Lee PO Box 303 Arapahoe, NC 28510 Subject Property: Pireway BAA NC Wildlife Resources Boat Ramp Renovation Approval of 401 Water Quality Certification with Additional Conditions Dear Mr. Lee: You have our approval, in accordance with the attached conditions and those listed below, to fill 0.04 acres and dredge 0.06 acres of open water for the purpose of renovating the existing boat ramp and parking facilities at the subject property, as described within your application dated November 1, 2005 and received by the N.C. Division of Water Quality (DWQ) on November 29,2005. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number 3400 (WQC 3400). The Certification allows you to use the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge, NPDES Stormwater and State Stormwater Management regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the CAMA Permit. . This approval is for the purpose and design that you described in your application. If you change your ! project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions, If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in l5A NCAC 2H .0506 (h). Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best ~I:magement Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion COfllrol Planning and Design Jfanual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control A-fanual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-ovmed or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining "Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No "Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction acu\- ities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur, 4. PROJECT DESCRIPTION The project site is located at the intersection of the Waccamaw River and NC Highway 904, adjacent to the Waccamaw River, in Brunswick County. To locate the property from the intersection ofNC Highway 17 S and NC Highway 904, turn right onto NC Highway 904/Longwood Road NW and travel approximately 5.2 miles. Turn left onto NC 904/Pireway Road NW and continue to just before the Waccamaw River Bridge. Turn left at the NC Wildlife Boating Access sign. The project site is a 1.90-acre parcel of land located just south of NC Highway 904 and bordered by the Waccamaw River to the west and the Rivergate Estates community to the south. The property has approximately 450 linear feet of shoreline frontage on the Waccamaw River and the average width of the waterbody is approximately 250 feet. The high ground property consists primarily of a 27,628 sq. ft. gravel parking area surrounded by lawn grasses, Dog Fennel (Anthemis arvensis), Water Oaks (Quercus nigra), Sweet Gum (Liquidambar stryciflua), Black Willow (Salix nigra), Loblolly Pines (Pinus taeda), and Bald Cypress (Taxodium distichum). The property has an average elevation of approximately 6 feet above normal water level. Existing structures on the property consist of a concrete boat ramp which is located on the western property boundary measuring approximately 14' x 90' with a concrete apron measuring approximately 12' x 30'. The shoreline adjacent to the ramp is stabilized with rip rap which averages approximately 20' in width and extending approximately 50' on the south side of the ramp and approximately 60' on the north side. r" ~ The waters of the Waccamaw River in this location are classified as "C Sw" by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is not open to the harvest of shellfish, PROPOSED PROJECT The Commission proposes to replace the existing single concrete boat ramp with a double concrete ramp. Each side of the ramp would measure 14' x 100' with 50' of the ramp extending below the normal water line and 50' above the normal water line. The new concrete apron would measure 20' x 32' with a concrete abutment measuring 8' x 19.7'. The concrete abutment would connect to a new 8' . x 80' wood floating dock located between the ramps. In order to comply with the Americans with Disabilities Act, a handicap accessible concrete ramp measuring 5' x lOT in total length would wrap aroWld the designated handicap parking space and connect to the concrete apron and would be located landward of the 30' Coastal Shoreline Buffer. The new ramp would require the excavation of 410 cu. yds. of clay and sand material below the normal water line and 90 cu. yds. above the normal water line in order to obtain a fInal depth of -7.6' at the waterward end of the ramp, giving the ramp a 14% grade. The existing ramp has a 10% grade and a water depth of -4.8' at the terminal end of the ramp. The excavatecl material would be placed on the southeastern side of the property in an area measuring 50' x 100' and would be contained by a silt fence. The spoil material will be mrned into grass berms along the property line after dewatering. There would be approximately 50 cu. yds. of additional riprap placed an average distance of 3 t waterward of nonnal water line to a maximum of 4' waterward of the normal1water line adjacent to the new ramp as needed for shoreline stabilization. ANTICIPATED IMPACTS The proposed boat ramp would result in the dredging of approximately 2,596 sq. ft. and filling of approximately 1,800 sq. ft. of shallow bottom area. It would also include the excavation of approximately 3,827 sq. it ofl.1;ighground area (above the normal water line) for ramp approach and . .parking lot area and would reklt in the placement of approximately 7,645 sq. ft. of concrete and gravel. The proposed new boat ramp and floating dock would incorporate approximately 1,800 sq. ft. of Public Trust Waters. Approximately 1,128 sq. ft. of this incorporation would be from non pre- existing structures (boat ramp and floating dock). Minor increases in turbidity can be expected during construction. PROJECT SUMMARY: The NC Wildlife Resources Commission proposes to double the size of the existing boat ramp and add a floating dock and renovate the public parking area. PROJECT DESCRIPTION The project site is located at the intersection of the Waccamaw River and NC Highway 904, adjacent to the Waccamaw River, in Brunswick County. To locate the property from the intersection of NC Highway 17 S and NC Highway 904, turn right onto NC Highway 904/Longwood Road NW and travel approximately 5.2 miles. Turn left onto NC 904/Pireway Road NW and continue to just before the Waccamaw River Bridge. Turn left at the NC Wildlife Boating Access sign. The project site is a 