A site inspection conducted by the Division of Water Quality indicated that your operation's animal population does not exceed the number set forth by §143-215.108(1), and therefore does not require coverage under the Swine Waste Operation General Permit. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. Additional information is required before we can continue our review. Please address the following by January 3, 2001: Based on data presented in your Waste Utilization Plan (WUP), the "Amount of Plant Available Nitrogen (PAN) produced per year" of 2,340 pounds of N (WUP page 2) is greater than the calculated "Pounds of Animal Waste Nitrogen" used of 623.28 pounds of N per year (WUP page 3). It appears additional crop acreage is needed to adequately utilize the PAN produced on your farm. Please correct this inconsistency in your plan and correct your field map to include this acreage. 2. Please provide a clearer map that identifies (outlines or highlights) and shows the acreage for each field to be used for waste application. Include the additional acreage requested in Item 1, above. 3. Please provide an irrigation design for irrigation system used on fields 3, 4 and 5. Irrigation application was noted for these fields on page 7 of WUP. If additional fields are added to WUP, please include them on page 7, as well. He just completed and sent in his waste plan to Raleigh about a week ago so I don't know what his available acreage is in the plan since I have not seen his completed plan..... Raleigh doesn't send us a copy until the farmer is sent their certificate of coverage or permit. When I inspected him about two months ago he did not have any sows ..... just 150 baby pigs he was finishing out for the sows that had already been sold. He is selling off his stock ..... says he may want to get out totally. I'm not sure where the 1 156 number came from. None of the inspections since 1996 have him over 90 sows. ???? I referred Callie to Warren Mincey for specific questions since Warren's office just worked with him on his plan. #3. My feeling is that the pasture vs. row crops is 50150 but that is only a guess. Again, I referred her to Warren for this question as well as info regarding sediment and non -point pollution sources. (1) Skokes County: I need to know for sure whether an impoundment was built on upper Town Fork Creek in the vicinity of SR 1961. We have 1995 special study benthic data that I need to use. Also, any thoughts on why a sample rated Poor in the upper portion? The Hriarwood Subdivision WWTP DMRs look good and I think it's too small to impact Town Fork Creek down where the sample was taken. (3) Also in Caswell County: We have very little data during this round of sampling. If any of you can give me any feedback on the Country Line Creek, Moon Creek, or Rattlesnake Creek watersheds, I'd gladly accept it. Is there a lot of pasture or row crops -- do you feel like there's a lot of nonpoint source pollution in terms of sediment? How about Yanceyville -- does runoff from the town impact Rattlesnake Creek heavily? Anything you can think of in terms of potential cause/sources of pollution in these watersheds. Although the final lagoon level was adequate, there are other concerns that warrant your immediate attention. Staff noted that the information in your records was not complete. Specifically, a soil analysis was not performed for yearl999. Please note that waste and soil analysis, once obtained, should be kept for a minimum of five years. Failure to have complete records is a violation of North Carolina General Statute 143-215.10C. Records provided to inspectors indicated that waste had been applied to fescue in June of 1999. The months of application listed in your waste utilization plan were February through May. Please note that Waste Utilization Plans are to be adhered to unless you contact the Caswell County Field Office to have this section amended. Additionally, trees need to be cut off the dams of lagoons #1 (behind the three houses) and #3 (eastside of final lagoon). While the presence of vegetative growth did not appear to be causing an immediate threat to the environment, their continued growth may eventually compromise the integrity of the dams. Finally, this office is concerned that a signed Waste Utilization Plan (WUP) has not been submitted to Raleigh for review. It is our understanding that a WUP was developed for you by the Caswell Field Office and only requires your signature for its submittal. Note again that, failure to have complete records is a violation of North Carolina General Statute 143-215.10C. We have sent a copy of this correspondence to the Division of Water Quality Non -discharge Compliance and Enforcement Unit in Raleigh. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that ace being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY I, DRY2, DRY3, SLUR I, SLUR2, SLD],`and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. Only the acres that are wetted can be credited in the waste management plan as receiving waste application. Any acreage within the plan that can not be reached by waste application equipment can not be used as part of your plan. An evaluation by Ron Linville on 5/28/99 was made to review the actual number of acres at your facility that receive animal waste during land application. The evaluation of your facility has yielded one of the following two results as indicated by the box marked with an "X". . Category 1: ❑ The evaluation of your facility could not be completed due to a lack of information. The inspection was conducted in order to determine compliance with your Certified Animal Waste Management Plan. observations at the site revealed that some concerns need to be resolved concerning the swine farm and the farm's operational documentation. Extensive weed growth on the dam of the #1 lagoon needs to be managed in order to allow easy viewing of the dam structure and to reduce the chance that groundhog burrowing might impact the integrity of the dam. A groundhog burrow was found in the middle of the dam near the pumping marker pipe. The wettable acres determination needs be recalculated to insure adequate application of wastewater due to the portable system being utilized and a modification in some of the field usages. During the visit, a Certificate of Coverage for the farm could not be found. To our knowledge, a non -discharge permit for the facility has not been received or requested at this time. The inspectors were very much concerned about record keeping at the farm. There appeared to be bits and pieces of the required documentation; however, they were not sufficient to ascertain whether or not the facility is in compliance with the WUP. Please be advised that the above issues are significant and they need to be corrected without delay.
