$12,538.70 which includes $538.70 in investigative costs. Attached is a copy of the assessment
document explaining this penalty.
This action was taken under the authority vested in me by delegation provided by the Secretary
of the Department of Environment and Natural Resources and the Director of the Division of
Water Quality. Any continuing violation(s) may be the subject of a new enforcement action,
including an additional penalty.
Within thirty days of receipt of this notice, you must do one of the following three items:

A request for remission or mitigation is limited to consideration of the reasonableness
of the amount of the penalty and is not the proper procedure for contesting the
accuracy of any of the statements contained in the assessment letter. Because a
remission request forecloses the option of an administrative hearing, such a request
must be accompanied by a waiver of your right to an administrative hearing and a
stipulation that there are no factual or legal issues in dispute. You must execute and
return to this. office the attached waiver form and a detailed statement which you
believe establishes whether:
(a) one or more of the civil penalty assessment factors in G.S. 143B-282. I (b)
were wrongfully applied to the detriment of the petitioner;
(b) the violator promptly abated continuing environmental damage resulting from
the violation;
(c) the violation was inadvertent or a result of an accident;
(d) the violator had been assessed civil penalties for any previous violations;
(e) payment of the civil penalty will prevent payment for the remaining necessary
remedial actions.

Acting pursuant to delegation provided by the Secretary of the Department of
Environment and Natural Resources and the Director of the Division of Water Quality, I, Jeffrey
O. Poupart, Supervisor of the Non -Discharge Compliance and Enforcement Unit of the Division
of Water Quality (DWQ), make the following:
I. FINDINGS OF FACT:
A. On the date of the freeboard and discharge violations, Keith Stephens owned and
operated Stephens Dairy, a dairy operation located on Fax Welborne Road in
Surry County.
B. The Stephens Dairy was deemed permitted as a nondischarge facility on February
1, 1993 in accordance with 15A NCAC 2H .0217. An approved animal waste
management plan is required by 15A NCAC 2H .0217 as a condition of being
deemed permitted.
C. A waste utilization plan (WUP) is a required component of an animal waste
management plan in accordance with G.S. 143-215.10C(e).
D. The approved animal waste management plan certification for Stephens Dairy was
received by DWQ on May 17, 1999. The certified animal waste management plan
(CAWMP) states that animal waste shall not be discharged into surface waters or
drainageways by overspraying. The CAWMP further states that animal waste
shall not be applied during rainfall events or when the soil is saturated.
E. The CAWMP additionally states that the waste storage pond must maintain
storage for a 25-year, 24-hour storm event in addition to one foot of mandatory
freeboard. A minimum of 18 inches of storage is required for this facility.

F. On March 20, 2003, DWQ staff inspected the Stephens Dairy in response to a
complaint. Staff observed animal waste being irrigated, during a rainfall event,
from the waste storage pond at the Stephens Dairy and onto a pasture sprayfield
located east of the farm drive. Staff further observed a discharge of wastewater
from the sprayfield into a freshwater pond owned by Vernon Medley. The
freshwater pond, containing the animal waste, was observed overflowing the
spillway and flowing downstream into the Mitchell River, a Class C water of the
State within the Yadkin River Basin.
G. Keith Stephens had no valid permit for the -above -described discharge activities.
H. DWQ staff collected surface water samples from the discharge into the freshwater
pond. Turbidity was 180 Nephelometric Turbidity Units.
I. The water quality standard for turbidity will not exceed 50 Nephelometric
Turbidity Units (NTU) as set forth in 15A NCAC 2B .0211(3)(k).
J. On March 20, 2003, staff observed only two inches of available storage in the
waste storage pond.
K. The cost to the State of the enforcement procedures in this matter totaled $538.70.
Based upon the above Findings of Fact, I make the following:
H. CONCLUSIONS OF LAW:
A. Keith Stephens is a "person" within the meaning of G.S. 143-215.6A pursuant to
G.S. 143-212(4).
B. The Medley freshwater pond and the Mitchell River constitute waters of the State
within the meaning of G.S. 143-215.1 pursuant to G.S. 143-212(6).
C. The above -cited discharge constituted making an outlet to waters of the State for
purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143-
215.1.
D. The above -cited application of animal waste during a rain event is a violation of
the non -discharge deemed permit and G.S. 143-215.1.
E. Keith Stephens violated 15A NCAC 2B .0211(3)(k) because turbidity in the
discharge to the Medley freshwater pond exceeded 50 NTU.
F. The above -cited failure to keep adequate storage in the waste storage pond is a
violation of the non -discharge deemed permit and G.S. 143-215. 1.

