However, the rest of the allegations appear to be unfounded since: 1. Waste was applied onto an appropriate crop. 2. Waste was applied NO CLOSER than 30 feet to waters of the State (no closer than 50 feet in other areas). And this was looking far any tiny bit of litter. 3. Waste was applied at agronomic rates. 4. The receiving field has 0-2% slope. S. Waste did not reach any rights -of -way. & Mr. Sparks is/has been actively working with Wilkes County Soil and Water to improve his no -till cropping system and to install grassed (fescue and small grain) field borders. The process for doing so is described below. Condition V.3. of your Cattle Waste Management Permit General Permit states: "Any containment basin, such as a lagoon or a storage pond, used for waste management shall continue to be subject to the conditions and requirements of this General Permit until properly closed. " Since your operation does not include management of any liquid waste or utilize a containment basin, there is no structure to "close out." My inspection of December 6, 2011 confirms the presence of two roofed dry stacks, one containing only dry poultry litter waste and the other, equipment. However, the permit does require you to submit a letter to the Division of Water Quality requesting rescission of the Certificate of Coverage (COC). You may send your written request to my attention at the address contained in the letterhead. I will review your request and forward it to the Animal Feeding Operations Unit in Raleigh for consideration. In addition to the written request, please complete the attached Closure Report Form and include it with your correspondence, Please be aware that per North Carolina General Statute (NCGS) 143-215.1 OB and 143-215.1 OC, any agricultural feedlot activity involving 100 or more confined cattle is considered an animal operation requiring coverage under an Animal Waste Operation General Permit. Additionally, any cattle activity that causes a violation of the State's water quality standards (ex. pH, dissolved oxygen, fecal coliform, turbidity, etc.) could still subject you to civil penalty assessments. In closing, be advised that nothing in this letter should be taken as removing you from the responsibility or liability for failure to comply with any State Rule, State Statue or permitting requirement. One of the objectives of conducting soil survey updates by MLRA is to provide uniform soil names and interpretations across political boundaries. W ith the 20 to 30 year difference in the age of soil surveys in the Southern Piedmont, this had not been possible. This. is but the first step in joining and modernizing all the soil surveys in the state, regardless of age. As we are completing the soil survey of the Southern Piedmont Major Land Resource Area in North Carolina, we decided to join the previously published counties to the newest, most modern soil surveys. Part of the process has included recogniz ing the areas of the Southern Piedmont that are in the mesic temperature regime. All of the soils within Wilkes County are in the mesic temperature regime. The amended soil survey legend retains the original publication symbols where possible. However, some map unit symbols were changed to keep the revised legend in alphabetical order. As updating continues in Wilkes County, further correlation amendments will be made and publication symbols added or dropped. Interpretations and data should, for the most part, be unchanged from previous versions on the Soil Data Mart. All of the revised soil names, data, and interpretations will be available in the Web Soil Survey and the Soil Data Mart. The nontechnical soil descriptions have all been revised and are ready for use in planning. While most animal waste management activities and record keeping were in excellent order, there remain however, other issues that still warrant your attention. Specifically, there were no precipitation records for the last two years. A review of our files also documents that you were reminded during last year's inspection to record precipitation type and amount daily for all precipitation events as a part of your Cattle Waste Operation General Permit requirements (Section III. 43a.). A reminder, that the failure to have complete records is a violation of the Cattle Waste Management System General Permit and North Carolina General Statute (NCGS) 143-215.10C. In reviewing the on -site waste application records, staff also documented that poultry litter had been land applied onto several fields that were not in either the beef or poultry waste plans. The following tracts/fields could not be located in your copy of the waste plans: T-277 F- 11, 12, & 16; T-9761 F-1 & 2; and T-306 F-5. Additionally, "corn" and/or "fescue hay" crops need to be added to the waste plan(s) for the following tracts/fields to correlate with