The purpose of this letter is to summarize our findings. DWQ made the following observations: • Fencing was installed 25 feet or greater from the creek excluding cattle. • All denuded areas had vegetation growing. • Two new graveled creek crossings/access points were installed. • One new graveled creek access point was installed. • Cattle were removed from the small lot next to road with creek flowing through it. DWQ would like to thank you for your quick response and efforts, and for the corrective actions that have taken place. Based on the observed site modifications it is our determination that no further action is necessary. These photos do not do justice to the changes and hard work that Mr. Hayes implemented at this site. Changes include: fencing installed >25 feet from the creeks excluding cattle, everything re -vegetated (even the upslope pastures), two new graveled creek crossings/access points, and one new graveled water access. It should be noted that Mr. Hayes paid out of his pocket to make these changes, but did seek technical assistance from Watauga Soil & Water. This visit was the result of an anonymous complaint received by our office alleging the run-off of cattle manure and sediment from your property into waters of the State. The surface waters in question are unnamed tributaries (UT) flowing into Howard Creek, which are C1ass'C waters also rated as Trout Waters and High Quality Waters, located within the New River Basin. Our site investigation confirmed that at least 150 beef cattle are/were being maintained on the property resulting in severely denuded pastures and the run-off of sediment and animal waste into the streams. Additionally, at least 1,000 linear feet of stream is impacted due to excessive animal activity in and around the tributaries. As a consequence of the complaint investigation the following violations are documented: Item I. Permit Violation On March 12, 2012, staff observed at least 150 beef cattle being maintained on a denuded lot or "feedlot" at the above referenced parcel. Per NCGS 143-215.1013 and 143-215.1 OC, any agricultural farming activity involving 100 or more confined cattle is considered an "animal operation" requiring application for coverage under an Animal Waste Operation General Permit. Our records indicate that you have not yet applied for the required permit. Item II. Stream Standard Violations Stream samples were also obtained and analyzed for dissolved oxygen (DO), pH, specific conductance, nutrient levels, five day biochemical oxygen demand (BODS), fecal coliform and turbidity. While there is currently no state water quality standard for specific conductance, nutrients, or BODS the attached results indicate that there is evidence of a significant impact occurring on the subject parcel. There were no violations of the State's water quality standard for DO or pH at the time of the site visit. However, there is certainly the potential for a violation if conditions deteriorate further. The downstream Fecal Coliform result of greater than 6,000 colony forming units (CFU)/l00 milliliter (mL) is greater than the State's water quality standard of 200 CFU/l OOmL. This is a clear indication that excessive cattle activity in and around the streams is impacting surface waters. Given that the fecal coliform levels are elevated downstream of the cattle, there is the possibilty for future civil penalty assessments should staff obtain a required total of five samples within the next 30 days that result in a geometric mean greater than 200 colonies/l00 ml. The downstream turbidity result of 120 NTU is greater than the State's water quality standard of 10 NTU for Trout Waters. This again is a clear indication that excessive cattle activity in and around the streams is impacting surface waters. In addition to the above mentioned violations, a wastewater discharge pipe was observed to be discharging into the unnamed tributary behind the onsite rental residence. This information has been relayed to the Watauga County Environmental Health office as well as a copy of this letter. Corrective Action Options and Re nested Response Option 1: Upon receipt of this letter, you have sixty (60) days to submit the attached "State Application for New or Expanding Animal Waste Operations" and all supporting documentation. Please note that the application is to be completed using information from a Certified Animal Waste Management Plan (CAWMP). Once the application has been completed and signed, the original and two copies of the application must be returned (along with three copies of the entire CAWMP) to the Division. The Watauga County NRCS/SWCD Field Office staff can assist you in developing a CAWMP. Their office number is (828) 264-3850. Be aware that operation of your facility (in its current condition) without coverage under a valid general permit could result in civil penalty assessments of up to $25,000 per day. If you wish to pursue this option, we urge you to contact the Watauga County NRCS/SWCD Field Office to discuss proposed implementation practices. At minimum, cattle should be excluded from the stream and vegetation established in the buffer area along the stream'to prevent further run-off of sediment and animal waste. The Winston-Salem Regional Office requests that you respond in writing, within thirty (30) days, regarding the permit violation described above, including whether you intend to apply for a permit. Your response should also contain a plan and specific descriptions detailing how and when the stream standard violations are to be addressed.
