Coverage. Staff from the Winston-Salem Regional Office have confirmed that this Coverage is
no longer required. Therefore, in accordance with your request, Certificate of Coverage No.
AWC290003 is rescinded, effective immediately.
If you again -wish to operate an animal waste management system you must first apply for and
receive a new animal waste permit Certificate of Coverage. Operating an animal waste
management system without a valid animal waste permit Certificate of Coverage will subject the
responsible party to a civil penalty of up to $25,000 per day.

I verify that the above information is correct and complete. I have followed a closure plan, which meets all NRCS
specifications and criteria. I realize that I will be subject to enforcement action per Article 21 of the North

Have you looked at the Alternate Method of Closure in standard 360? If the liquid waste analysis is less
than 40 ppm of total N and the sludge depth is less than 0.2 ft., the structure could be considered closed.

Pat, the structure has been in use around 15 years, the water is
usually cloudy due to soil particles (loafing area in drainage area)and
decayed vegetation. If liquids are removed and the bottom dries out, it
would be possible to determine depth to soil, how much organic matter is
from waste and how much is from decayed vegetation would be difficult at
best. This structure only received waste during heavy rains or as a
back-up from the primary storage ponds overflowing during high rainfall

up to some folks to see if they can up with something.
I do have the following questions:
1. How long was this structure in operation and how often did it
receive
solids? (Assuming by the low nutrient content of the waste analysis,
the
sludge depth is either really low - or - due to lack of use, the
structure is
faily stable and the waste analysis is only representative of the
nutrients in
the top column of liquids).
2. Are there any clear areas in the pool area to get clear sludge
depths for
a sludge survey?
3. If the liquids are removed, can it be determined that there is no
more
than one foot of agitated materials in the bottom given the trees,
stumps,
etc.?

Thank you for your recent submittal of the information requested in our letter dated April 23,
2003. We greatly appreciate the effort that you made in compiling this information and sending
it to our Winston-Salem Regional Office by the date required. We also appreciate the fact that
you reported the problem with high freeboard to our staff as required by your permit and worked
with our staff to manage the problem once it occurred.
Upon review and consideration of the information submitted, the Winston-Salem Regional
Office has determined that no further compliance/enforcement actions will be taken by the
Division for high freeboard.
Also, based on your actions to properly operate your facility, the Division of Water Quality
hereby rescinds the Notice of Violation that was issued to you on April 23, 2003 and replaces it
with this Notice of Deficiency.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
These methods include, but are not limited to, water conservation practices, adding additional
application sites, updating your cropping systems, adding additional and/or more flexible
application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate
levels throughout the year. Our staff looks forward to continuing to work with you and your
Technical Specialist to evaluate and implement any needed changes to your system.

BEALLGRAY FARM$ INC.
WASTE MANAGEMENT PLAN
Beallgray Farms Inc. currently has 100 cows, 100 heifers and 10 calves on confined
feedlots or holding areas. Twenty percent of the manure and urine is scraped and hauled,
the remaining eighty percent enters waste storage pond #1. Waste pond #1 also receives
lot runoff and wastewater from milk parlor. Liquid from storage pond #1 drains into
storage pond #2 and drains into storage pond #3, where it is pumped out and applied by
either center pivot or hose tow irrigation.' Storage pond #4 is intended to trap any
overflow from pond #3 in the event of a discharge. Liquid from pond #4 can also be
applied by irrigation. Ten calves produce solid waste that is broadcast on fields.
A fresh water farm pond is located below storage pond #4; this pond is used to supply
irrigation water to crops and contains no animal waste. A diversion designed by NRCS is
located on the West sidd of the pond to prevent any surface water from entering the pond.
All waste storage ponds were build by BealIgray Farms Inc. and not NRCS designed.
Increasing the depth may increase waste storage volumes. If this is to be done, sludge
should be tested to determine nutrient content and land applied at agronomic rates.
Waste storage ponds are to be inspected monthly to check for leaks or seepage on or in
the dam. Vegetation is to be clipped annually to control undesired weeds and brush.
Refer to specification contained in waste plan for additional information and management
practices.
Distance to nearest dwelling not associated with the farm is in excess of 750 feet. No
floodplains exist on areas to receive animal waste, no wetland exist on application areas.
Cropping system is usually no -till corn for silage followed by no -till small grain for
silage. Alfalfa is to receive animal waste not to exceed NCDA soil test
recommendations. Applications of animal waste to alfalfa will be made for establishment
only, not for yearly maintenance. In some years due to weather and economic factors,
other crops may be planted. Cropland acres are well in excess of nitrogen produced.

