Reference is made to your request for rescission of the subject animal waste permit Certificate of
Coverage with the submission of a completed Animal Waste Storage Pond and Lagoon Closure
Report Form on November 19, 2009. Staff from the Winston-Salem Regional Office has
confirmed that this Coverage is no longer required. Therefore, in accordance with your request,
Certificate of Coverage No. AWI300002 is rescinded, effective immediately.
If, in the future, you wish again to operate an animal waste management system you must first
apply for and receive a new animal waste permit Certificate of Coverage. Operating an animal
waste management system without a valid animal waste permit Certificate of Coverage will
subject the responsible party to a civil penalty of up to $25,000 per day.

discuss this matter further.

I would like to request that my confined animal operation permit (# AWS30002, Facility
# 30-02) in Davie County, NC be rescinded. I have closed the waste storage lagoon for
my swine operation through the NC Ag Cost Share Program using the Natural Resources
Conservation Service standards and specifications. I have also completed a Waste
Storage Lagoon Closure Plan which was been submitted to Division of Water Quality
regional office in Winston-Salem, NC.

Foster had indicate he is in the process of closing down his storage
lagoon through NC Ag Cos Share program. and hence he be granted a
waiver of the permit fee. Because this facility has an active permit,
it is subject to all the conditions of the general permit until and
unless a completed waste Storage lagoon closure plan is submitted to
this Division and the permit is rescinded. Mr. Foster had indicated
that the closure will occur by Fall of 2008. Please provide us an
update on the progress of the closure process for us to make an

I spoke to Bruce Wilson with NRCS about having a loading stand after the lagoon is closed. He spoke
to the staff in the area office and they appoved having the loading stand. This is based upon having
valves on each house, a valve on the last pit (all these valves are already in place), and installing a
valve on the loading stand. Jerry will also construct a berm around the loading area for containment. If
you have any other questions give me a call.

I concur.
Now the question is whether we can issue him a "zero animal" permit now to avoid
fees? I say no, as he still has some animals (<250). He says his plans are to close
by Fall 2008. That means he must be close to doing so. That means we do not need to
do anything at this time....

I'm a little concerned about the pipe remaining in place from the houses, but I
can see why he wants it left. If the lagoon is being filled in (the waste
cannot end up in an empty hole or converted farm pond), then I would feel a
little better.
I think what he is proposing is in accordance with our rules. If we get a
lagoon closure form, then we can rescind the permit. There is no.requirement to
remove the houses, so he could still use them as he sees fit (provided he stays
under 250). If he is truly operating a system with no lagoon, and he is under
250, I guess we can let him do it.

Melissa,
The Jerry Foster farm can convert its operation type from 225 farrow finish to a 2361 Feeder to finish
operation without exceeding the current 55LW. In order to do this, they need to get an approval from our
office in the form of a new COC. Here is what they will need to get the new COC:
1. Completed application form:

2. Completed certification form with new animal type and numbers:

They cannot go head with the conversion before obtaining a new COC from us.

Dear Permittee:
Your facility is currently approved for operation under one of the Animal Waste Operation General Permits.
These permits expired on October 1, 2004. On June 11, 2004, the North Carolina Division of Water Quality
(Division) issued revised State General Permits for animal facilities. The General Permits were issued in
accordance with the directive of Senate Bill 733 (Session Law 2003-28). The Division staff is currently in the
process of issuing Certificates of Coverage for these revised general permits.
In order to assure your continued coverage under the general permit, you must apply to` the Division for renewal.
Enclosed you will find a Permit Coverage Renewal Application Form. The application form must be completed
and returned within 60 days from receipt of this letter.
Failure to request renewal of your coverage under a general permit within the time period specified may result in
a civil penalty. Operation of your facility without coverage under a valid general permit would constitute a
violation of NCGS 143-215.1 and could result in assessments of civil penalties°of up to $25,000 per day.

Dear Mr. Foster:
On February 5, 2004 Melissa Rosebrock of the Division of Water Quality's Winston-
Salem Regional Office (DWQ-WSRO) performed a compliance inspection at your swine farm in
Davie County. While most animal waste operations appeared to be in order. there is a
recordkeeping concern that requires your attention.
Specifically, Ms. Rosebrock noted that a soil analysis had not been obtained for those
fields that received animal waste in 2003. As discussed during the inspection, failure to have
complete records is a violation of North Carolina General Statute 143-215.10C and your
Animal Waste Management Permit. Please be advised that North Carolina General
Statutes provide for penalties of up to S25,000 per day per violation as well as criminal
penalties for violations of state environmental laws and regulations.
A reminder that a representative Standard Soil and Fertility Analysis, including pH,
copper, and zinc, must be obtained each year. Per the swine waste permit. the results of the sail
tests are to be maintained for three years.

