THIS CORRECTION DEED, made and entered into this 18th
day of July, 1996, by and between C. ALLEN PROPST, JR. and wife,
ANGELA P. PROPST, hereinafter called "grantors", and THOMAS E.
ELRICK and wife, NANCY D. ELRICK, 33162 Redwood Boulevard, Avon
Lake, Ohio 44012, hereinafter called "grantees";

WHEREAS, grantors conveyed to grantees a lot and
boatslip by deed dated May 1, 1996 and recorded in Book 313 at
Page 278, Pamlico County Registry; and
WHEREAS, grantors desire by this deed to correct
certain inconsistencies in the Boatowners' Declaration and the
ownership of the boatslip owners' common property.
NOW, THEREFORE, grantors, for and in consideration of
the sum of ten dollars and other good and valuable
considerations to them in hand paid, the receipt of which is
hereby acknowledged, have bargained and sold, and by these
presents do bargain, sell and convey to the said Thomas E.
Elrick aced wife, Nancy D. Elrick and their heirs and assigns, a
certain lot or parcel of land in Number Two (2) Township,
Pamlico County, North Carolina, particularly described as
follcws:
TRACT ONE: Lot Number Three (3) which is shoats on the
map entitled "PLAN OF NEUSE WINDS", prepared by
Herbert J. (Josh) Nobles, Jr., RLS, which is recorded
in Plat Cabinet A, Slide 43-7, Pamlico County
Registry.
This conveyance is made subject to the Declaration of
Covenants dated June 29, 1989 and recorded in Book 261
at Page 61 (re-recorded in Book 268, Page 531),
Pamlico County Registry, and the amendments thereto
recorded in Book 265 at Page 26, Book 273 at Page 748,
Book 311 at Page 822, and Book 313 at Page 239, said
registry, and the Subdivision Street Disclosure
Statement recorded in Book 261 at Page 388, said
registry.
TRACT TWO: A one-tenth (1/10) undivided interest in
and to that strip of land ten (10) feet in width
located along the western shoreline of Lot 30 of Neuse
Winds Subdivision, and being shown on that plat
entitled "NEUSE WINDS LOTS 28, 29 AND 30" (the Dock
Map), prepared by Herbert J. Nobles, Jr., RLS, dated
April 9, 1995 and recorded in Plat Cabinet A, Slide
96-3, Pamlico County Registry, and designated on said
map as "PIEROWNERS PROPERTY".
TRACT THREE: Also conveyed is a one-tenth (1/10)
undivided interest in and to the wooden pier and
pilings adjacent to TRACT TWO as shown on the above-
referenced Dock Map.

Grantors reserve the right to expand the docking
facility a maximum of two additional boatslips. In
the event said additional boatslips Tre annexed, the
undivided interest of grantees shall he automatically
reduced on a pro-rata basis.
TRACT FOUR: Also conveyed herewith is the exclusive
right to use Boatslip Number one (1) as shown on the
above-referenced Dock Nap. Such Boatslip is assigned
to and appurtenant to the aforesaid undivided
interest.
The above-described exclusive right to use said
boatslip shall be an appurtenance to TRACT ONE herein
conveyed and is conveyed subject to all of the
following:
(1) All of the term, provisions, conditions,
restrictions, easements and other matters set forth in
the Declaration of Covenants for Neuse winds
Boatowners' Association, Inc., dated May 1, 1996 and
recorded in Book 313 at Page 243, Pamlico County
Registry, as amended by instrument dated July 8, 1996,
recorded in Book _, Page , said registry,
including, but not limited to, the obligation to pay
assessments and the rights and easements reserved by
grantors for the benefit of themselves and their
heirs, successors and assigns. All such rights and
easements are incorporated herein by reference.
(2) The rights of all governmental entities and the
public in general, if there are such rights, to the
riparian rights of the property described in TRACTS
TWO and THREE above.
(3) The grantees, said grantees' heirs and assigns,
agree that they shall not have any right to bring a
suit or proceeding to partition and that the
institution of any such suit or proceeding shall be an
offer to sell such parties' above-described undivided
interest to such persons and on such terms as set
forth in Article xi of the Declaration; further, such
suit or proceeding shall subject the party instituting
it to the penalties set forth in the Declaration.
(4) The grantees, said grantees' heirs and assigns,
agree that they will not in any way interfere with the
rights of others in and to any other boatslip not
assigned to the grantees, and the grantees shall use
only the boatslip specified above as being assigned to
said grantees.
(5) The Declaration is incorporated herein by
reference as if set forth verbatim.
TRACT FIVE: A perpetual, non-exclusive easement
fifteen (15) feet in width, the centerline of which is
described as follows:

APPROVAL for the use of the "General" MAJOR VARIANCE; From the Neuse and Tar-Pamlico
Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the
Coastal Counties as defined by the Coastal Area Management Act with Additional Conditions
Dear Mr. Elrick:
You have our approval, in accordance with the conditions listed below, to impact approximately
3104 square feet (ft) of Zone II of the protected riparian buffers for the purpose of constructing
dwelling and driveway on the subject property as described within your application dated
October 24, 2005. This letter shall act as your approval for the use of the "General" Major
Variance; From the Neuse River Riparian Buffer Rules for the Construction of Structures on
Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with
ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the
Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get
any other required federal, state or local permits before you proceed with your project including
(but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall
expire in five years from the date of this letter.
This approval is for the purpose and design that you described in your variance request. If you
change your project, you must notify us and you may be required to send us a new request for
approval. If the property is sold, the new owner must be given a copy of this approval and plat
thereby assuming responsible for complying with all conditions. This approval requires you to
follow the conditions listed below.

The Additional Conditions of the Certification are:
1. No Zone 1 Impacts
No impacts (except for proposed and "exempt" uses as identified within 15A NCAC 2B .0233(6)
shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ.
No impervious surfaces shall be added to Zone 1, unless otherwise approved by the DWQ.
2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 /Wetlands Unit, North Carolina Division of Water Quality,
943 Washington Square Mall, Washington, NC 27889.
3. Diffuse Flow
All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive
velocities prior to entering the protected riparian buffers as identified within 15A NCAC 2B
.0233(5). No new ditching or piping of stormwater through the protected buffers is allowed
3. Buffer Mitigation (EEP/Restoration)
You are not required to mitigate for Zone II impacts to the protected riparian buffers.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings to: 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer
Protection Rules (15A NCAC 2B .0233 (9)(b)). Please contact Kyle Barnes at 252-948-3917 if you have