This lack of adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility,on July 31, 2000. In addition to this Notice of Violation (NOV), this non-
compliance 'is'subject to an appropriate enforcement action by DWQ. This action can consist of

On April 14, 2003, a representative of your animal operation informed the Division of
Water Quality (DWQ) that there was inadequate freeboard in the lagoon(s) serving this facility.
This lack of -adequate freeboard is in non-compliance with the Certificate of Coverage
issued to this facility on July 31, 2000. in addition to this Notice of Violation (NOV), this non-
compliance is subject to an appropriate enforcement action by DWQ. This action can consist of
one or more of the following: a civil or criminal enforcement action; an injunction; and/or a
requirement to apply for coverage under an individual permit. The action chosen will be based
on complete evaluation of all factors that resulted in the inadequate freeboard; the actions taken
to restore the needed freeboard; and the actions being proposed to prevent the problem from
reoccurring.
To assist• us in our review, please provide the Winston-Salem Regional Office with an

Melissa Rosebrock of this Office conducted a site inspection at your facility on August
28, 2000. Although no violations were found with the waste handling system or other farm
operations, the record keeping system needs -improvement.
Staff noted that the 'information in your waste application records was not complete.
Specifically, waste applications for each field had not been recorded on the appropriate forms
(IRR-2 and SLD-2). Staff did note however, that you had kept detailed records on a separate
sheet of paper regarding the tracts, fields, waste volumes, nitrogen amounts, and a nitrogen
balance. Should you need assistance regarding the transference of this information onto IRR
and SLD forms #1 and #2, we would suggest you contact the Davidson Field Office at (336)
242-2076. Please note that waste and soil records, once obtained, should be kept for a
minimum of five years.
Failure to have the above components available and complete is a violation of your
Permit. As you know, waste applications should be applied during the time the crop can
utilize the nutrients in the waste. In general, waste should be applied no earlier than 30 days

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject application. Additional
information was requested on August 11, 1999 and to date has not been received by the Division. Additional information is
required before we can continue our review. Please address the following by August 13, 2000:
According to the Waste Utilization Plan (WUP), 40 percent of the waste from the milk cows is scraped and
hauled. Please provide information on how often hauling occurs. If the waste is stored once it is scraped,
please provide the number of days of storage that are available, whether or not the storage structure is
covered, and how leachate is collected.
Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before August 13, 2000 or the Division will return your application as incomplete in accordance with 15A
N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without -a valid permit is a violation of North

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2,
SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject application. Additional
information is required before we can continue our review. Please address the following by September 10, 1999:
1. According to the Waste Utilization Plan ()VUP), 40 percent of the waste from the milk cows is scraped and
hauled. Please provide information on how often hauling occurs. If the waste is stored once it is scraped,
please provide the number of days of storage that are available, whether or not the storage structure is
covered, and how leachate is collected.
Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before September 10, 1999 or the Division will return your application as incomplete in accordance with 15A
N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a violation of North
Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental Management
Commission.

information is required before we can continue our review. Please address the following by July 1, 1999:
Please include maximum irrigation application parameters in your Waste Utilization PIan (WUP).
Irrigation events are to be listed in the WUP as the maximum application allowable for that soil type from
the time the pumps are turned on until the time they are shut off. It is currently recommended that total
application amounts not exceed one inch in any application event for any soil type. If your application rates
need to be adjusted for the application of animal waste, please have your Technical Specialist revise your
WUP to reflect the appropriate application amount per event. If the rates exceed the recommended one -
inch, please have your Technical Specialist justify the increased application rate in the narrative of your
WUP.
2. The WUP lists the nitrogen uptake for corn silage and tropical corn silage as 288 pounds per acre. This is
higher than currently recommended. Please contact your technical specialist to revise the Waste Utilization
Plan or provide justification that supports the increased yield as shown in the current WUP. Please note that
all WUP revisions must be signed and dated by both the owner and the technical specialist.
The Plant Available Nitrogen (PAN) produced and utilized by the facility must be included in the WUP.
Please have your technical specialist revise your WUP to include this information.
