Dear Mr. Zarzecki:
On November 21, 2005, at your request I conducted an on-site determination to review a feature located
on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is
labeled as "B" on the attached map initialed by me on November 21, 2005. Division of Water Quality
(DWQ) Staff from the Raleigh Regional Office had previously conducted an on-site determination of the
stream. In your letter to the Director dated November 17, 2005, you requested an appeal of their
determination as provided within 15A NCAC 02B .0233(3)(a).
At your request, I conducted an appeal of their determination as stated above. During my review I
evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach B and
calculated the score to be 8.5 points. The form states that if the score is "greater than or equal to 19 points
the stream is at least intermittent".
The DWQ has determined that the stream labeled as "B" on the attached map is not subject to the
Neuse Buffer Rule. This determination shall replace the determination originally performed by the
Regional Office.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information please call me at (919) 733-
9721. This determination is subject to review as provided in Articles 3 & 4 of G.S. 150B.

On behalf of the buyer of the subject property (Westfield Homes) and the property owner (Bespack, Inc.)
we request an appeal of the buffer determination performed by Mr. Eric Kulz of the Raleigh Regional
Office for the subject property. On November 15, 2005, Mr. Kulz met Aaron Cooper of our office on site
and determined feature B to be subject to the Neuse Buffer Rule (see attached USGS & Soil Survey
map(s)). However, we believe this feature lacks the necessary indicators of an intermittent/buffered
stream channel. Therefore, we request a re-evaluation of Mr. Kulz's analysis. Please accept this letter as
an official request. We are only appealing the determination of stream "feature B". We do not disagree
with the other determinations throughout the property. Your help in clarifying the status of the
application of the Neuse Buffer Rules to this feature is greatly appreciated.
We have not yet received a copy of Mr. Kulz's report and as such do not have a DWQ project number to
provide you at this time. Please contact me at your earliest convenience to coordinate a site meeting for

The owners of the Sherron Rd/NC98 property have decided not to proceed
with the stream appeal call at this time. However, as it happens I have
another property where our client has requested an appeal of a
determination performed by Eric Kulz with Aaron Cooper earlier this
week. I've attached an appeal request for this site. The site is
located on the southeast corner of Laura Duncan Road and Old Apex Road.
It's an existing industrial property (Bespak, Inc.) that is proposed for
residential. A marginal channel exists on the property. Aaron felt
that the stream was ephemeral and Eric scored it at 19 points and
decided to call it. The developer feels that it will drastically effect
their project and directed us to request an appeal of Eric's call.
There is a Town of Apex community park located just south of the
property. If you are willing to go to this site in leu of the Durham
site, then please plan to meet me near the park entrance. We'll access
the stream from the park property. I'll plan to meet you at 10 am
unless you would like to meet earlier. I'll bring a signed copy of the
request to the meeting.
