These are violations pursuant to North Carolina General Statute § 143-215.1 (a)(1)&(6) and Title 15A of the North Carolina Administrative Code, Chapter 2, Subchapter 2H, Section .0217(d). FINDINGS ► Mr. George Smith and Mr. Ron Linville of this office responded - to a complaint of which they met with you on February 21, 1996, and subsequently inspected your waste storage pond. At that time you admitted the waste storage pond was overflowing. The waste storage pond was topped and overflowing into Little Hunting Creek, Class WS-III waters of the State. The illegal discharge from the waste storage pond was entering the creek at two locations. ► On February 27, 1996 Mr. George Smith and Mr. Danny Hockett of this office met with the Wilkes Soil & Water Conservation District. Their files document your Best Management Plan (BMP) was approved on March 7, 1995. During the summer of 1995 Mr. Audie Nicholson, as contracted per verbal agreement with you, proceeded to carry -out a"portion of Phase I construction as set forth in the BMP. (a) Activities for Which Permits Required. -- No person shall do any of the following things or carry out any of the following activi- ties until or unless suchperson shall have applied for and shall have received from the Commission a permit therefor and shall have complied with such conditions, if any, as are prescribed by such permit: (1J Nake any outlets into the waters of the State; (2) Construct or operate any sewer system, treatment works, or disposal system within the State; (3) Alter, extend, or change the construction or method of oper- ation of any sewer system, treatment works, or disposal system within the State; (4) Increase the quantity of waste discharged through any out. let or processed in any treatment works or disposal system to any extent which would result in any violation of the effluent standards or limitations established for any point source or which would adversely affect the condition of the receiving waters to the extent of violating any of the &tan- dards applicable to such water, (5) Change the nature of the waste discharged through any disposal system in any wary which would exceed the efflu- ent standards or limitations established for any point source or which would adversely affect the condition of the receiving waters in relation to any of the standards appli- cable to such waters; (6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters of the State in violation of the water quality standards applicable to the assigned classifications or in violation of any effluent standards or limitations established for any point source, unless allowed as a condition of any permit, special order or other appropriate instrument issued or en- tered into by the Commission under the provisions of this Article; (7) Cause or permit any wastes for which pretreatment is re- quired by pretreatment standards to be discharged, di- rectly or indirectly, from a pretreatment facility to any disposal system or to alter, extend or change the construe- tion or method of operation or increase the quantity or change the nature of the waste discharged from or pro- cessed in such facility; (8) Enter into a contract for the construction and installation of any outlet, sewer system, treatment works, pretreat. Failure to register on or before December 31, 1993, shall result in an appropriate enforcement action being initiated or the facility being required to apply for and receive an individual nondischarge permit. Penalties assessed may be based on any one or a combination of the factors as established in G.S. 143& 282. I (b) and commensurate with actual or potential environmental damage. (d) Failure to obtain approval of a management plan as required by the data specified in Paragraph (a)(1) of this Rule or failure to follow an approved animal waste management plan shall result in appropriate enforcement actions being initiated or the facility being required to apply for and receive an individual nondischarge permit. Penalties assessed may be based on any one or a combination of the factors as established in G.S. 143B-282. I (b) and commensurate with actual or potential environmental damage. (e) The Secretary of Environment, Health, and Natural Resources is delegated the authority to assess fines and penalties for the willful discharge of animal waste from animal or poultry feeding operations pursuant to N.C. General Statutes 143-215(e). (t) Nothing in this Rule shall be deemed to allow the violation of any assigned surface water, groundwater, or air quality standards, and in addition any such violation shall be considered a violation of a condition of a permit. Further, nothing in this Rule :ball be deemed to apply to or permit activities for which a statelNPDES permit is otherwise required. February 1, 1993; December 1, 1984. .0210 LOCAL PROGRAMS FOR SEWER SYSTEMS (a) Jurisdiction. Muaicipalities, counties, local boards or commissions, water and sewer authorities, or groups of municipalities and counties may apply to the