The Non -Discharge Permitting Chit has completed a preliminary review of the subject application. Additional information is
required before we can continue our review. Please address the following by April 27, 2003:
This office currently has a waste utilization plan (WUP) for this facility• that is dated 613011999. The plan was written for
225 Farrow to Finish operation. The Plant Available Nitrogen (PAN) rate in the WUP was generated rising a waste
analysis of the storage pond liquid. Current guidance recommends that an average PAN production rate be calculated
using representative waste samples, at least rivo per year, over a three year period. It is necessary to take these samples
at different times of the Year to reflect seasonal variations in PAN. In addition, irrigation records must be supplied for
the same three near period. Please submit additional information to support the PAN production rate as listed in the
current WUP or revise the WUP to show average "book" values for PAN production at this facility. Please submit a
more recent WUP if you have already revised it since its last submittal.
Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist.
Please reference the subject permit application number when providing the requested information. All information should be
signed, sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter
must be submitted on or before April 27, 2003 or the Division will return your application as incomplete in
accordance with 15A N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a
violation of North Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental
Management Commission.

Got your message re: Foster Farms (30-2). They have one of those
cooperative extension plan with waste analysis. At the time when the
permit came, we were still haggling about the waste analysis
requirements. Once we had a document, they didn't have enough records.
was in contact with Ronnie Thompson on this. I will call him follow up
on this today. Maybe they have a new plan by now. The one I have is
2-26-99. Please let me know if they have updated their plan.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. 1RR1, IRR2, DRY], DRY2, DRY3, SLURI, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

In accordance with State Regulations (15A NCAC 2H .0217(a)(1)(E)) adopted by the Environmental
Management Commission on February 1, 1993, the owner of the subject facility was required to submit a
Certification Form for the facility's animal waste management system by December 31, 1997.
This letter is to advise you that this office has no record of having received the required Certification for
the subject facility. Please provide this office with an explanation as to why this Certification was not
submitted as required. This explanation must be received within 30 days following the receipt of this letter.
Any existing facility owner which did not submit the required certification by the deadline is no longer
deemed permitted to operate their animal waste management system. Therefore, if the certification was not
submitted as required and the facility is still in operation, this facility is being operated without a valid
permit. N.C.G.S. 143-215.6(b) allows the Secretary of the Department of Environment and Natural
Resources to take appropriate enforcement actions for this violation for as long as the violation continues.
As per Senate Bill 1217, which was ratified on June 21, 1996, the Environmental Management
Commission (EMC) may enter into a special agreement with facilities that did not meet the December 31,
1997 deadline. These special agreements can only be issued to facility owners which signed up for assistance
with their local Soil and Water Conservation District Office by September 1, 1996 and which can
demonstrate that they made a good faith effort to meet the December 31, 1997 deadline. The special
agreement, if issued, would contain a specific schedule for the facility to follow to develop and/or implement
an approved animal waste management plan. Attached is an application for a special agreement between the
EMC and the subject facility. If you can demonstrate that this facility can meet the conditions for a special
agreement, you may send this request along with your explanation as to why the plan has not been developed
and implemented. This request would also be due within 30 days from receipt of this letter.

Davie County
On .Tune 18, an Operation Review was conducted of Foster Farms, Inc., facility no. 30-02. This Review,
undertaken in accordance with G.S. 143-215.1 OD, is one of two visits scheduled for all registered livestock
operations during the 1997 calendar year. The Division of Water Quality will conduct a second site inspection.
During the Review, it was determined that waste was = being discharged to the waters of the State, and
the animal waste collection, treatment, storage and disposal systems were properly maintained and operated under
the responsible charge of a certified operator. However, the following management deficiencies were discovered
and noted for corrective action: failure to install start and stop markers within lagoons; and insufficient maintenance
of lagoons (need to mow and remove heavy vegetation). These management deficiencies need to be addressed and
corrected. You are encouraged to contact your certified technical specialist if additional assistance is needed.
During ensuing reviews, these same deficiencies will be re-examined to determine if corrective actions were
implemented.
In order for your facility to remain in compliance with environmental regulations, animal waste cannQ4 be
discharged into the waters of the State, and the animal waste collection, treatment, storage and disposal systems
must be propxjY maintained and operated_ under the responsible charge of a certified operator.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the -Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form,must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