G. Keith Stephens may be assessed civil penalties in this matter pursuant to G.S.
143-215.6A(a)(2), which provides that a civil penalty of not more than twenty-
five thousand dollars ($25,000.00) per violation may be assessed against a person
who is required but fails to apply for or to secure a permit required by G.S. 143-
215.1.
H. The State's enforcement costs in this matter may be assessed against Keith
Stephens pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282. I (b)(8).
I. The Supervisor of the Non -Discharge Compliance and Enforcement Unit,
Division of Water Quality, pursuant to delegation provided by the Secretary of the
Department of Environment and Natural Resources and the Director of the
Division of Water Quality, has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:
M. DECISION:
Accordingly, Keith Stephens is hereby assessed a civil penalty of:

permit as required by G.S. 143-215.1.
for violation of 15A NCAC 2H .0217 and G.S. 143-215.1
by applying animal waste during a rainfall event

pond as specified in the CAWMP.

(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;

(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs
over which the Environmental Management Commission has regulatory authority;

Acting pursuant to delegation provided by the Secretary of the Department of
Environment and Natural Resources and the Director of the Division of Water Quality, I, Jeffrey
O. Poupart, Supervisor of the Non -Discharge Compliance and Enforcement Unit of the Division
of Water Quality (DWQ), make the following:
I. FINDINGS OF FACT:
A. On the date of the freeboard and discharge violations, Keith Stephens owned and
operated Stephens Dairy, a dairy operation located on Fax Welborne Road in
Surry County.
B. The Stephens Dairy was deemed permitted as a nondischarge facility on February
1, 1993 in accordance with 15A NCAC 2H .0217. An approved animal waste
management plan is required by 15A NCAC 2H .0217 as a condition of being
deemed permitted.
C. A waste utilization plan (WUP) is a required component of an animal waste
management plan in accordance with G.S. 143-215.10C(e).
D. The approved animal waste management plan certification for Stephens Dairy was
received by DWQ on May 17, 1999. The certified animal waste management plan
(CAWMP) states that animal waste shall not be discharged into surface waters or
drainageways by overspraying. The CAWMP further states that animal waste
shall not be applied during rainfall events or when the soil is saturated.
E. The CAWMP additionally states that the waste storage pond must maintain
storage for, a 25-year, 24-hour storm event in addition to one foot of mandatory
freeboard. A minimum of IS inches of storage is required for this facilitv.

F. On March 20, 2003, DWQ staff inspected the Stephens Dairy in response to a
complaint. Staff observed animal waste being irrigated, during a rainfall event,
from the waste storage pond at the Stephens Dairy and onto a pasture sprayfield
located east of the farm drive. Staff further observed a discharge of wastewater
from the sprayfeld into a freshwater pond owned by Vernon Medley. The
freshwater pond, containing the animal waste, was observed overflowing the
spillway and flowing downstream into the Mitchell River, a Class C water of the
State within the Yadkin River Basin.
G. Keith Stephens had no valid permit for the above -described discharge activities.
H. DWQ staff collected surface water samples from the discharge into the freshwater
pond. Turbidity was 180 Nephelometric Turbidity Units.
I. The water quality standard for turbidity will not exceed 50 Nephelometric
Turbidity Units (NTU) as set forth in 15A NCAC 2B .0211(3)(k).
J. On March 20, 2003, staff observed only two inches of available storage in the
waste storage pond.
K. The cost to the State of the enforcement procedures in this matter totaled $538.70.
Based upon the above Findings of Fact, I make the following:
H. CONCLUSIONS OF LAW:
A. Keith Stephens is a "person" within the meaning of G.S. 143-215.6A pursuant to
G.S. 143-212(4).
B. The Medley freshwater pond and the Mitchell River constitute waters of the State
within the meaning of G.S. 143-215.1 pursuant to G.S. 143-212(6).
C. The above -cited discharge constituted making an outlet to waters of the State for
purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143-
215.1.
D. The above -cited application of animal waste during a rain event is a violation of
the non -discharge deemed permit and G.S. 143-215.1.
E. Keith Stephens violated 15A NCAC 2B ,0211(3)(k) because turbidity in the
discharge to the Medley freshwater pond exceeded 50 NTU.
F. The above -cited failure to keep adequate storage in the waste storage pond is a
violation of the non -discharge deemed permit and G.S. 143-215.1.

