SUBJECT: Simonini Builders, Shoreline Stabilization, Lots 1006 & 1007, The Point
Subdivision, Lake Nonnan, DWQ Nos. 20052172 and 20052173, Iredell County
The applicant is requesting 401 Water Quality Certification from the North Carolina Division of
Water Quality. The NCWRC has reviewed information provided by the applicant, and field
biologists on our staff are familiar with habitat values of the project area. These comments are
provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.)
and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The project is to install 100 feet of river rock on lot 1006 and 100 feet of river rock on lot 1007
to prevent shoreline erosion. Stabilization at the site. appears to be warranted provided the
shoreline meets Duke Power Company's Shoreline Management Plans pursuant to Federal
Energy Regulatory Commission requirements.
Based on our review of the submittal, we do not object to the stabilization; however, the use of
river rock for stabilization should be avoided. For shoreline stabilization the following general
recommendations are provided for your consideration:
1. The stabilization project should be done with minimum class I (class II preferred)
riprap. This size rock improves aquatic habitat structure. We do not support the
use of river rock as mining river rock causes impacts to aquatic environments and
destabilizes riparian zones by causing unnatural geomorphic and biological
function modifications. Large, irregularly shaped stone should stay in place
better and provide more crevices and voids that are beneficial to aquatic life.

Fabric matting may be used beneath the stone to reduce erosion and turbidity. To
the extent practicable, rock or stone should be placed just above the high water
mark and towards and into lake edge waters to provide continuous aquatic habitat
as lake water elevations rise and fall. To improve aquatic habitat values,
incorporating large boulders every thirty (30) feet of shoreline enhances fish
holding habitats. Placement of boulders should be accomplished in a manner that
boating and swimming safety is not compromised.
2. Stabilization work should occur from the water instead of the shore to minimize
buffer impacts when possible.
3. Any Large Woody Debris (L WD) should be maintained to the maximum extent
practicable to provide aquatic habitat. If relocated, the L WD must be securely
anchored so that it will remain where installed.
4. Stringent erosion control measures should be installed where soil is disturbed and
maintained until project completion. Temporary or permanent herbaceous -
vegetation should be planted on all bare soil within ten (10) days of ground
disturbing activities to provide long-term erosion control.
5. Disturbed banks may be revegetated with silky dogwood (Cornus amonum), silky
willow (Salix sericea), tag alder (Alnus serrulata), black willow (Salix nigra), and
sycamore (Platanus occidentalis) or other native plants to provide long term bank
stability and stream shading. Note that silky dogwood, silky willow and black
willow can be planted as live stakes collected during the dormant growing season.
Cuttings should be randomly planted and done on 4 foot centers from the waters
edge to the top ofthe bank. Trees should be planted on 10-12 foot centers. Banks
in these areas should also be seeded with an approved wetland seed mix or
temporary crop of wheat or rye.
6. Existing undisturbed shoreline buffers and natural vegetation should be
maintained to the extent practicable. Required buffers must be protected and
permanently preserved.

Dear Mr. Jarinski:
You have our approval, in accordance with the attached conditions and those listed below, to place fill in
or to otherwise impact approximately 0.003 acre of water and 0.003 acre of riparian buffer for the purpose of
stabilizing approximately 100 linear feet of shoreline on Lake Norman, as described in your application
received on December 7,2005. After reviewing your application, we have determined that this project is
covered by Water Quality General Certification Number 3492, which can be viewed on our web site at
http://h20cenr.state.nccus/ncwetlands.This General Certification allows you to use Regional Permit No.
198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves
as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B
.0243. Please note that you should get any other federal, state or local permits before proceeding with your
project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and
Water Supply Watershed regulations.
The above noted Certification will expire when the associated USACOE's 404 permit expires unless
otherwise specified in the General Certification. This approval is only valid for the purpose and design that you
described in your application. If you change your project, you must notify us in writing, and you may be
required to send us a new application for a new certification. If the property is sold, the new owner must be
given,a copy of the Certification and approval letter; and is thereby responsible for complying with all
conditions. If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h).
In addition to the requirements of the certification, you must also comply with the following conditions:
1. No impacts shall occur in the buffer, including the removal of trees, except in the immediate shoreline
stabilization area.
2. Upon completion of the project, the applicant/responsible party shall complete and return the enclosed
"Certificate of Completion" form to the Division of Water Quality's 401/Wetlands Unit.