The subject feedlots were visited October 14, 1992, by
George Smith, Mike Mickey and the writer. The following
observations were made:
(1) Foster Farms, Inc. - Mr. Jerry Foster was
met. The lagoon for this hog farm was 4-6
feet below full. According to Mr. Foster, a
dragline had been used within the last year
to remove sediment (mostly sand) from the
lagoon. No problem was seen.
(2) Lazy -A -Farms - On the day of the visit no
discharge was observed. Manure is pushed
from the concrete holding area into a manure
spreader. No lagoon for storm waje'p
collection is present. During heavy rains
runoff will leave the area but such is the
nature of operation. On October 14, 1992, no
violation was observed.

SUBJECT: Letter from Mr. Jerry Foster (Foster Farms Inc.)
dated September 16, 1987 - Davie County
Foster Farms, Inc. was designated by the Director on
September 2, 1987, as a concentrated animal feeding
operation based on the July, 1987, investigation and
investigations prior to 1987 by DEM staff. Investigations
found that hog waste had been discharged into the surface
waters.
Mr. Foster had land available with a spray system
capable of applying the waste in a manner that would not
have created a surface. water problem, -but -the waste was-* not' _ -
- properly applied. Mr. Foster states in his letter, "We
always check close when we are pumping to prevent any
run-off into the streams" and "We have intended to keep
wastes out of the stream...". Mr. Spurgeon Foster, Sr., The
father of Mr. Jerry Foster, told the writer and Mr. Mike
Mickey on July 24, 1987, that he sprayed waste on July 20,
1987, and on that date Mr. Jerry Foster was not at the farm.
Mr. Foster, Sr., also made a statement that sometimes when
you spray you get busy doing other things on the farm and
you don't watch the spray gun. This apparently was the case
on July 20. Pooled hog waste was found next to the stream
approximately 150 yards downslope of the spray gun on July
28, eight days after the waste had been sprayed.
The Fosters' have a system to adequately dispose of the
waste, but history has shown that the system has not been
properly operated.

of the.staff of the Winston-Salem Regional Office. These

tributary to Buffalo Creek, Class "C" waters.
2. A total of approximately 1800 swine are confined.

A National Pollutant Discharge Elimination system

Aaarently, waste entered the stream as a result of runoff
from the spray „irrigation field.

Yes. Waste _sprayed 7/20/87 on farizd. Runoff entered stream
and on 7/24 87 dead fish and oxygen depletion was documented
in Buffalo Creek. In February 1985 WSRO investigated
complaint of odor, and waste entering stream but nothing was
found. In December 1981 a small fish kill (3) occurred due
to excessive waste spray upon initial use of the spray
irrigation device. In 1974 State investigation found a
temporary pipe going into stream from lagoon. A Notice was
issued 5/1/74 to Mr. Spuraeon H. Foster.
Type of Waste Management (Examples: type of confinement -free
stall barns, sheltered or limited shelter dirt lots, paved
or dirt open lots, swine houses, pasture; type of waste
handling -direct spreading in solid form, slotted floor with
lagoon or pit, single or multi -cell lagoon, aerated lagoon,
land application of liquid manure, spray irrigation,
contractor disposal, etc.)
The manure from the hoa houses flows into a laaoon. (There
are two lagoons on the farm) The waste is pumped and spray
irrigated on a field located approx. 150 yards north of the
northern most lagoon. According -to „the Foster'srwater was
last sprayed during the summer 1986. A single nozzle
stationary spray gun is used. Also according to the Foster
some of the water has in the east been hauled to other
sites.
Condition of Waste Management Facility (rate as poor -good,
no discharge, sufficient freeboard in lagoon, etc. Include
weather conditions during inspection.)
On July 24, and 28, 1987 the weather was hot and drv.
Apparently when water is sprayed runoff from the field has
reached the stream. If water is sprayed for short periods
with the sprav aun being moved to different locations there
would be no discharge.
Animal Waste Discharge (including photos and witness` names,
addresses, telephones numbers and statements of fact).
The spray irrigation field and path of the runoff toward the
stream was observed by WSRO staff.Water Quality violations
for dissolved oxygen downstream were documented and a fish
kill was observed.

