At this meeting, Tommy Burchette, NRCS Civil Engineering Technician; Daphne Cartner, DSWC Environmental Engineer; Mike Bowman, Forsyth County Soil Conservationist and myself walked over your farm and discussed ways to solve the water quality problem. Our technical assistance was requested after you received a Notice of Violation from the NC Division of Water Quality for "settleable solids & turbidity" violations. According to the notice, these violations were due to excessive streambed and bank erosion. During our field evaluation on 1/28/03, we discussed the streambank erosion problem and the possibility of fencing the cows out of the creek. Due to the difficulties in getting adequate amounts of water from existing wells (you said that you only get about 2-3 gallons per minute), we decided that providing an alternative watering system was not feasible on this faun. Also, we looked at constructing several stream crossings. Suitable sites could not be found due to the very steep terrain. In addition, we discussed the construction of a pond or sediment basin to catch the soil before it leaves your property. According to Tommy Burchette, building a pond would be very difficult and expensive due to site conditions (i.e., state road below dam & a tremendous amount of soil would need to be moved to construct an emergency spillway). Based on these observations, we decided that the most severe erosion is caused by inadequate vegetation on the pastureland, steep terrain and overgrazing. We can provide assistance to address this erosion problem. At this time, I will provide you with general recommendations to accomplish this task. Specific guidelines (seeding rates, etc,) will be provided as needed. PHASE I • Plant perennial grass (fescue) in areas along the creek and hillsides that are bare or do not have a good stand of vegetation. • Install permanent fence along the creels from the road culvert to 200' upstream. NOTE: Phase I is essentially completed. The Dept. of Transportation plans to install a larger road culvert in the near future. Since this area will be disturbed, we will need to re- evaluate after pipe installation is completed. It usually takes 4-6 weeks to get the results back so gather samples soon. The sample boxes and info. sheets are available at the Extension office (767-8213). • Existing gullies need to be filled and graded to a uniform shaped and seeded. Temporary electrical fencing will need to be erected for whatever period of time it takes to get the area stabilized and the grass established. Also, a diversion will need to be constructed to divert the water coming through the pipe under the gravel road. We will need to survey these areas and flag off the practices. Cows [rust be removed before flagging. • We will permanently fence off the largest gullied area below the silage pit. The area will be graded in such a way so that water will spread out. This area will be used for filtering purposes before water reaches the stream, • The diversion and grassed waterways will be seeded and mulched according to our specifications. • Completely renovate the existing pasture. As soon as you can get the cows off, apply lime and fertilizer according to soil test recommendations. In absence of a soil test, apply 2 tons of lime per acre and 1000 lbs. of 10-10-10 fertilizer per acre at seeding time. The pasture will need to be top dressed again in the fall. • Re -seed fescue (minimum rate of 15 lbs. per acre) using a sod drill. PHASE 11 • Provide me with the number of cow/calves and their weights that will be using this pasture. I will base the grazing plan on these numbers. • Follow a prescribed grazing system. I will provide you with guidelines concerning the appropriate start & stop grazing times, rest periods, approximate yields, etc. • Reduce the number of cows that depend on this pasture. You stated that when you completed the new silage pit (across the road), that you would decrease the number and size of cows using this pasture. You must be committed to this approach or all the work will be a waste of time. Consider planting rye or other winter annual for dormant season. We may recommend cross fencing for rotational grazing. I hope that our office can provide financial, as well as technical assistance. Right now, I do not have federal funds for cost share assistance. However, we are expecting funds in April or May_ Remember, if you want cost -share assistance, you can NOT begin work prior to approval of the contract. All practices will have to meet our standards and specifications before you are paid. This violation was issued after Division of Water Quality (DWQ) staff documented that approximately 900 linear feet of an unnamed tributary to Beaver Dam Creek had been impacted by stream bed and bank destabilization and the subsequent deposition of sediment into waters of the State. As a result of these observations, we confirmed violations for settleable solids, turbidity, and removal of best usage. Your letter indicates that you would Iike an opportunity to resolve the water quality issues at the Kapp Livestock Farm. Specifically, your letter states that you are in the process of fencing out approximately 200 linear feet of the creek immediately upstream from the culvert at the end of your property. We further understand that this buffer area is to extend out 15 feet from the,top of the bank on each side of the creek. As noted during previous DWQ inspections, grassy vegetation is also being established on the streambarik:in_ this, area. At that time, the pipe was open and the banks seeded. I could see no other work that was needed. The blockage was apparently caused by branches and silt. I could find no evidence that the blockage was caused by your actions. I have requested that our Hydraulics Department investigate the site to determine if the proper pipe size .was initially