Cattle have also been fenced from the area to allow vegetation to establish. Soil has been added to the lower corner of the waste storage pond to help contain heavy rainfall. Waste was not in danger of entering waters of the State on today's visit. 5. No severe threats on today's date but operator will still need to maintain the dam on the waste storage structure and earthen divider that seperates freshwater ditch and milk parlor waste ditch. 6. Per operator, a design for a new waste pond has been done and Surry SWCD is to lay out the design next week. 16. Facility does not have an irrigation gun yet to apply waste correctly. Operator is supposed to have irrigation system installed by this winter. Operator was instructed to install anoroariate gun prior to oumoine attain. The purpose of today's visit was to document that the waste storage structure was not overflowing and that parlor waste was not AL entering a freshwater ditch that flows to waters of the State. Another complaint was.received by DWQ about two weeks ago. The repairs made since the last inspection are a temporary solution only. Facility may need to be checked until the new waste storage pond and irrigation system is installed. Director > Division of Water Duality O `C July 31, 2002 Mr. Danny Hodges 125 Boone Trail Road Low Gap, NC 27024 SUBJECT: Follow -Up Inspection Hodges Farm (Formerly Mountain View Dairy), #86-12 Surry County Dear Mr. Hodges: This letter is to summarize our follow-up inspection and conversation of July 29, 2002 regarding animal waste management issues observed on your dairy farm in Surry County- Last Friday's visit was a result of a Notice of Deficiency (NOD) issued by our office in April 2002. A copy of the final inspection report is enclosed for your review. As we discussed, there are four main issues that could/are affecting the water quality in an unnamed tributary to Beaver Dam Creek. The items described below are to be addressed iinmediately and a written response to these items is expected within two weeks of receipt of this letter. Your response is to include statements and specific descriptions as to how the following water duality concerns have been addressed: 1. On July 26, 2002, only six inches of freeboard was observed in the waste storage structure. While we recognize that a significant amount of rainfall had occurred within the 24 hours prior to our follow-up inspection, this situation continues to pose an immediate threat to the environment due to the potential for an unpermitted discharge to waters of the State. The waste level should be pumped down to at least 18 inches below the lowest point on the darn and the waste land -applied to an actively'" growing crop. As we discussed, pasture is an acceptable receiving crop. 2. After our initial inspection in April 2002, the waste level in the storage structure was lowered with a 6hp pump and flexible 4-inch hose. The waste was pumped from the waste storage structure and allowed to just run out onto the pasture on the top of the hill. Although we did not find any evidence of over application or discharge to the creek last Friday, simply pumping onto the ground from the hose is not an acceptable method of waste application. You should consult with an irrigation specialist and/or the Surry County Soil and Water Conservation District for the proper application of waste using an irrigation gun appropriate for your particular situation.:> 3. Run-off of sediment, manure, and feed was also observed entering a surface water ditch that eventually flows into the unnamed tributary mentioned above. As suggested, the cattle should be excluded from the lot containing the surface water and parlor waste ditches and the area seeded with a permanent type of vegetation. N. C. The earthen divider between the surface water and waste ditches needs to be built-up immediately. Cattle traffic and precipitation has worn this "wall" down so that less than 12 inches separates the milk parlor waste from the surface water ditch. As described in #3 above, the cattle should be fenced from the area and permanent vegetation established as soon as possible. Once items 1-4 have been addressed you should continue working with the Surry County Soil and Water Conservation District to derive a permanent solution to managing the manure and parlor waste on the farm. Are getting run-off of sediment, feed, and waste into a freshwater ditch which flows into waters of the State. Also, there is the potential for the waste from the milk parlor ditch to mix with the surface water run-off ditch. Suggest fencing cattle out of pasture where itches and drains are located and re -grading earthen wall between freshwater ditch and milk parlor ditch. Need to re -seed area, too. 4. Waste storage pond waste needs to be pumped immediately and land applied to a receiving crop (pasture). Staff of the Division of Water Quality -Winston-Salem Regional Office performed an inspection at your dairy as a result of a complaint received by our office alleging an overflow from the waste storage pond into the creek. Mr. Danny Hodges (manager of the dairy) was also present and accompanied Staff during the inspection. A copy of the final inspection report is enclosed for your review. Our investigation, unfortunately, revealed some concerns that warrant your immediate attention and action. On the date of the investigation, Staff observed that the settling basin/waste storage pond had only five inches of freeboard before waste could discharge over the spillway. It appeared that waste had previously spilled -over the embankment and that 6-12 inches of feed and/or bedding had been piled in the two lower corners of the structure to help contain the waste. This situation poses an immediate threat to the environment due to the potential for an unpermitted discharge to an unnamed tributary Beaver Dam Creek (Class C Waters of the State), which is only 480 feet downhill from the waste storage structure. Run-off of sediment, manure, and feed was also observed entering a surface water ditch, then dispersing onto a grassed waterway, prior to entering the creek. A fecal coliform sample taken from the waste structure near the spillway had a reported result of 48,000 colonies/100 mL. Please note that the North Carolina water quality standard for fecal coliform is only 200 colonies/100mL. A dissolved oxygen reading, taken in the same corner of the waste structure, was only 0.07 mg/L. The water quality standard for this parameter is 5.0 mg/L. We are still awaiting results on the nutrient and total dissolved solids analyses. - .