referenced project. This receipt serves as notification that the compensatory mitigation requirements for this project have
been satisfied. You must also comply with all other conditions of this certification and any other state, federal or local
government permits or authorization associated with this activity.
The NCEEP, by acceptance of this payment, acknowledges that the NCEEP is responsible for the compensatory mitigation
requirements associated with the project permit and agrees to provide the compensatory mitigation as specified in the permit.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is wilIing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts, It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
PermitJ401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/40l/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Ford:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.12 acres of wetland for the purpose of constructing the proposed access to
lots on the ocean side of the North Drain wetland area in the vicinity of the project, as described within
your application dated December 2,2005, and received by the N.C. Division of Water Quality (DWQ) on
December 6, 2005, with additional information received on December 19,2005. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification
Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Pennit(s) NW14 when
issued by the US Anny Corps of Engineers (US ACE). In addition, you should obtain or otherwise
comply with any other required federal, state or local pennits before you go ahead with your project
including (but not limited to) Erosion and Sediment Control, Non-discharge, and other regulations. Also,
this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for thisproject (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

Sediment and Erosion Control:
2. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the 404/40 1 Permit Application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is
unayoidable, they shall be removed and the natural grade restored within six months of the date that the
Dh.ision of Land Resources has released the project;
5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor
\\,rithin these boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H,
Section .0500;
6. Deed Notifications - Deed notifications or similar mechanisms shall be placed on all retained
jurisdictional wetlands, waters and protective buffers in order to assure compliance for future
\\letland, water and buffer impact. These mechanisms shall be put in place prior to impacting any
wetlands, waters and/or buffers approved for impact under this Certification Approval and
Authorization Certificate. A sample deed notification can be downloaded from the 40 1/W etlands Unit
web site at http://b2o.enr.state.nc.usIncwetlands. The text of the sample deed notification may be
modified as appropriate to suit to this project;
7. Construction Stormwater Permit NCG010000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an
NPDES General stormwaterpermit (NCG010000) administered by DWQ is ~utomatically issued
to the project. This General Permit allows stormwater to be discharged during land disturbing

construction activities as stipulated by conditions in the pennit. If your project is covered by this
pennit [applicable to construction projects that disturb one (1) or more acres], full compliance
with pennit conditions including the sedimentation control plan, self-monitoring, record keeping
and reporting requirements are required. . A copy of this pennit and monitoring report forms may
be found at httv:/lh2o.enr.state.nc.uslsu/Forms Documents.htm.;
8. Diffuse Flow (No Review)
All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non-erosive velocities through the protected stream buffers such that it will not re-concentrate
before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If this is not
possible, it may be necessary to provide stormwater facilities that are considered to remove
nitrogen. This may require additional approval from this Office.
9. Culvert Installation
Culverts required for this project shall be installed in such a manner that the original stream profiles
are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and
longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall
be designed and installed to allow for aquatic life movement as well as to prevent head cutting of
the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall
be re-established or, ifthe pipes installed in a perched manner, the pipes shall be removed and re-
installed correctly. .
Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the
stream up or down stream ofthe culvert(s). Existing stream dimensions (including the cross section
dimensions, pattern and longitudinal profile) shall be maintained above and below locations of each
culvert.
Placement of culverts and other structures in waters, streams, and wetlands must be placed below
the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches,
and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow
low flow passage of water and aquatic life. Design and placement of culverts and other structures
including temporary erosion control measures shall not be conducted in a manner that may result in
dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream ofthe
above structures. The applicant is required to provide evidence that the equilibrium shall be
maintained if requested in writing by DWQ.
The establishment of native, woody vegetation and other soft stream bank stabilization techniques
must be used where practicable instead of rip rap or other bank hardening methods. If rip-rap is
necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of
Water Quality.
Installation of culverts in wetlands must ensure continuity of water movement and be designed
to adequately accommodate high water or flood conditions.
Upon completion ofthe project, the Applicant shall complete and return the enclosed "Certificate of
Completion" form to notify NCDWQ when all work included in the 9401 Certification has been
completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. Please

send photographs upstream and dOl'.-7ZStream of each culvert site to document correct installation
along with the Certificate of Completion form.
Certificate of Completion:
10. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,
1650 Mail Service Center, Raleigh, NC, 27699-1650.
Also, this approvalto proceed with your proposed impacts or to conduct impacts to waters as
depicted in )'our application shall expire upol1 expiration of the 404 or CAMA Permit.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification shall expire upon
expiration of the 404 or CAi.\1A Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

