Within the Authorization Certificate that you received there is a condition that reads: Notification of Construction The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within 10 days of the commencement of construction. This is a part of the Express Review Program that is required to ensure compliance during construction and post construction. Therefore, if you have begun construction on your extended detention wetland and utility line, you are required to notify this office in writing by November 17, 2004. If you do not notify this office in writing and construction has started, you are in violation of the Water Quality Certification Rules as required by 15A NCAC 2H .0507(c). This letter is to notify you and make you aware of this new condition that has been written into the Water Quality Certifications and Riparian Buffer Authorization Certificates issued within the Express Review Program. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge Water Supply, Watershed regulations. This approval is for the purpose and design that you described in your application and the additional information submitted. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed below. The Additional Conditions of the Certification are: 1. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification (or Isolated Wetland Permit) are met. Diffuse Flow All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5) 3. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 213 .0233. 4. Grading and Revegetation within Zone 2 The plans provided along with the application depict,grading activities within Zone 2 of the protected buffer. This activity is designated as "exempt" under the Buffer Rule provided that fill is not placed in Zone 1, diffuse flow is maintained as per the Buffer Rule, the disturbed areas are stabilized and revegetated, and the health of the existing vegetation in Zone 1 is not compromised. 5. No Impacts to Zone 1 No impacts shall occur to Zone 1 of the protected riparian buffers (except for uses and activities designated as "exempt" within 15A NCAC 02B .0233), unless otherwise approved by the DWQ. 6. Written Stormwater Management Plan (No Further Approval Needed) The final, written stormwater management plans (including the signed and notarized operation and Maintenance Agreement) as signed and sealed by the engineer on July 21, 2004, must be implemented and the stormwater management facilities shall be constructed and operational before any permanent building is occupied at the subject site. The structural stormwater plans as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater plans, or to the percentage of impervious surface indicated in the plans and calculations, shall be made without written authorization from the Division of Water Quality. 7. Standard Erosion and Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices: !f Ten Ten Two, LLC Page 3 of 4 7/21/04 a. Erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. Design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. 8. No Impacts Beyond those in Application No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 9. Measures in Wetlands Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources or locally delegated program has released the project. 10. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 11. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed notification may be modified as appropriate to suit to this project. 12. Temporary Fills All temporary fill and culverts shall be removed and the impacted area returned to the original grade, including each stream's original cross sectional dimensions, planform pattern, and longitudinal bed and bed profile after construction is complete or within 6 months of the establishment of the crossing, which ever is sooner, and the various sites shall be stabilized with natural woody vegetation (except for the maintenance areas of Ten Ten Two, LLC Page 4 of 4 7/21/04 permanent utility crossings) and restored to prevent erosion. If the crossings are not completely removed and restored as described above within the specified time above, additional written approval from this Office must be obtained to modify this condition. 13. Notification of Construction The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within 10 days of the commencement of construction. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1508. This Authorization Certificate shall expire five (5) years from the date of this letter. This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0233. This letter does not authorize any impacts to either Waters of the United States or Waters of the State. In an effort to reduce and avoid impacts to the stream buffer, several design alternatives were contemplated for the required stormwater treatment facility which is shown on the design drawings. Lot sizes and building pads have been reduced to the greatest extent possible while still meeting the minimum lot size criteria required by the final PUD documents which have been approved by the Town of Apex, and in order to provide the required pad size to accomodate the proposed building footprints. In fact, two lots were eliminated by the developer from the maximum density allowed by the PUD in order to avoid impacts (total number of lots reduced from 41 to 39). The grading for the facility has been designed in order to provide the required water surface and treatment volumes required by DWQ, and has been moved as far to the north and west as possible while still respecting the grading required to provide the mimimum lot depths and the required access road which runs along the north and east sides of the facility from the public roadway to the existing sewer lift station as shown on the site plan. The addition of a retaining wall in order to keep grading out of the buffer areas has been analyzed and determined to be cost prohibitive when combined with the loss of the two lots previously mentioned. Access to the site has been provided at the location of an existing trail road and culvert crossing, such that additional impacts at that location are not necessary. In total, impacts to the primary buffer zone have been reduced to less than 0.07 acres. 3. As indicated on the design drawings, the open water, low marsh and high marsh areas of the stormwater wetland have been designed in a manner such that the stormwater which flows into the facility is routed slowly through the facility, thus preventing "short circuiting". The proposed project consists of the construction of an extended detention wetland within Zones 1 and 2 of the Neuse Riparian Buffers and utility line impacts within Zone 2 of the buffer. The proposed subdivision is located northeast of the intersection of SR 1010 and Highway 1. Figure 1 shows the location of the ±12 acre site on a USGS topographic quadrangle. S&EC conducted a detailed wetland delineation and Neuse Buffer Evaluation in December of 2003. The delineation maps are being finalized and will be sent to the USACE within the next few weeks. On May 18, 2004, Ms. Debbie Edwards of the NC- DWQ verified the Neuse Buffer origin points (DWQ404-0760). Buffer impacts include 4,982 SF of Zone 1 and 2,994 SF of Zone 2 for the extended detention wetland and 289 SF of Zone 2 for utility line installation. No impacts are proposed to wetlands or stream channels on-site. The proposed roadway will utilize an existing culvert in order to avoid stream impacts. The impacts are summarized in the attached PCN form and illustrated on the attached impact maps. The applicant requested a wetland and buffer evaluation prior to construction in order to avoid impacts to jurisdictional features to the maximum extent practicable. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Impacts to the stream were avoided by using an existing road crossing in order to gain access to the site. The gravel road will be improved (i.e. paved) but no additional impacts to the channel or adjacent wetland will occur during road construction. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as Page 5 of 8 incomplete. The proposed project consists of the construction of an extended detention wetland within Zones 1 and 2 of the Neuse Riparian Buffers and utility line impacts within Zone 2 of the buffer. The proposed subdivision is located northeast of the intersection of SR 1010 and Highway 1. Figure 1 shows the location of the f 12 acre site on a USGS topographic quadrangle. S&EC conducted a detailed wetland delineation and Neuse Buffer Evaluation in December of 2003. The delineation maps are being finalized and will be sent to the USACE within the next few weeks. On May 18, 2004, Ms. Debbie Edwards of the NC- DWQ verified the Neuse Buffer origin points (DWQ#04-0760). Buffer impacts include 4,982 SF of Zone 1 and 2,994 SF of Zone 2 for the extended detention wetland and 289 SF of Zone 2 for utility line installation. No impacts are proposed to wetlands or stream channels on-site. The proposed roadway will utilize an existing culvert in order to avoid stream impacts. The impacts are summarized in the attached PCN form and illustrated on the attached impact maps. The applicant requested a wetland and buffer evaluation prior to construction in order to avoid impacts to jurisdictional features to the maximum extent practicable. The proposed stormwater wetland is designed to meet DWQ criteria and will preserve water quality downstream. A detail of the BMP is included with the attachments. Impacts to the stream were avoided by using an existing road crossing in order to gain access to the site. The gravel road will be improved (i.e. paved) but no additional impacts to the channel or adiacent wetland will occur durine road construction. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in detennining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as Page 5 of 8 incomplete. Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet [wetland] detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the permanent pool depth reads feet in the main pond, the sediment shall be removed. [For stonnwater wetlands: if the elevation of the marsh areas exceed the permanent pool elevation, the sediment should be removed to design levels. This shall be performed by removing the upper 6 inches of soil and stockpiling it. Then the marsh area shall W excavated six inches below design elevations. Afterwards the stockpiled soil should be spread over the marsh surface.