field measurements, visual observations and slope and
vegetative cover of land adjacent to water, extent of
rainfall and other factors relative to the likelihood or
frequency of discharge of animal wastes and process
wastewaters)
On July 24, 1987 Mr. David Russell and _Mr. Mike Mickey from
WSRO visited Foster Farms, Inc. A small U.T. to Buffalo
Creek flows downslope of the hog farm. This U.T. flows
approx. 1/4 to 1/2 mile below the hog farm before entering
Buffalo Creek. At 0920 hrs Buffalo Creek at SR 1600
(approx. 100 Yds downstream of U.T. confluence into Buffalo
Creek the dissolved oxygen was 1.6 mc,(_1 with a temperature
of 23-C. The water was dark brown and approximately 75_dead
fish (bream, bass, carp, suckers, etc.)were observed
downstream of the bridge. Upstream of the U.T. confluence
into Buffalo Creek at 1125 hrg the dissolved oxy2en was 7.8
mg/l with a temperature of 26 C. The water was clear and
living fish were observed. The U.T. just before entering
Buffalo Creek had_dissolved oxygen of 3.2 mg/1 with_a
tem erature of 28 C. The stream was only about a foot wide
and was brown. The measurements were taken at 1123 hrs.
The investigators met Mr. Spurgeon Foster, Sr. and went
with him to the spray field. A single nozzle stationery
spray gun was Located on ridge in a field covered by weeds
3-6 feet tall. The spray un was !Iaroximately 150 yards
uupslooe of the U.T. to Buffalo Creek. The soil was moist in
the natural drainage path from near the spray gun towards
the stream. The U.T. was clear in the area where runoff
would enter the stream but a short distance downstream the
stream became discolored and was discolored all the way to
Buffalo Creek. -
There was no evidence of the two lagoons having
overflowed_ or the irrigation Lipe from the pump at the
lagoon to the spray gun having leaked. According to Mr.
Foster waste wassprayed on July 20, 1987 to the field.
_ On July 28, 1987 the site was revisited. Stream
sam les were collected and additional observations made.
The spray ,field was again.observed veer etation_ was found
to be wilting in the drainage path from the spray gun
downslope to the stream. About a 6-8 feet wide path of
vegetation had wilted. Apparently, the vegetation in the
runoff path had been "burned" by the nitrogen in the waste.
Photo of vegetation is included). A pool of dark water
approx. 4 feet by 4 feet was found in the runoff Dath about
15 feet from the stream. A photo was taken and is included.
The BOD of the pool was 110 m 1 and the dissolved oxygen
was 0.4 mqZl. The pool was apparently the remains of the
runoff _flow that entered the stream. Upstream of where
runoff would have entered the U.T. the^ BOD was 0.6 mg/I with
a D.O. of 6.0 mg/l. The U.T. downstream just below entering
Buffalo Creek had a BOD of 26 mg/1 with D.O. of 5.4 mg/l.
Buffalo Creek at SR 1600 had a D.O. of 7.7 m2/1 and looked
much im roved as compared to conditions on July 24. A
sample was also taken from a lagoon and the BOD was 500
mg/1. A photo of the lagoon is included. R!
_ Mr. Jerry Foster, son of Mr. Spurgeon Foster, Sr., was
met on July 28. Mr. Jerry Foster is manager of the hoq
o2eration of Foster Farms, Inc.
Observations indicate that waste from lagoon was
sprayed at such a rate and for a long enough period that
runoff entered a U.T. to Buffalo Creek. Water_guality
violations for minimum dissolved oxygen concentrations were
documented and a fish kill resulted in Buffalo Creek.
Recommendations Made to Owner/Operator:
Spray for short periods, move spray gun to different
locations on spray field, disc field to allow for better
ground absorption.
Recommendations for further DEM Action: (Re -inspect,
designate, etc.)
WSRO has investigated this operation in the 2ast due to
complaints but investigations have been after the fact. It
is recommended the operation be designated so enforcement
action can be taken should violations occur in the future.

Dear Mr. Foster:
A member of my office observed and sampled a discharge from a waste-
water lagoon serving your hog parlor on March 30, 1974. A copy of the
laboratory results from the samples is attached. This discharge was in
violation of General Statute # 143-215.1 (A)(1). I understand that this
discharge was terminated that day. You are hereby notified that the re-
sumption of the discharge of any wastewater to the streams of the State
of North Carolina after receipt of this notification will also result in.
a violation of General Statute # 143-215.1 (A)(6), unless a permit has
been applied for and received for the treatment and disposal of waste-
water.

