On Feb. 21, 2019, the Division of Water Resources issued to Duke Energy Progress, LLC,
NPDES permit NC0003417 for the H.F. Lee Energy Complex with an effective date of April 1,
2019. We have been informed that, in the course of publishing the draft permit for public
comment, the Division did not complete all of the public notice requirements mandated in 15A
NCAC 021-1.0109.
Duke Energy requests that DWR withdraw the version of the permit issued on Feb. 21 for the
limited purpose of allowing DWR to republish the permit for public notice under 021-1.0109 and to
take final action under 15A NCAC 021-1.0112. Because the new permit is not yet effective, Duke
Energy's current permit, dated October 14, 2009, remains in effect. Duke Energy's request is
based on the understanding that the current permit will remain in effect until DWR takes final
action after the close of the public comment period.