1.90-acre parcel of land located just south of NC Highway 904 and bordered by the Waccamaw River to the west and the Rivergate Estates community to the south. The property has approximately 450 linear feet of shoreline frontage on the Waccamaw River and the average width of the waterbody is approximately 250 feet. The high ground property consists primarily of a 27,628 sq. ft. gravel parking area surrounded by lawn grasses, Dog Fennel (Anthemis arvensis), Water Oaks (Quercus nigra), Sweet Gum (Liquidambar stryciflua), Black Willow (SaZix nigra), Loblolly Pines (Pinus taeda), and Bald Cypress (Taxodium distichum). The property has an average elevation of approximately 6 feet above normal water level. Existing structures on the property consist of a concrete boat ramp which is located on the western property boundary measuring approximately 14' x 90' with a concrete apron measuring approximately 12' x 30'. The shoreline adjacent to the ramp is stabilized with rip rap which averages approximately 20' in width and extending approximately 50' on the south side of the ramp and approximately 60' on the north side. ~t' , ;; The waters of the Waccamaw River in this location are classified as "c Sw" by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is not open to the harvest of shellfish. PROPOSED PROJECT The Commission proposes to replace the existing single concrete boat ramp with a double concrete ramp. Each side of the ramp would measure 14' x 100' with 50' of the ramp extending below the normal water line and 50' above the normal water line. The new concrete apron would measure 20' x 32' with a con~rete abutment measuring 8' x 19.7'. The concrete abutment would connect to a new 8' . x 80' wood floating dock located between the ramps. In order to comply with the Americans with Disabilities Act, a handicap accessible concrete ramp measuring 5' x 107' in total length would wrap around the designated handicap parking space and connect to the concrete apron and would be located landward of the 30' Coastal Shoreline Buffer. The new ramp would require the excavation of 410 cu. yds. of clay and sand material below the normal water line and 90 cu. yds. above the normal water line in order to obtain a final depth of -7.6' at the waterward end of the ramp, giving the ramp a 14% grade. The existing ramp has a 10% grade and a water depth of -4.8' at the terminal end of the ramp. The excavated material would be placed on the southeastern side of the property in an area measuring 50' x 100' and would be contained by a silt fence. The spoil material will be turned into grass berms along the property line after dewatering. There would be approximately 50 cu. yds. of additional riprap placed an average distance of 3' waterward of normal water line to a maximum of 4' waterward of the normal water line adjacent to the new ramp as needed for shoreline stabilization. Concrete Ramp = 560 sq. ft. Concrete Apron - 360 sq. ft. Total Impervious Area = 28, 548 sq. ft. The proposed impervious surface coverage area for the entire project site is as follows: Gravel Parking Area = 26,000 sq. ft. Concrete Ramps = 1,500 sq. ft. Approach/Abutment = 200 sq. ft. Handicap Parking = 500 sq. ft. Total Impervious Area = 28,200 sq. ft. 10. ANTICIPATED IMPACTS The proposed boat ramp would result in the dredging of approximately 2,596 sq. ft. and filling of approximately 1,800 sq. ft. of shallow bottom area. It would also include the excavation of approximately 3,827 sq. ft of high ground area (above the normal water line) for ramp approach and parking lot area and would re~~lt in the placement of approximately 7,645 sq. ft. of concrete and gravel. The proposed new boat ramp and floating dock would incorporate approximately 1,800 sq. ft. of Public Trust Waters. Approximately 1,128 sq. ft. of this incorporation would be from non pre- existing structures (boat ramp and floating dock). Minor increases in turbidity can be expected during construction. Expanded Boatramp Facilitv . 1) This permit authorizes only the docks, boatramps, piers, and other structures and uses located in or over' the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the boatramp facility. Any sewage discharge at the facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. The permittee is not relieved of this requirement if he abandons the permitted activity wit.~out having it transferred to a third party. This permit does not authorize the interference. with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, Dn the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Boatramp The boat ramps shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a \vatertight containment structure. Live concrete shall not be allowed to contact ,vaters of the State or waters that will enter waters of the State. Excavation and ground disturbing activities above and below the normal water line, as shown on the attached \vorkpIan drawings, that are associated with the construction of the boat ramps shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the permit application dated 11/1/05 and the work plan drawing labeled 5 of 7 and dated 10/25/05. Shoreline Stabilization 10) The alignment of the permitted riprap shall be staked by the permittee and approved on-site by a representative of the Division of Coastal Management. The alignment of the approved riprap shall not extend more than 4 feet from the normal water level, as shmvn on the attached \vorkpIan drawings, at any point along its alignment. 12) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 13) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. I Spoil Disposal I ~ 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to I ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e,g, silt fence, diversion swales or berms, etc.). , 15) No spoil material shall be placed within 30 feet of the Normal Water Level. 16) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. . Stormwater Mana2:ement 17) The N.C. Division of Water Quality approved this project under stormwater management rules of the ' Environmental Management Commission under Stormwater Permit No. SW8051126 on 1/17/06. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 18) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 19) No vegetated wetlands shall be excavated or filled, even temporarily. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 052156), which was issued on 12/16/05.