The writer received a message on March 26, 1974, to contact Mrs.
Thurman Faster. The writer called her and learned of the discharge of
wastewater to a tributary stream of Buffalo Cre&k. She noted that this
had occurred several times since Dr. Sherman T. Mayne, previously of the
Water Quality Division had made an investigation. An investigation was
scheduled for the following week. On March 29, 1974, Mr. C. H. McNeill
called the Concord Office and requested that we visit the site. The
writer arranged to meet Mr. McNeill at 10:00 A.M. on March 30, 1974, at
his home. Mr. McNeill showed the writer the discharge pipe from Mr.
Spurgeon H. Foster's lagoon. The 2" plastic discharge pipe originated
below the surface of the lagoon, was laid over the bank of the lagoon
and extended to the foot of the bank. The discharge rate was probably
in excess of 5 G.P.M. The wastewater flowed for approximately 200 feet
before entering the stream. Samples of the upstream, discharge, and down-
stream were collected. The writer left from the residence of Mr. McNeill
and went to call this problem to the attention of Mr. Foster. The writer

lagoon and that the writer wanted to go to the lagoon with him. He
departed under the pretense of finding a farmhand to accompany the
writer to the lagoon. He returned in roughly 10 minutes and said that
he would take the time to walk to the lagoon with the writer. Upon
reaching the lagoon the pipe was gone. The writer walked to the area
where the discharge had occurred. The dark residue that had settled
out of the wastewater confirmed that a distinct path of wastewater flow
had originated nearby the lagoon and extended to the stream.
The writer asked Mr. Foster if he could explain the existence of
the discolored flow. He responded negatively. Mr. Foster was then
informed that the writer had observed the discharge and had collected
samples that morning. He was also informed that this discharge was in
violation of State Law. Mr. Foster asked for suggestions on how to
handle the wastewater. Spray irrigation was discussed briefly. The
writer asked how long the present lagooA(could handle the wastewater
flow without a discharge. Mr,`Foster replied "at least six months".
He said that the number of animals ranged from 1,000 to 2,000 head.
Mr. Foster stated that he would not resume the discharge and the writer
informed him that our office would contact him by letter and would offer
our suggestions on solving his wastewater disposal problem.

On March 29, 1979, the writer and Steve Moser of the Winston-Salem
Regional Office investigated a complaint of the S. H. Foster Hog Parlor
discharging waste to Buffalo Creek in Davie County. Upon arrival at the hog
parlor, the investigators met with Mr. 'Spurgon Foster, Jr. and explained the
reason for the visit. Mr. Foster stated that the parlor did not discharge
to a stream and that we could look at the waste handling system. He stated
the parlor had approximately 1500 hogs and pigs of various sizes. Upon
examining the parlor area it was found that the waste from the buildings
was piped to a holding tank of 100,000 gallons located under one of the build-
ings. When the holding tank filled it was allowed to flow out from the
holding tank and thru an open ditch into a 2 acre lagoon. The lagoon has no
discharge to the stream. Waste from the lagoon is spray irrigated onto land
near the hog parlor. Mr. Foster stated that the last time the lagoon was
emptied was about a year ago. He also stated that the waste is sometimes pumped
from the holding tank under the parlor building and carried to other sites for
land application. The lagoon was walked completely around by the investigators
- 2-
and Mr. Foster and there was no evidence of a discharge from the lagoon.
The water surface was approximately 18' - 24" below the dike around the
lagoon. In addition, the area around the lagoon was trenched to help
prevent surface water runoff from reaching the lagoon.
Mr. Foster stated that prior to the construction of the lagoon the
parlor had a discharge, but after the lagoon's construction in 1972 or 1973,
the discharge stopped. The lagoon's design and construction was approved
through a State Agency in Raleigh.
During the investigation no strong odors were detected and no evidence
of a discharge was observed in the stream near the lagoon nor in Buffalo
Creek at SR 1600 some 1/2'mile downstream of the lagoon.
Mr. Foster also stated that he believed part of the reason for the
complaint came from a disagreement he and a neighbor had some 3 or 4 days
before concerning right-of-way fmr an electric power line.
There is no incinerator located on the farm. Dead animals are dis-
posed of by burying. Odor regulations do not apply to any facility located
on this farm.