----This situation --is of particular concern to the State in that an unpermitted discharge from your waste structure would most assuredly cause a water quality violation in Beaver Dam Creek. A review of our files indicates that you were previously issued a Violation for an illegal discharge observed on November 14, 1995. Your written response to our office stated that you were working with the Surry Soil and Water Conservation District (SWCD) to derive a permanent solution to managing the manure and parlor waste on the farm. To date, a permanent solution does not appear to have been implemented. N. C. You should also be aware that the non -permitted discharge of any type of wastewater to the waters of the State is illegal and is a violation of North Carolina General Statute (NCGS) 143- 215.1 (a), which states: No person shall do any of the following things or carry out any of the following activities until such person shall have applied for and received -from the Commission a permit therefore and shall have complied with such conditions, if any are prescribed by such permit ... Make any outlets into waters of the State. This means that you could be subject to this penalty even though the farm is below threshold numbers. Note that, in this region of the state, you must have a minimum of 18 inches of extra storage in your waste pond at all times. You should pump waste from structure immediately and land -apply the waste at agronomic rates to an existing crop, or to a crop that is expected to be actively growing within 30 days. You may wish to consider the construction of a larger waste holding pond or the installation of a tank to contain the parlor waste. These and other options were discussed with Danny Hodges during the inspection. The ditch disperses onto a 237'x 18' grassed waterway prior to entering Beaver Dam Creek. The old waste storage pond was not closed out according to NRCS standards. The dam was reportedly just pushed in. Dept. of EHNR NOV 10 1997 Winston-Salem: Regional Officer Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, was ratified by the North Carolina General Assembly on June 21, 1996. This bill required that a properly certified operator be designated as the Operator in Charge for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or. more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. The deadline for designating an Operator in Charge for animal waste management systems involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and certification program was not yet available for these systems, you were allowed to apply for and were issued a temporary animal waste management certificate from the Water Pollution Control System Operators Certification Commission (WPCSOCC). Because you applied for and were issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an animal waste management system. Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate that you have not obtained a permanent animal waste management system operator certification. If you intend to remain the Operator in Charge of the facility for which you were designated, you must obtain a permanent animal waste management system operator certification of the appropriate type before your temporary certification expires on December 31, 1997. To obtain a permanent certification, you must be 18 years of age, complete ten hours of approved training, and pass an examination. If you do not intend to remain the Operator in Charge, a properly certified animal waste management system operator must be designated as Operator in Charge of the facility prior to the expiration of your temporary certification. This year's final training program for both Type A and Type B animal waste management systems is scheduled for December 10 and 11, 1997, at the Hunt Horse Complex in Raleigh. This bill requires that a certified operator be designated as the Operator in Charge by January 1, 1997, for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. Our records indicate that your facility is registered with the Division of Water Quality and meets the requirements for designating an 01C. A training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry. Owners and operators of these systems will be issued temporary animal waste management certificates by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. To obtain a permanent certification, you will be required to complete ten hours of training and pass an examination by December 31, 1997. A training and certification program for operators of animal waste management systems involving cattle, sheep, horses, and poultry is now being developed and should be available by the spring of 1997. The type of training and certification required for the operator of each system will be based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste. As the owner of an animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether yourself or another person, must complete the enclosed application form for temporary certification as an animal waste management system operator. The inspection was conducted in order to determine the waste levels and structural integrity of the waste lagoon as well as overall waste handling capabilities. Observation at the site revealed serious problems with respect to proper disposal of animal waste. The farm appears to have a old lagoon that has been full for a long time, judging from the amount of solids and the heavy vegetation in the lagoon. Any wastes that go to the lagoon immediately flow over the solid waste that is in the lagoon and into a ditch that carries the waste products to the stream. Emptying,waste from the lagoon should be incorporated into your farm's management plan so that at least 18 inches of freeboard is kept on a regular basis. Personnel from this office visited the dairy on April 27, 1994 and January 9, 1995 concerning reports of improper waste disposal. During those inspections, no problems were noted due to inaccessibility to the illegal discharge area. On the day of the lagoon inspection the waste stream was flowing from the lagoon, down the ditch to the stream. The non -permitted discharge of any type of wastewater to the waters of the State is illegal as per North Carolina General Statute 143-215.1. Steps should be taken immediately to remedy the problems associated with animal waste runoff. If you have any questions about how to handle these problems, please contact the Surry Soil and Water Conservation District. You are requested to respond in writing to our Winston-Salem Regional Office on or before January 22, 1996 advising what corrective actions have been or will be initiated to prevent future illegal discharges from the waste lagoon.