the 2006 waste application records: T-9860 F-1; T-437 F-1 through 6; T-423 F-1, 3& 4; and T-424 F-1. Failure to abide by the Certified Animal Waste Management Plan is a violation of NCGS 143-215.10C and your animal waste management permit. As discussed during the inspection, it is your responsibility to contact a technical specialist for assistance in correcting these discrepancies. Per your request, a spreader calibration form has also been enclosed for your use. Discharge rates and application SPREADER SYSTEM rates change over time as equipment gets older and components wear. For solid or semi -solid application equipment, application rates and patterns may vary depending on forward travel and/or PTO speed, gear box settings, gate openings, operating pressures, spread widths, and overlaps. Equipment should be calibrated on a regular basis to ensure proper appli- cation rates and uniformity. Calibration is a simple procedure involving col- lecting and measuring the -material being applied at several locations in the application area. Calibration helps ensure that nutrients from animal waste are applied efficiently and at proper rates. Solid or semi -solid (slurry) applicators can be calibrated by one of two methods: load -area method, and weight -area method. Load -Area Method To use the load -area method, you must know the spreader capacity. Spreader capacity is normally rated by the manufacturer and often is indicated on the application equipment. Liquid spreaders are normally rated in gallons while semi -solid spreaders are rated in either bushels or cubic feet. As the name implies, the load -area method involves applying a full load to a measured area. For ease of measurement, it is best to use a rectangular field pattern. For PTO -driven spreaders, application rate is dependent on ground speed so a uniform speed must be maintained throughout the swath length. Ground -driven applicators apply reasonably uniform rates independent of ground speed. Refer to fact sheet AC-553-5 for detailed calibration proce- dures. Weight -Area Method The weight -area method is often used for solid and semi -solid spreaders. The procedure involves measur- ing the spreader discharge over a small measured area. The application rate is determined by dividing the collected material (weight) by the collection area. Weight -Area Method Calibration Procedure 1. Obtain a tarp or plastic sheet of about 100 square feet (9'X12'. 10'X10', 10;X12', etc.) and measure for exact surface area (length X width). 2. Weigh the tarp using a set of spring -tension or platform scales. 3. Spread the tarp and pin on the field surface at each corner with a tent stake or long nail through the eyelets. 4. Operate the spreader over the center of the tarp at the speed normally driven when applying manure on the field. 5. Make two additional passes on two opposite sides of the center of the tarp at the normal spreader overlap spacing. 6. Remove and fold the tarp being careful not to spill any collected material. Subtract the empty tarp weight from the gross tarp plus manure weight to obtain the weight of manure applied. 8. Divide the amount of manure collected (pounds) by the tarp area (square feet) and multiply this value by 21.8 (43,560 ftz/ac divided by 2,000 lbs/ton) to convert pounds per square foot to tons per acre. Spreader Pattern Uniformity Determination of spreader uniformity is an impor- tant component of spreader calibration. The pattern shape and uniformity determines the overlap re- quired for uniform application. To determine the uniformity of spread and the amount of overlap needed: 1 • Place aline of small pans or trays equally spaced (2 to 4 feet apart) across the spreader path (See Figure 2) • Label the pans chronologically as left or right from the center pan. Center pans may need to be shifted slightly out of the spreader wheel tracks. (Pans should be a minimum of 12 by 12 inches, no more than 24 by 24 inches, and 2 to 4 inches deep.) 2. Make one spreader pass directly over the center pan at normal operating speed and spreader settings. Record — spinner PTO speed, — flow divider delivery point onto the spinners, and -- the spreader gate setting. 3. Weigh and record the contents caught in each pan, 4. The effective spread width is found by locating the pan on either side of the path center where the contents caught in the container is one-half the amount caught in the center pan. 5. The distance between the two pans on either side of the center (in Number 4) is the effective width. This will be removed as needed and land applied at agronomic rates. 2. You also mentioned the stock trail needs maintenance and repair. I am addressing this by reinstalling the culvert at the west end of the trail and making any needed repairs. I also will be pouring a curb at the east end, nearest the barn, to prevent future waste spillage. f ' 3. Vegetation will be established as needed. 