REQUEST FOR MORE INFORMATION
Dear Mr. Ford:
On December 6,2005, the Division of Water Quality (DWQ) received your application dated
December 2,2005, to impact 0.12 acres of wetland to construct the proposed access to lots on the
ocean side of the North Drain wetland area in the vicinity of the project. The DWQ has
determined that your application was incomplete and/or prqvided inaccurate information as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore,
unless we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and will place this project on
hold as incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:
1. Please provide the percent of project imperviousness area based on built-out conditions,
and describe the total area versus impervious area. If this is greater than 30% a
stormwater management plan will be required.
2. Please indicate all stormwater outfa1ls on the site plan.
3. Please indicate the diffuse flow provision measures on the site plan.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Kyle Barnes of the DWQ Washington Regional Office. Ifwe do not hear from you
within three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.

This correspondence and attached revised site plan is in response to the "Request for More Information"
letter from you dated December 9,2005. We have reviewed your requests and have item by item
responses to the requests that include what is asked for.
) OWO Request 1. Please provide the percent of project impervious area based on build-out conditions,
V and describe the total area versus impervious area. If this is greater than 30 % a stormwater
management plan will be required.
Quible Response: In the application it is mentioned that Glenn Ford will have the opportunity to develop a
maximum of two lots for residential purposes. It additionally states that the property owner to the south of
the Ford lots may have the opportunity to utilize the roadway without having to create an additional access
there. Due to the annual maximum erosion rate and subsequent GAMA setbaks in this area of Rodanthe,
the applicants will have to utilize the GAMA Ocean Hazard Exception Rule as set forth in NGAG T15A:
07H .0309. This limits a house footprint to 1,200 square feet or ten percent of the lot size; whichever is
greater. In Ford's case, one-tenth of the lot size is greater, therefore, the inset conceptual model shown
on the site plan depicts a footprint on-tenth of the lot size along with an oversized parking area.
To give an extremely conservative figure, I will consider the project area at maximum build-out conditions
to include the easement area starting at the western wetlands line to the First Line of Stable Natural
Vegetation (FLSNV) and the uplands (non-wetland) area on the Ford (north) side and the adjacent (south)
side, also to the FLSNV. I will not include any wetlands area, other than that which will be bridged or filled,
to remain on the conservative side for this purpose. And, I will not include any oceanfront land east of the
FLSNV. The total maximum impervious area including development on four lots and road construction
would be 20,643 square feet. This divided by the potentially buildable land area of 90,255 square feet
equals 22.9 percent coverage.
DWQ Request 2. Please indicate all storm water outfalls on the site plan.
Quible Response: The only storm water outfalls are the two areas of double, 24 inch culverts to be placed
/} under the filled section of road. After meeting with USAGE on the property, it was suggested that in
addition to the bridge section, culverts would help surficial hydrologic conditions. The culverts are labeled
on the site plan and I have included an additional cross-section showing the culverts.
DWQ Request 3. Please indicate the diffuse flow provision measures on the site plan.
/ j Quible Response: Diffuse flow provision measures include 1) providing a 4-foot wide vegetative

filter strip on each side of the to-foot wide travel aisle of the crowned gravel-surfaced travel
aisle, and 2) rip-rap slope stabilization around the culverts. These diffuse flow measures serve
different purposes. The vegetative filter stip and crowned surface is a stormwater control and
treatment measure that directs any rainwater that does not infiltrate into the gravel surface to
the vegetative strip where it can infiltrate. The main purpose of the culverts are to allow surface
or near surface water to transmit through the wetlands. This area is not normally flooded, but
wind driven pushes of water up the north drain ditch can cause some flooding. It is not normal
for rainwater to have this effect here.