Commission for approval of programs for permitting construction, modification, and operation of public and private sewer systems in thew utility Service areas. Permits issued by approved local programs serve in plane of permits issued by the Division. (b) Applications. ApplicationS for approval of local sewer system programs must provide adequate information to assure compliance with the requirements of G.S. 143-215.1(f) and the following raqub=ents: (1) Applications for local sewer -system programs shall be submitted to the Director, Division of Environmental Management, Department of Environment, Health, and Natural Resources, P. O. Box 29535, Raleigh, North Carolina, 27626-0535. (2) The program application shall include copies of permit application forms, permit forms, minimum design criteria, and other relevant documents to be used in administering the local program. (3) An attorney representing the local unit of government submitting the application must certify that the local authorities for processing permit applications, letting permit requirements, enforcement, and penalties are compatible with those for permits issued by the Division. (4) If the treatment and disposal system receiving the waste is under the jurisdiction of another local unit of government, then the program application must contain a written Statement from that local trait of government that the proposed program complies with all its requirements and that the applicant bas entered into a satisfactory contract which assures continued compliance. (5) Any future amendments to the requirements of this Section shall be incorporated into the local Sewer system program within 60 days of the effective date of the amendments. (6) A professional engineer licensed to practice in this State Shall be on the Staff of the local sewer system program or retained as a consultant to review unusual situations or designs and to answer questions that arise in the review of proposed projects. The quality control measures taken in reference to the deviations cited in the Inspection report are acceptable, however, you failed to completely address the deviations listed below: (1) In order to adequately analyze all BOD samples, the dilutions must cover the full range of possible usage. It is therefore recommended that a 100% sample, 5051a, and 25% be set. (2) The lab did not respond to the lack of certification for Method 8100. Until the lab is certified for this method, any samples reported as analyzed by 8100 are reported in violation of North Carolina's Certification Requirements. (3) Log books are required for all balances. The Mettler BAS/BAL did not have a log book available. Upon correction of the above deviations, all requirements cited in this inspection will be met and your laboratory will continue to meet the requirements of 15A NCAC 2H .0800 for the analysis of environmental samples. Please respond to these deviations within 15 days. If a future inspection should reveal that the deviations cited in the inspection report were not corrected, enforcement actions may be recommended. Wilkesboro NC 28659 March 22, 1995 Mr. Williams, The Wilkes Soil and Water Conservation District Board of Supervisors would like to formally notify you of your acceptance for cost sharing wider tine North Carolina Agricultural Cost Share Program. However, some items should be brought to your attention. On June 27, 1994, Mr. George Smith with DEM and Mr. Ronald C. Howard with NRCS met with you on your farnn with the intent of developing a certifiable animal waste system. Mr. Howard mentioned several action items that must be accomplished before the systent can be certified. 1) The waste storage pond must be pumped down a mininium of three feet from the surface of the push -off ramp and ntainntauned at a 1.5 foot minninnum from tine push -off ranip. The intention beuig is to reduce chances of overflow front the waste storage pond during wet weather periods. 2) Within the new plan, take necessary actions to place all contaminated run-off into die waste storage pond. The intention being is to eliminate this discharge to Little Hunting Creek. It is die intention of die Wilkes Soil and Water Conservation District to provide technical assistance and work within the guidelines of the North Carolina Ag, Cost Share Program to provide financial assistance. hi order to do this, certain criterion must be inet at your farm. 1) Item # 1 above must be followed at all times. Your waste storage pond should not be allowed to fill above its intended capacity. 2) The practices that you ilistall must be mauitained for a ntuiinium of ten years. If damage occurs or maintenance is needed, take corrective actions itiunediately. 3) You must work to gain favorable standing with DEM. Failure to comply with these rules will result in forfeiture of cost share moneys and/or technical assistance. If you have received cost share dollars, and cost shared practices are not maintained or carried out correctly, the cost share dollars will have to be repaid.