REPORT: Mrs. Thurman Foster
The writer received a message on March 26, 1974, to contact Mrs.
Thurman Foster. The writer called her and learned of the -discharge of
wastewater to a tributary stream of Buffalo Cre6k. She noted that -this
had occurred several times since Dr. Sherman T. Mayne, previously of the
Water Quality Division had made an investigation. An investigation was
scheduled for the following week. On March 29, 1974, Mr. C. H. McNeill
called the Concord Office and requested that we visit the site. The
writer arranged to meet Mr. McNeill at 10:00 A.M. on March 30, 1974, at
his home. Mr. McNeill showed the writer the discharge pipe from Mr.
Spurgeon H. Foster's lagoon. The 2" plastic discharge pipe originated
below the surface of the lagoon, was laid over the bank of the lagoon
and extended to the foot of the bank. The discharge rate was probably
in excess of 5 G.P.M. The wastewater flowed for approximately 20b feet
before entering the stream. Samples of the upstream, discharge, and down-
stream were collected. The writer left from the residence of Mr. McNeill
and went.to call this problem to the attention of Mr. Foster. The writer

lagoon and that the writer wanted to go to the lagoon with him. He
departed under the pretense of finding a farmhand to accompany the
writer to the lagoon. He returned Wroughly 10 minutes and said that
he would take the time to walk to the lagoon with the writer. Upon
reaching the lagoon the pipe was gone. The writer walked to the area
where the discharge had occurred. The dark residue that had settled
out of the wastewater confirmed that a distinct path of wastewater flow
had originated nearby the lagoon and extended to the stream.
The writer asked Mr. Foster if he could explain the existence of
the discolored flow. He responded negatively. Mr. Foster was then
informed that the writer had observed the discharge and had collected
samples that morning. He was also informed that this discharge was in
violation of State Law. Mr. Foster asked for suggestions on how to
handle the wastewater. Spray irrigation was discussed briefly. The
writer asked how long the present lagooA/ could handle the wastewater
flow without a discharge. Mr -/Foster replied "at least six months".
He said that the number of animals ranged from 1,000 to 2,000 head.
Mr. Foster stated that he would not resume the discharge and the writer
informed him that our office would contact him by letter and would offer
our suggestions on solving his wastewater disposal problem.

SUBJECT: Investigation of Hog Parlor Discharge into Unnamed Tributary
to Ellsworth Creek

Discussion: At the request of Mr. R. J. Duncan, Sanitarian, Davie
County, North Carolina, the writer, on the afternoon of September 20,
1973, investigated a reported discharge of waste from a hog parlor
into an unnamed tributary to Ellsworth Creek. The hog parlor is owned
by a Mr. Robert Ellis, and is located just off S.R. 1605, approximately
4-miles northeast of Mocksville, North Carolina. Mr. Duncan and Mr.
John Moore, whose residence is located adjacent to the hog parlor,
accompanied the writer on the investigation.
- The on -site inspection revealed a dry stream bed (with some small
pools of standing water) into which the reported discharge was made.
The stream bed seemed to have been dry for several days. There were,
however, indications that there had been flow in the stream.
Walking upstream, the origin of the stream was found to be from
the overflow of a holding pond located approximately 200 feet across
Mr. Moore's and Mr. Ellis' boundary line on the property of Mr. Ellis.
At the time of the inspection there was no flow into or out of the pond.
Waste, from the buildings housing the hogs entered the pond via a
small ditch which flowed into a marsh area that terminated at the pond.
The pond probably overflows when additional waste is discharged to it
and during periods of heavy rain. The origin of this overflow into
the unnamed tributary is approximately one-half mile upstream of the
tributary's outfall to Ellsworth Creek.

Conclusions_and.Recommendations: Mr. Moore, who. notified Mr.
Duncan of this situation, later revealed that he was primarily, concerned
with having. the trash on the grounds of the bog parlor cleaned-upi-.and
that it had been two months since he had been down to the stream.
Since -evidence of an illegal discharge was insufficient to justify
taking immediate action$ the writer suggested to Mr. Duncan that in
his upcoming talks with Mr. Ellis, he suggest that M r. Ellis remedy
the overflow problem in the pond. The writer also suggested that Mr.
Duncan notify this Office if flow from the pond increases and is con-
tinuous, which would justify in illegal discharge to the receiving
stream.