G. Keith Stephens may be assessed civil penalties in this matter pursuant to G.S.
143-215.6A(a)(2), which provides that a civil penalty of not more than twenty-
five thousand dollars ($25,000.00) per violation may be assessed against a person
who is required but fails to apply for or to secure a permit required by G.S. 143-
215.1.
H. The State's enforcement costs in this matter may be assessed against Keith
Stephens pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8).
I. The Supervisor of the Non -Discharge Compliance and Enforcement Unit,
Division of Water Quality, pursuant to delegation provided by the Secretary of the
Department of Environment and Natural Resources and the Director of the
Division of Water Quality, has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

Please find, attached, documents supporting the Winston-Salem Regional Office's request for yet
another civil penalty assessment against the Stephens Dairy in Surry County. This request is based on the
facility's continued lack of compliance and cooperation and the most recent site visit conducted March
20, 2003 in response to a complaint alleging the application of animal waste during a rain event.
On the date -of the. complaint investigation,-sfaff observed animal waste=tieing pvmped'from the
Stephens Dairy waste pond and irrigated onto a pasture field next to the dairy during a rain event. Animal
waste was observed running off the pasture field, into a drainage ditch, and discharging into a freshwater
pond owned by Mr. Vernon Medley. The dairy's waste storage pond was documented to be only two
inches from overflowing. Several field parameters were recorded and waste samples obtained for
analysis. Turbidity -of -the -accumulated run-off reaching a drainageway, just prior to Mr. Medley's -pond
was found to be 180 NTU, a violation of the NC Water Quality Standard for Freshwater Classifications.
The Winston-Salem Regional Office considers this facility an immediate threat to the
environment. We request that you initiate appropriate action from your office and forward the package to
the Water Quality Director for review.

Mr. Stephens violated his CAWMP (Certified Animal Waste Management Plan) and NCCS by
applying waste during a rain event that resulted in a discharge to waters of the State. He also
caused the discharge of animal waste into a privately owned freshwater pond owned -by Mr.
Vernon Medley. To date, DWQ has not.rece-ived a report of any impact to the freshwater pond.
Since the operator has no soil or waste analysis records, or waste application records it is difficult
to determine whether the plant available nitrogen limit per field has also been exceeded due to
the misapplication of animal waste.
2. The duration and gravity of the violations:
Unknown. Based on information -supplied-from-the�complaint- caller, animal -waste may only ------
have been discharging from the spray field a few hours prior to investigation by the WSRO.
The darn of the waste pond appears to be intact for now. However, with chronic rainfall
continuing in the area and increased pressure on the dam wall due to consistently high waste
levels, there is concern for a possible catastrophic failure of the dam on the south side of the
structure.
The WSRO has recently confirmed chat Farm Credit has hegun forrclosurr pmceedin,gs on this facility due to non-
payment of the mortgage since December 2002. Facility's waste application equipment has been repossessed

Unknown. To date, there have been no substantiated reports of downstream impacts outside of
the area of investigation.
4. The cost of rectifying the damage:
Estimated $4000. Costs would involve pumping the waste level down approximately three feet
below the spillway, cost of the soil/waste analysis, and repair/seeding of the damaged spillway
area. it%SRO suggests pnmpin,g at least three feet of waste so that faciliy is in compliance when new owner (most
like! Farm Credit) takes possession in approximated 120 days. -�"'