installed. I visited your farm on August 28, 2002 per your request. We looked at the streambank erosion problems associated with your cow pasture. At that time, you had already seeded fescue and the grass was starting to come up. We discussed various options to solve the problem. Fencing the cows out of the entire creek, digging a well and installing watering troughs is probably the best solution. As stated, you can apply for cost -share assistance through our office for these practices. We will need to develop a detailed plan and submit to Raleigh for approval. This process may take as much as two months. If approved, the practices will need to be installed according to our specifications before you receive payment. Our office will be glad to work with you if you wish to proceed with this approach. In the meantime, I suggest the following measures: I . Install a fence from the culvert to 200 feet upstream. The fence should be 15 feet from the top of the bank on each side of the creek. 2. Sow fescue in areas near the creek that are eroding or have very little vegetation. You told me in our phone conversation on August 30'h, that you had planted more fescue along the banks and the hillsides. 3. Continue to rotate the cows among other pastures to allow the vegetation to get established. These measures may not solve the problem permanently but should improve the current erosion problems near the culvert. According to the letter from Mike Patton, the NC Department of Transportation will investigate the site to determine if the proper size pipe was initially installed. Installation of a new pipe may destroy some of your new grass so we will probably need to review the situation again. Melissa Rosebrock will re -check the site again in approximately six months to see if the problem has been solved. In the meantime, please call our office at 767-0720, ext. 3 if you need further assistance or would like to apply for cost -share assistance to fence out the entire creek. A subsequent inspection was performed August 26, 2002. A "final.notes"_copy of each of the 2002 inspections is also attached for your review. -Our investigation revealed that approximately 900 linear feet of an unnamed,tributary to Beaver Dam Creek, Class C waters, Yadkin -Pee Dee River Basin, had been impacted by stream bed and bank destabilization, resulting from cattle access, and the subsequent deposition of four to nine -inches of sediment. As a result of these observations and a Regional Office file review of your facility, the following items .are confirmed: (1) settleable solids violation, (2) turbidity violation, and (3) the removal of best usage. Please note that,the need to address streambed and�bank erosion was previously outlined during an August 13, 1997 compliance: inspection in which our records indicate that you were present. Item 1: Settleable Solids From visual inspection, a large deposition of solids to surface waters has clearly occurred. The addition of a notable accumulation of settleable solids, approximately four to nine inches in depth, to waters of the State for approximately 900 linear -feet of the unnamed tributary to Beaver Dam Creek iss-a violation of 15A NCAC 02B .0211 which states: "Water quality standards far all fresh surface waters are the basic standards applicable -to -Class C waters. " Water quality standards for Class C waters are outlined in 15A NCAC 02B .0211(3)(c) which states: "Floating solids; settleable solids; sludge deposits; only such amounts. attributable to sewage, industrial wastes or other wastes. as shall not make the water unsafe or unsuitable for aquatic life -and wildlife or impair the waters for any designated uses." Item 2: Turbidity It was determined from stream samples obtained on August 26, 2002 that a violation of the turbidity standard for Class C waters has occurred as a result of streambed and bank erosion associated with excessive cattle traffic in the unnamed tributary to Beaver Dam Creek. The water quality standard for turbidity, outlined in 15A NCAC 02B .0211(3)(k), states that: "The turbidity in the receiving water shall not exceed 50 Nephelometric Turbidity Units (NTU) in streams not designated as trout waters..." A stream sample taken approximately 752 feet upstream from the culvert had a reported turbidity of 150 NTU. NDENR N. C. These impacts to the stream represent a violation of best usage. Specifically, 15A NCAC 02B .0211(2) states that either a short-term or long-term preclusion of best usage, which includes aquatic life propagation, biological integrity, wildlife, agriculture, and secondary recreation, represent a water quality standard violation. This Office requires that violations, as detailed above, be abated immediately. Also please note, these violations and any future violations are subject to civil penalty assessment of up to $25,000.00 per day, per violation. We request that you respond to this letter, in writing, within 10 days of receipt of this Notice. Your response should include the following items: • Clearly discuss your efforts to abate impacts to surface waters. This Office understands that a second site visit was conducted by Ms. Rosebrock on August 26, 2002 and that improvements to the stream channel and - -- streambanks-had clear]y-occurred as a result of the. establishment of fescue. and oats. The Division appreciates your'cooperation. However, this Office feels that additional work can be accomplished, specificallythe removal of cattle access .to.the stream channel. Please address this issue. • Discuss.your stabilization and sediment removal efforts and explain how you propose to prevent this problem from occurring in the future. Please keep in mind that even though you are attempting to resolve this issue by stabilizing the stream banks and removing excessive sediment, care must be taken so that these violations do