any questions. I reached out to Stephanie on May 20,
2019 for a permit approval update which was day 55 of DWR's time period for permit
review. I received an email and link from Stephanie on May 21, 2019 that included the
request for additional information (day 56). The applicant had not received the certified
letter the day I forwarded the additional information request to him (May 21, 2019). If a
DWR field review is necessary for the buffer determination I request a site meeting as
soon as possible given the timing of the additional information request outlined above.
A copy of the DWR additional information request letter is enclosed for reference.

Description of projects area and activity: This permit verification allows for 82 linear feet of permanent stream channel
impacts, 36 linear feet of temporary stream channel impacts, 0.353 acre of permanent wetland impacts, and 0.113 acre of
temporary wetland impacts from fill associated with the installation of two road crossings and lot fill for the Royal Creek
residential subdivision in accordance with the below impact table. Mitigation is required for this proposal.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AID) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AID before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AJD could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be"waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:

On March 27, 2019, the Division of Water Resources (Division) received your application
requesting a Riparian Buffer Authorization from the Division for your project. The Division has
determined that your application is incomplete and cannot be processed. The application is on -
hold until the following information is received:
1. Please provide the most recent bound and published Wake county soil survey. Please
clearly draw or delineate the site boundaries on the soil survey. [15A NCAC 02H
.0502(b)]
2. DWR's file review revealed that a portion of the riparian buffers received formal
verification by the Division on January 7, 2014, NBRRO# 13-385. However, the buffer
determination letter expired on January 7, 2019 and the property boundary depicted on
the January 7, 2014 buffer determination letter does not depict the same project
boundary submitted in this application. In the Neuse River Basin, intermittent streams,
perennial streams, lakes, ponds and estuaries depicted on USGS maps and NRCS soil
survey maps are subject to the Riparian Buffer Rules. Impacts to the riparian buffers
must be identified on your plans [15A NCAC 02B .0233 (8)(b)(iv)]. If a stream is depicted
on either map it is subject to the riparian buffers. [Note: If the permittee believes the

Please provide documentation for review that the U.S. Army Corps of Engineers has
verified all stream, wetland, and/or open water locations for the project. [15A NCAC
02H .0502(a)(7)]
Pursuant to Title 15A NCAC 02B .0259 (8), the applicant shall furnish all of the above requested
information for the proper consideration of the application. if all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules or
the Neuse Riparian Buffer Rules for this activity.