4. The creek bank in the pasture behind the silos will be addressed. I am unsure as to the best course of action, but I am considering removing the cattle from the stream by means of a fence and providing alternate water. 5. I have made contact with the Wilkes Soil and Water Conservation District to make necessary adjustments to my waste plan to account for the pearl millet. This Notice of Intent is to summarize water quality concerns and violations noted during the inspection. Specifically, staff noted that prior discharge and stream condition concerns have escalated since last year's compliance inspection. The following items, therefore, require your immediate attention and should be addressed in your response to our office: 1. On the date of the inspection, Ms. Rosebrock noted past evidence of silage run-off coming from the silos, through the barn lot and surge pile check dam, traveling approximately 111 feet downhill, to the creek where it has been discharging. Although on the date of. the inspection there was no discharge flowing, the current situation still allows for the continued discharge to surface waters of the State, especially during rain events. -Our files also indicate that you were previously notified of this violation and strongly urged to prevent future discharges (see July 22, 2000 and July 23, 1999 DWQ Notices of Violation). This is a continued violation of NCGS 143-215.1, your Certified Animal Waste. Management Plan (CAWMP), and deemed permit. 2. The stock trail is in need of immediate and extensive maintenance and repair. On the date of the compliance inspection an unpermitted discharge of solid animal waste was also observed to be - - - -- coming from the stock -trail near the freestall barn. The -above silage waste'discharge described in #1 appears to have combined with animal waste from the stock trail to kill a swath of vegetation approximately four feet wide downhill to an unnamed tributary to Little Bugaboo Creek (Class C waters of the State). This is -a violation of NCGS 143-215.1, your Certified Animal Waste Management Plan (CAWMP), and deemed permit. These situations allow for a probable water quality violation (fecal, BOD, turbidity, nutrients, etc.), particularly if conditions deteriorate further. 4. While reviewing the farm's waste application records, it was also noted that the receiving crop (pearl millet) differed from that designated in the CAWMP (corn silage). While it is possible, and even probable, that the receiving crop may vary fora particular year, the -CAWMP should be revised to coincide with a farm's particular cropping system. Failure to 'have complete records is a violation of NCGS 143-215.1, the CAWNW,.and deemed permit. The Winston-Salem Regional Office is considering recommending an enforcement action against you for the above referenced violations. If you have justification that these violations are caused by circumstances beyond your control, or you have an explanation that you wish to present, please respond in writing within fifteen (15) days following receipt of this notice. The Winston-Salem Regional Office will review your response and forward it to the Water Quality Section Chief with the enforcement package. A nitrogen balance had not been calculated and recorded for each field either. Please note that waste and soil records, once obtained, should be kept for a minimum of five years. Failure to have the above components available and complete is a violation of your Certified Animal Waste Management Plan. As you know, waste applications should be applied during the time the crop can utilize the nutrients in the waste. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. The Wilkes staff visited my farm, and after careful consideration, we decided on the following plan of action. These items include: 1. Cover the silage with plastic to prevent rainwater from saturating it. This will eliminate run-off from the silos. 2. Clean the gravel filter and replace as necessary. 3. Re -vegetate the waterway below the silos. I have competed items 2 and 3 and will have item 1 completed by August 2"d. This should eliminate any problems associated with the silage run-off. Upon investigation, this office found an illegal discharge of rainwater from one of the silage bins that ultimately discharges into an unnamed tributary of Little Bugaboo Creek. The silage discharge caused the dissolved oxygen to drop below the stream standard of 5.0 mg/L. This discharge must cease immediately! Pursuant to North Carolina General Statute § 143-215.1 (a), " No person shall do any of the following things or carry out any of the following activities until or unless such person shall have applied for and shall have received from the Commission a permit... (1) Make any outlets into the waters of the State.
