In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse.imp act on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. While doing the operations reviews in Davie county on June 16 - 18, 1997, I appraised the status of these operations. Facility No. 30-01 Ketchie Creek Hog: I have include Mr. Thomas Williams signed request for removal from the register. This operation is out of business and there are no swine present on the site. Mr. Williams does not plan on going back into the swine business. I can confirm that this operation can be removed from the register. Facility No. 30-05 Charlie Barnes Farm: This is a small swine operation that is out of the commercial swine business. Mr. Barnes currently has 1 sow, 7 piglets, 1 boar, and 3 Vietnamese Potbelly pigs in his facility. I have included Mr. Williams' signed request for removal. Due to the level of waste in the holding pond, I cannot confirm this request for removal. Specifically, the inspection was conducted to determine the status of your compliance with Title 15 A, North Carolina Administrative Code 2H .0200 regulations, which govern wastewater disposal systems which do not discharge to surface waters of the State. Animal waste management systems which comply with the .0200 regulations are "deemed permitted" by the Division, and thus, are not required to apply for individual permits for operation. The primary factor in assessing compliance with the regulations is whether or not a discharge of pollutants occurs from the facilities (in your case a lagoon) during any rain event less severe than a 25 year storm. A 25 year storm is a storm of such severity, that it can statistically be expected to recur once every 25 years. A 25 year storm in Yadkin County would amount to any rainfall 6 inches or greater within a 24 hour period. You should be aware, however, that because the weather data used to compile what is a 25 year storm covers many years, it is possible to experience 25 year storms on two consecutive days. Likewise, you could receive 5 inches of rain one day, and 5 inches the next, and neither would constitute a 25 year storm, so you would need at least 10 inches of freeboard to prevent a discharge. At the time of the inspection, it was noted that your lagoon was full with practically no freeboard. The general recommendation for lagoon operators is to maintain at least 16 inches of freeboard in a lagoon (1 foot plus the 6 inches from the 25 year storm) . Please be aware that the construction of manmade pipes, ditches, or other conveyances for the purpose of willfully discharging pollutants to the waters of the State may result in the immediate imposition of civil penalties of up to $5,000.00 for the first offense. Should a discharge from your lagoon occur, you could lose your "deemed permitted" status, requiring submittal of an, individual nondischarge permit application to DEM, or requiring you to get an approved animal waste management plan prior to the mandatory December 31, 1997 deadline for animal waste management plans.