The amount of money saved by noncompliance:
Estimated $2000 for the cost of applying just enough animal waste to bring the waste level into
compliance.
G. Whether the violation were committed willfully or intentionally:
We believe these violations to be committed willfully and intentionally. Mr. Stephens has been
notified several times since 1998 for violations of his Certified Animal Waste Management Plan,
including 1998 NOV/NOI, and June and November 2001 Civil Penalty Assessments for
operating above certified numbers.
Our office has also documented numerous complaints alleging misapplication of animal waste
by Stephens Dairy. Mr. Stephens has been instructed and questioned several times by the WSRO
regarding the proper technique for animal waste application. Prior to the most recent
investigation (March 2003), WSRO staff visited this facility twice in 2003 and cautioned Mr.
Stephens about potentially high freeboard levels if he didn't apply the waste in a timely manner
(seeJanuary15, 2003 and January 29, 2003 inspection reports).
7. The prior record of the violator in failing to comply with programs over which the
Environmental Management Commission has regulatory authority:
1997 (November) - DWQ NOD -issued for inadequate freeboard and poor condition of storage
:pond. T -
1998 (February) - DWQ NOV issued for zero inches of freeboard.
1998 (November) - DWQ NOV/NOI issued for exceeding certified. number of 150. Regional
office investigates and reports that there are 240 animals on site_ Operation is also found to not
have a CAWMP or a certified operator. Dam is found to be denuded and eroding.
1999 (November) - DWQ NOV issued for Invalid Operator's Certification. Operator is also
warned to obtain a revised CAWMP prior to stocking additional animals.
2000 (April) - DWQNOV issued for failure to keep adequate waste, application, and soil
.records. Operator -is -also -notified -of -violations -involving run-off-of-soil/waste from concrete lot;
erosion of storage pond dam; lack of maximum liquid marker; and poor stock trail conditions.
Response to DWQ "10-day letter" not received until June 15, 2000.
2000 (May) - DWQ/NOI issued for inadequate response to April 2000 NOV. Operator is also
told that the exterior lot is a violation of his CAWMP. This correspondence reiterates violations
involving lack of soil, waste„ and application records. Problems with the stock trail, condition of
the darn, and lot run-off are also noted. Operator is again told to install a maximum liquid
marker.
2001 (March) - DWQ NOV/NOI issued for exceeding certified numbers, again. Previously
mentioned violations (see above) are noted in the NOV/NOI. An additional source of
unpermitted discharge is also noted. Operator has still not obtained any soil or waste analyses.
2001 (May) — DWQ NOV/NOI issued for exceeding certified numbers, again.
2001 Dune) -- DWQ issues an assessment of a civil penalty against Stephens Dairy in the amount
of $5,436.46 for violations noted in March 2001 NOV/NOI.
2001 (November) — DWQ issues an assessment of another civil penalty against Stephens Dairy
in the amount of $4,472,44 for violations noted in May 2001 NOV/NOI.
2002 (February) — Show Cause meeting with DWQ, Attorney Generals office, and Mr. Stephens.
2002 (September) — DWQ issues NOV for failure to comply with the Schedule of Compliance
that was finalized April 17, 2002.

Stephens discharge.
b) Receiving stream: Unnamed tributary to Mitchell River, Class C Waters of the State.
c) Damage: None observed.

Since the operator has no soil or waste analysis records, or waste application records it is difficult
to determine whether the plant available nitrogen limit per field has also been exceeded due to
the misapplication of animal waste.
2. The duration and gravity of the violations:
Unknown. Based on information supplied from the complaint -caller, animal waste may only -- - - -
have been discharging from the spray field a few hours prior to investigation by the WSRO.
The dam of the waste pond appears to be intact for now. However, with chronic rainfall
continuing in the area and increased pressure on the dam wall due to consistently high waste
levels, there is concern for a possible catastrophic failure of the dam on the south side of the
structure.
The WSRO has recently confirmed that Farm Credit has begun foreclosure proceedings on this facility due to non-
payment of the mortgage since December 2002. Facility's waste application equipment has been repossessed
3. The effect on ground or surface water quality or quantity or on air quality:
Unknown. To date, there have been no substantiated reports of downstream impacts outside of
the area of investigation.
4, The cost of rectifying the damage:
Estimated $4000. Costs would involve pumping the waste level down approximately three feet
below the spillway, cost of the soil/waste analysis, and repair/seeding of the damaged spillway
area. WSRO suggests pumping; at least three feet of waste so that facility is in compliance when new owner (most
likely Farm Credit) takes possession in apprximaley120 days. --

