Ballard Homes, ESP Associates, P.A. has enclosed a copy of the information packet sent to the USACE for Application to use NWP #39 within the proposed Twelve Oaks Subdivision in Union County, North Carolina. The project has been carefully planned to avoid nearly all wetlands, streams and open waters on the property. With the exception of one unavoidable road crossing, all remaining jurisdictional waters will be preserved in Common Open Space or, for the minimal areas located within lots, with deed restrictions. Ballard Homes proposes to develop 24.13 acres of land in Union County, North Carolina. The proposed development would be known as Twelve Oaks Subdivision and marketed as a low-density 24-lot single-family residential community. The site for the proposed Twelve Oaks community is located on a single parcel at the corner of Chambwood Road and New Town Road. The area surrounding the proposed community is zoned for single-family development and contains several existing single-family residences, as well as new residential subdivisions. The property is bordered on its northeastern side by Price Mill Creek. The specific goal of the Twelve Oaks community will be to offer an upscale residential alternative for the Waxhaw, NC area, while retaining the existing environmental and natural resources for the enjoyment of community residents. D. Ballard Homes hopes to provide significant natural resource conservation, enhancement and preservation, while also offering a reasonable, high-quality single-family community development in an environmentally sensitive and well-planned manner. Jurisdictional Impacts The project as planned avoids impacts on natural resources to the maximum extent practicable. Avoidance of impacts on jurisdictional areas was a central effort in the many considerations of residential development design. The roads, utility corridors, and other developmental aspects of the proposed project are all planned after the jurisdictional areas were thoroughly investigated. ESP personnel identified approximately 750 linear feet of stream, 0.4 acre of open water (existing on-site pond), and 0.16 acre of jurisdictional wetlands within the project boundaries. The applicant was able to limit jurisdictional impacts to 0.01 acre of wetlands, and approximately 125 linear feet of perennial stream (the proposed project avoids impacts to approximately 95% of jurisdictional waters on the site). These impacts are necessary to provide access to the northern portion of the property via construction of a subdivision cul-de-sac street with a 40-foot right-of-way. This is the only area proposed for impact where the project purposes could not be accomplished with any practicable alternatives. Mitigation These impact quantities are within NWP #39 thresholds of 0.5 acres of wetlands and 300 if of perennial stream and also remain below the thresholds for NCDWQ written concurrence, which are 0.10 acres of wetlands and 150 if of intermittent or perennial stream. The 24.13-acre Twelve Oaks Subdivision has been designed to avoid and minimize the impacts to waters of the U.S. on site through a careful planning process. Of the approximately 0.6 acres of jurisdictional area spread out across the project site, only 0.019 acres of impacts are proposed. Proposed compensation consists of the avoidance of the remaining 0.58 acre of jurisdictional area, minimization of impacts to the maximum extent possible, and preservation of riparian buffers along the remaining jurisdictional waters, contained primarily within a contiguous block of approximately 5 acres of C.O.S. encompassing the entire northeast corner of the property. This preservation area will provide excellent wildlife habitat, and will compliment and enhance the high quality residential community proposed for the site. The preservation area will also act as a natural filter for runoff associated with the development, and will compensate for any minimal water quality impacts to downstream waters. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. The property is in the shape of a pentagon. A tributary of Price Mill Page 6 of 13 Creek enters the site from the adjacent parcel to the northwest and flows southeast across the property to Price Mill Creek which flows along the northeastern property boundary. An existing sanitary sewer line corridor crosses both the on-site tributary and Price Mill Creek at the eastern corner of the property. Near the center of the property, the tributary has been impounded to create an approximately 0.4-acre pond with a forested wetland feature that transitions between the stream and the pond The area surrounding the proposed Twelve Oaks community is zoned for single-family development and contains several existing single-family residences as well as a new residential subdivision to the north and another south of New Town Road. 10. Describe the overall project in detail, including the type of equipment to be used: Proposed impacts on the 2413-acre site include 0.01 acres and 125 linear feet of jurisdictional impact all of which is associated with placement of clean fill for construction of a subdivision road necessary to access lots in the northern portion of the property. A double 36"/single 48" cross-culvert will be constructed across the stream and wetland area above the 0.4-acre pond Mechanized excavation and grading equipment will be necessary for installation of the culvert. Cross-sections of the impact area are included with this application 11. Explain the purpose of the proposed work: The development of a 24-lot low-density single-family residential project is proposed. The specific goals of the development are to create a high quality residential real estate project that enhances the market value of the property in an environmentally sensitive and well- planned manner. The Twelve Oaks community will offer an upscale residential alternative, while retaining the existing environmental and natural resources for the enjoyment of community residents The proposed impacts are necessary to provide access to the northern portion of the property, without which the desired low-impact design of the project would not be economically feasible IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Several factors have contributed to the choice of location for this project: the availability of the property for purchase at an economically feasible price and the unique asset of an existing nsite pond, as well as sufficient developable upland areas to allow for the upscale development plan using large one half- to one-acre lots. As impacts from preliminary plans were identified, the project engineers and planners worked with the landowner to redesign the community layout to minimize and avoid all possible impacts. The position of the road crossing was adjusted several times as the more accurate wetland survey map was generated, to avoid impacts to the pond and reduce stream impacts. Because the project design has already employed a very low-density development plan that should result in approximately 37% of the developable area left in green space, we do not believe that further avoidance is feasible. A nearly 5-acre portion of the site in the northeast corner of the property has been preserved as Common Open Space. This area includes the 0.4-acre pond and adjacent natural areas that will be used as a nature preserve with walking trails for community residents. The concept of low-density single-family residential was chosen over the more traditional high-density subdivision plan in an effort to reduce impacts to natural resources. The jurisdictional area is spread across the project site almost directly through the middle. The road crossing is necessary to allow access to lots in the northern portion of the property. The proposed road crossing is designed to cross the wetlands and stream in a perpendicular direction to minimize impact quantities. Fill material used in impact locations will be unpolluted, and appropriate sedimentation and erosion control measures will be implemented. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors Page 10 of 13 including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Proposed compensation consists of the preservation of riparian buffers along the remaining jurisdictional waters. Most of the remaining waters are within a large, contiguous block of approximately 5 acres of natural area preserved in C.O.S., encompassing the entire northeast corner of the property. The 200 linear foot onsite stream segment, upstream of the proposed culvert crossing, is also within C.O.S. The average buffer width will be approximately 20 ft from the limits of the wetlands or top of bank of the stream and pond. Most areas will be considerably greater than 25 feet, but several locations will be less due to site constraints on building lots (see site plan). This preservation area will provide wildlife habitat, and will compliment and enhance the high qualitv residential community proposed for the site. The preservation area will also act as a natural filter for runoff associated with the development, and will compensate for any minimal water quality impacts to downstream waters. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. For additional information regarding the application process for the NCEEP, check the NCEEP website at http://h2o.enr.state.nc.us/wrp/index.htm.
