Dear Mr. Methven:
On December 1, 2005, at the request of Kevin Yates of The John R. McAdams Company, Inc., I
conducted an on-site determination to review one feature located on the subject property for
applicability to the Neuse Buffer Rules (15A NCAC 2B.0233). The feature is labeled as "G" on
the attached maps initialed by Amy Chapman on December 1, 2005.
The Division of Water Quality (DWQ) has determined that the feature labeled as "G" on
the attached maps is subject to the Neuse Buffer Rule, the origin of this feature has been
delineated and flagged in the field with a flag labeled, "Start Neuse Buffer G". This stream
feature and its associated buffers should be identified on any future plans for this property. The
owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in
any future correspondences concerning this property. This on-site determination shall expire
five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c/o John Dorney, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. Applicants are
hereby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends
that the applicant conduct this notification in order to be certain that third party appeals are made
in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail

Thanks for getting the buffer concurrence letter out Friday. But, I was wondering if you could possibly ID the start
buffer point on feature "G in a letter (just below pond 2) or place the approximate start point on the map below
pond 2 and reference it as being the start buffer point. We need to be able to show the City of Raleigh that'pond 2
is not buffered for their approval.

The proposed project consist of constructing a residential community with multi-family and single-family housing. The
project will include roads, sewer line, a force main, stormwater collection, and amenities such as a pool and
clubhouse. Stormwater management facilites will not impact waters of the U.S.. Traditional equipment will be used
such as front-end loaders, graders, and earth movers. The construction of the project will be separated into two
phases, however, the applicant would like to apply for the 401 permit as if it were one phase.

Dear Mr. Race:
On January 27, 2005, at your request l conducted an on-site determination to review fine features
located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B
.0233). These features are labeled as =`A, B, C, E and F" on the attached maps initialed by me on
January 27, 2005.
The Division of Water Quality (D'ti' Q) has determined that the features labeled as "A, B
and C" on the attached maps are subject to the Neuse :Buffer Rule, all three features have
been delineated in the field and identified as the following: The origin of feature A is "start
NBR flag #A0111; the origin of feature B is "start channel #F01"; and the origin of feature
C is "start channel #GOV. Features E and F are both not subject. These features and their
associated buffers should be identified on any future plans for this property. The owner (or
future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property. This on-site determination shall expire five (5)
years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in wwritin- c/o John Uomey, DWQ iVetlands/401 Unit, 2321 Crabtree Blvd.,
Raleigh, NC 27604-2260, Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. ` Applicants are
hereby notified that the 60-day statutory appeal time does not start until the affected party
(including downstream and adjacent landowners) is notified of this decision. DWQ recommends
than the applicant conduct this notification in order to be certain that third party appeals are made

On January 27, 2005, at your request I.conducted an, on-site determination to review. five features
located on the .object property for applicability to the Nettie Buffer Rules (15A NCAC. 213
,0233). These, eatures am labeled as "A, B, C, E and F' on, the, attached maps initialed by, me, on
January 27, 2005.
The Division`cf Water Quality (DWQ) has deter>miirted that the features labeled as "A B
and C" on the attached snaps are subject to the Neuse Buffer Rule, all three features have
been delineated in the field and identified as the following: The origin of feature A is "start
NBR flag #A01"; the origin of feature B is "start channel 001"; and the origin of feature
C is "start chFtnnel #CAV. Features E and F are both not subject. These features and their
associated buffers should be identified on any future plans for this property. "Ific owner (or,
future owners) should notify the.DWQ (arid other relevant agencies) of this decision in any,
future correspondences cpnterning this property, This on-site determination shall expire five, (5)
ycars from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer tole naay request a
determination by the Director. A request for a determination by the Director shall be referred to