On December 6, 2005, the Division of Water Quality (DWQ) received your application dated
December 2,2005, to impact 0.12 acres of wetland to construct the proposed access to lots on the
ocean side of the North Drain wetland area in the vicinity of the project. The DWQhas
determined that your application was incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore,
unless we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and will place this project on
hold as incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:

The purpose of this correspondence is for Quible & Associates, P.C. to provide USACE and NCDENR,
Division of Water Quality a Nationwide #14/401 Water Quality Cert. Permit application submitted by our
firm on behalf of Glenn Ford. The site plans accurately show the confirmed wetlands line as well as the
proposed wetlands fill location.
As displayed on the site plan enclosed and described in the PCN application, we are proposing a
combination bridge/roadway fill in the location of a perpetual 20 foot wide easement for lot access. Road
construction has already been permitted by CAMA Major 179-04 under Gerald Gaines, the former
property owner. Gaines had also obtained a 401 Water Quality Certification (#04-1332) for the fill of 0.215
acres of wetlands in the easement for the same purpose. To meet Federal Permitting requirements, this
work is now proposed as a bridge and roadway fill combination instead of fill across the entire drain.
The bridge will be slotted wood, built a minimum of three feet above the wetland ground elevation and will
extend over 160 linear feet of wetlands, including the ditch. The fill area will include two locations of
double 24 inch diameter pipes to further maintain the surficial hydrologic connection. The proposed fill
area totals 0.12 acres of jurisdictional wetlands. This access roadway will provide access to a minimum of
two buildable lots and will likely provide access to additional lots to the south of the Ford properties.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

There is a perpetual easement (20 ft wide) along Midgett Mobil Court from Pamlico Sound
to the oceanfront. Glenn Ford owns developable lots on the oceanfront. There is an area of
iurisdictional wetlands to cross that is the subiect of this application. There is currently no
coverage on the Ford Property.
7. Property size (acres): The perpetual easement (subiect property) on the east side of NC 12 is
0.9 acres. This is a 20 ft wide strip along Midgett Mobil Court that is intended to provide lot
access for ocean side lots.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
This is a required access route for access to the ocean side buildable lots in the proiect vicinity.
There is no alternative access route available. Attempts have been made to purchase an
easement from Sea Haven Drive to the North through a privately owned property to the subiect
parcels. The property owner was not willing to consider this due to the presence of a house and

septic system in the required easement locations. Attempts have also been made to cross two
sets of properties to the south from another access road to reach the subiect properties. This was
also denied. As an attempt to minimize impacts Glenn Ford proposes to construct a pile-
supported bridge over the main drainage area (the North Drain Ditch itself and adjoining
wetlands), The length of the bridge over wetlands would be 160 ft. In addition, there are
culverts proposed for two locations along the proposed fill area. There would be two side-by-
side 24 inch diameter pipes in each location.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.em.state.nc. us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Impacts to wetlands are proposed to be offset bv providing a payment to EEP.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

reviewed and approved before it can be used to satisfy mitigation requirements. Applicants

0.4 acres to 0.5 acres. The slotted bridge is not considered to be impervious coverage.

You have our approval, in accordance with the attached conditionS, to place fill in 0.215 acres of
wetlands to construct an access to a vacant buildable lot as described in your application received by the
Division of Water Quality (DWQ) Wetlands/401 Unit on August 13,2004. After reviewing your
application, we have determined that the Division of W ater Q~ty (DWQ) General Water Quality
Certification Number 3351 covers these water impacts. This Certification allows you to General Permit
No. 198000291 when issued by the US Army Corps of Engineecl, (USACE). In addition, you should get
or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in
your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
