Skvada, Ili Secretary As you may recall, I visited your property on September 12, 2013 in response to a complaint alleging the run-off of sediment and animal waste into an unnamed tributary (UT) of Beaver Creek from a beef cattle pasture located in the above parcel. I am grateful for the cooperation I received from you and your sons that day as stream samples were obtained and the complaint was investigated. My follow-up call to you on September 17, 2013 (recorded by voice mail) was to apprise you of the fecal coliform test results. A reminder that, on the date of my visit, the fecal coliform bacteria was determined to be 80 colonies/100 ml upstream of the beef cattle activity, and 800 and 2,400 colonies/100 ml at two downstream sites where cattle have access to the stream. The initial results indicate that excessive cattle activity has impacted surface waters. The State's water quality standard for fecal coliform bacteria is 200 colonies per 100 ml (maximum). Given that the fecal coliform level was elevated downstream of the cattle, there is the probability for future fecal coliform standard violations should we obtain a total of five samples within 30 days that result in a geometric mean greater than 200 colonies/100 ml. Our office has made several telephone attempts to contact you over the last few months regarding corrective action. Staff with the Surry County Soil and Water Conservation District office (SWCD) has also called to offer their technical assistance. It was my understanding that you had planned to exclude all, cattle from surface waters by installing fencing and/or moving the cattle to another location. Recent observations, however, indicate that the cattle still have access to the stream, the embankments continue to be denuded, and that several inches of sediment persist in the creek. Torres January 31, 2014 Page 2 Please be aware that the section of Beaver Creek in question is classified as Class C Waters by the NC Division of Water Resources (DWR). Surface water classifications are designations applied to streams, rivers, lakes, etc. which define the best uses for which they are to be protected and carry with them an associated set of water quality standards to protect these uses. Class C waters are to be protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological integrity, and agriculture. Secondary recreation includes wading, boating, and other uses involving human body contact with water where such activities take place in an infrequent, unorganized, or incidental manner. To avoid potential violations in the future, the Division strongly recommends the following corrective actions: 1. Limit or deny cattle access to the stream. You may wish to contact the Surry County SWCD/NRCS office at (336) 386-8751 for any technical or financial assistance you might need. 2. Permanent vegetation should be established in the buffer area along the stream to prevent further run-off of sediment and manure during rain events. 3. Respond in writing to this office, within 30 days, describing your plans for eliminating cattle impact to Beaver Creek. Your response should be sent to my attention at the address included at the bottom of page one.