5. The amount of money saved by noncompliance:
Estimated $2000 for the cost of applying just enough animal waste to bring the waste level into
compliance.
6. Whether the violation were committed willfully or intentionally:
We believe these Violations to be committed willfully and intentionally. Mr. Stephen's has been
notified several times since 1998 for violations of his Certified Animal Waste Management Plan,
including 1998 NOV/NOI, and June and November 2001 Civil Penalty Assessments for
operating above certified numbers.
Our office has also documented numerous complaints alleging misapplication of animal waste
by Stephens Dairy. Mr. Stephens has been instructed and questioned several times by the WSRO
regarding the proper technique for animal waste application. Prior to the most recent
investigation (March 2003), WSRO staff visited this facility twice in 2003 and cautioned Mr.
Stephens about potentially high freeboard levels if he didn't apply the -waste in a timely manner
(see January 15, 2003 and January 29, 2003 inspection reports).
7. The prior recordof the violator in failing to comply with programs over which the
Environmental, Management Commission has regulatory authority:
1997 (November) - DWQ NOD issued for inadequate freeboard and poor condition of storage
pond._ - -
-1998 (February) - DWQ NOV issued for zero inches of freeboard.
1998 (November) - DWQ NOV/NO issued for exceeding certified number of 150. Regional
office investigates and reports that there are 240 animals on site. Operation is also found to not
have a CAWMP or a certified operator. Dam is found to be denuded and eroding.
1999 (November) - DWQ NOV issued for Invalid Operator's Certification. Operator is also
warned to obtain a revised CAWMP prior to stocking additional animals.
2000 (April) -.DWQ NOV-issued-for-failure to keep adequate waste; application; and soil - - -
records. Operator_is.ilso notified of violations involving run-off of soil/waste from -concrete lot;
erosion of storage pond dam; lack of maximum liquid marker; and poor stock trail conditions.
Response to DWQ "I 0-day letter" not received until June 15, 2000.
2000 (May) - DWQ/NOI issued for inadequate response to April 2000 NOV. Operator is also
told that the exterior lot is a violation of his CAWW. This correspondence reiterates violations
involving lack of soil, waste, and application records. Problems with the stock trail, condition of
the dam, and lot run-off are also noted. Operator is again told to install a maximum liquid
marker.
2001 (March) - DWQ NOV/NOI issued for exceeding certified numbers, again. Previously
mentioned violations (see above) are noted in the NOV/NOI. An additional source of
unpermitted discharge is also noted. Operator has still not obtained any soil or waste analyses.
2001 (May) — DWQ NOV/NOI issued for exceeding certified numbers, again.
2001 Dune) — DWQ issues an assessment of a civil penalty against Stephens Dairy in the amount
of $5,436.46 for violations noted in March 2001 NOV/NOI.
2001 (November) — DWQ issues an assessment of another civil penalty against Stephens Dairy
in the amount of $4,472.44 for violations noted in May 2001 NOV/NOI.
2002 (February) — Show Cause meeting with DWQ, Attorney Generals office, and Mr. Stephens.
2002 (September) — DWQ issues NOV for failure to comply with the Schedule of Compliance
that was finalized April 17, 2002.

- Water Quality's (DWQ) Winston-Salem Regional Office visited your farm to investigate the allegations.
DWQ staff found the following violations that warrant your immediate compliance:
1. On the date of the complaint investigation, Staff observed that the waste level in the waste
storage structure was two inches from overflowing the dam. Failure to maintain the waste level
below the maximum storabe volume is a violation of your CAVVMP, deemed permit, and
- NCGS -143-215: Our -records .also indicate that -you were previously cautioned about potential
=1 freeboard violations during youi'Ianuary 2003 compliance inspection and again after a January
29.2003 follow-up inspection.
?. On March 20, 2003 DWQ staff also observed animal waste being* pumped from the waste storage
structure and irrigated during a rain event onto a pasture field owned by Mr. Vernon Medley. The
waste was observed flowing off the pasture and discharging into a drainage. ditch. The animal
waste discharge was also -observed flowing from the drainage ditch and into a freshwater pond
owned by Mr. Medley. On the data of the complaint investigation, pond water, also containing
the animal waste, was overflowing the pond's spillway and combining with another drainage
ditch that flows into the Mitchell River (Class C waters of the State).
Several violations of the CAIVW, deemed permit, and NCGS 143-2I5.1 were noted as a result of
the unpermitted discharge of animal waste from the sprayfield:
- The CAWMP states that animal waste is to be. applied by a pump -and -haul method, not through
irrigation.
- The CAWMP states that animal waste is not to be applied during rain events.
- The CA)A'MP. deemed permit, and NCGS state that "animal waste shall not reach waters of the

Today 's investigation is the result of a complaint received by the Surry SWCDINRCS office alleging that the operator was applying

waste in the rain.. Questions left blank were not applicable to this facility, andlor this investigation at this time.
1. WSRO staff observed that animal waste was in fact being irrigated during a rain event onto a cattle pasture owned by Mr. Medley.
The soil was so saturated that anima] waste was observed flowing off of the application pasture and into a ravine, and then discharging
into a freshwater pond owned by Mr. Medley. Freshwater and the dark colored animal waste was also observed discharging through the
freshwater pond's spillway where it mixed with other freshwater run-off and flowed into a UP to the Mitchell River. Parameters and

Tanay's investigation is the result of a complaint received by the ,Surr y SWCD/NRCS of alleging that the operator was applying

waste in the rain.. Questions left blank were not applicable to this facility and/or this investigation at this time.
1. WSRO staff observed that animal waste was in fact being irrigated during a rain event onto a cattle pasture owned by Mr. Medley.
The soil was so saturated that animal waste was observed flowing off of the application pasture and into a ravine, and then discharging
into a freshwater pond owned by Mr. Medley. Freshwater and the dark colored animal waste was also observed discharging through the
freshwater pond's spillway where it mixed with other freshwater run-off and flowed into a UT to the Mitchell River. Parameters and
samples were obtained for: pH, DO, temp., fecal coliform, turbidity, BOD, and nutrients.