not reoccur or continue. We strongly.urge you to contact the Forsyth County Soil and Water Conservation District (336.767.0720) for continued assistance in developing Best Management Practices for your farm. Sediment has accumulated to a depth of 4 to 5 inches in most of the creek and 9 inches at the culvert. Mr. app and his son have removed most of the sediment from the culvert itself. Per Mr. Kapp, the sediment was piled onto the creekbank, ien removed, and spread on the surrounding pasture and into low areas. The disturbed areas have been have been seeded with fescue id oats and covered with straw. The latest inspection was made on August 20, 2002, and there appeared to have been some effort to clean out the pipe and creek, but it is unsatisfactory. Pictures have been taken during these inspections. The material needs to be removed completely and taken to an off -site disposal area where it will not run back into the creek during rain events. The potential for street flooding due to the material obstructing the pipe is a safety hazard Also, the material may be degrading water quality, which may be a violation under the jurisdiction of the Department of Environmental and Natural Resources. The State has cleaned this pipe out in the past, but it is unfair to the taxpayers to foot the bill for a continuous problem, which is privately caused_ There is an agency that can help offer long terse solutions to this problem and if you would like to have some assistance, Ms. Deridre De Bruhl of the Natural Resources Conservation Service can be contacted at 336-767-0720. Because of the safety issues involved, we would appreciate the prompt cleaning of this material out of the creek and pipe. This is your responsibility. An inspection will be made on September 6, 2002, and if the creek and pipe have not been cleared, we will initiate enforcement action in accordance with GS 136-92 which states "It is unlawful to obstruct a drain along or leading from any public road in the state. AL 3. Today's visit was a result of a complaint alleging that cattle waste from this facility had stopped -up a 52 inch culvert located at the downhill end of the cattle pasture. I was not able to see the culvert since sediment had completely buried the culvert. Approximately 900 feet of stream uphill from the culvert is mpacted due to heavy cattle traffic. Streambank/streambed is eroded and void of vegetation. The stream actually begins as a spring in the pasture. Lots of sediment was noted in the stream. Some cattle manure was noted in the stream, however, sediment appears to be the main concern. Pastures are well vegetated. 24. This facility will need to be checked again after the culvert under Shore Road has been cleaned -out. Though, I have not physically counted the number of cows on the farm, I have not seen 100 cows concentrated in a confined area. During a December 1997 visit, I explained the .0200 regulations to Mr. Kapp. Mr. Kapp told me that he had 50 cows and 45 calves on his "home" farm. These cows are allowed to graze and roam on pasture land. Mr, Kapp has five non-contiguous tracts of pastureland (approx. 200 acres) that he uses for cattle grazing. He stated that he decreased the number of cows raised on his home farm but he had never had over 100 cows confined on one farm. He believes that he was misled when told by a former employee of another agency that he had to register. In my professional opinion, the Kapp Livestock Farm should be removed from the .0200 registration list because he has less than 100 head of cattle on one farm. The cattle are raised on pastureland. This bill required that a properly certified operator be designated as the Operator in Charge for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. The deadline for designating an Operator in Charge for animal waste management systems involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and certification program was not yet available for these systems, you were allowed to apply for and were issued a temporary animal waste management certificate from the Water Pollution Control System Operators Certification Commission (WPCSOCC). Because you applied for and were issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an animal waste management system. Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate that you have not obtained a permanent animal waste management system operator certification. If you intend to remain the Operator in Charge of the facility for which you were designated, you must obtain a permanent animal waste management system operator certification of the appropriate type before your temporary certification expires on December 31, 1997. Our records indicate that your facility is registered with the Division of Water Quality and meets the requirements for designating an 01C. A training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry. Owners and operators of these systems will be issued temporary animal waste management certificates by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. To obtain a permanent certification, you will be required to complete ten hours of training and pass an examination by December 31, 1997. A training and certification program for operators of animal waste management systems involving cattle, sheep, horses, and poultry is now being developed and should be available by the spring of 1997. The type of training and certification required for the operator of each system will be based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste. As the owner of an animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether yourself or another person, must complete the enclosed application form for temporary certification as an animal waste management system operator. Both the designation form and the application form must be completed and returned by December 31, 1996.
