Dear Sir or Madam:
You have our approval, in accordance with the attached conditions, to place fill material within or
otherwise impact 0.296 acres of non-vegetated wetlands (boat basin bottom) and 0.029 acres of Pantego
Creek bottom to bulkhead across an existing boat basin and backfill the impounded area to create
additional high ground for future development as described in your application received by the Division
of Water Quality (DWQ) 401 Oversight/Express Review Pennitting Unit on October 27,2005. After
reviewing your application, we have detennined that the Division of Water Quality (DWQ) General
Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to
General Pennit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition,
you should get or otherwise comply with any other federal, state and local requirements before you go
ahead with your project including (but not limited to) erosion and sediment control regulations and
CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or ISO linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Project Setting
The 1.8-acre project site is located in the Town of Belhaven at 435 Water Street adjacent
Pantego Creek in Beaufort County, North Carolina. The site was fonnerly known as Robbs Marina.
Robbs Marina was a marine oriented business that provided vessel maintenance including bottom
cleaning/painting, prop repair, and an engine shop. The site also provided fuel and dockage for
transient boats traveling the Atlantic Intercoastal Waterway. The business has been closed and the
site inactive since 2002. Located on the site is a two story building that served as a ships
store/marina office and an engine shop. The entire shoreline has been stabilized with a bulkhead.
Most of the upland areas of the property are covered with gravel. Vegetation on the site is upland
grasses intermixed with the gravel. There is a :t60' x 215' man made boat basin off Pantego Creek
with an average water depth of 5'. A wooden dock in some disrepair lies around the perimeter of
the boat basin on the landward side of the existing bulkhead. Mooring of transient vessels took
place in the basin mooring side to the bulkhead. Major CAMA Permit No. 79-92 authorized the
construction of pile supported travel lift piers for a travel lift used to provide vessel haul out
services. The travel lift system was constructed on the northwest corner of the property in Pantego
Creek incorporating a portion of an existing pier that was also used for mooring of transient vessels.
This project site is adjacent to the proposed Day Beacon #9 project site subject of a recent
Environmental Assessment review for a planned condominium and marina.
Pant ego Creek in the vicinity of the project site is classified as SC-NSW by the Environmental
Management Commission and Inland Waters by the Wildlife Resources Commission. This area is
closed to shell fishing.
Project Description
The applicant proposes to fill the :t60' x 215' man made boat basin to create additional
highground for development. The applicant proposes to accomplish this by constructing a new
bulkhead 67' across the basin opening to Pantego Creek decanting the water in the basin through
and over the proposed bulkhead as the basin is backfilled. The remaining 653' of existing bulkhead
is proposed to be replaced with a new alignment 2' seaward. The basin and new bulkhead is to be
backfilled with sand from a local sand mine. The applicant is not proposing any upland
development at this time.
Anticipated Impacts
The proposed project will result in the filling of a :t60' x 215' (12,900 ft2) man made boat
basin off Pantego Creek creating additional highground area for upland development adjacent
Pantego Creek. Replacement of the remaining 653' of bulkhead will result in the filling of 1,306 ft2
of Pantego Creek bottom. There will be some localized short term turbidity during construction of
the proposed bulkhead.

The subject property is a 1.85 acre tract located along the Pantego Creek waterfront in Belhaven, North
Carolina. The property has been used as a Marina for many years prior to the marina closing in 2002.
The site is currently vacant. The property owners, DCR, propose to fill the existing boat basin as a
means of creating some upland area for future development potential. DCR anticipates selling the
property prior to any additional development. No upland development is proposed at this time. No water
dependent structures are proposed at this time. This permit application requests the replacement of 653
feet of bulkhead and associated backfill, construction of 67 feet of new bulkhead and the backfill of
13,066 square feet of man made boat basin.
Proposed Worl\: Scone:
The proposed scope of work is the replacement of the bulkhead around the site (653 linear feet) and the
construction of 67 feet of new bulkhead across the boat basin, Once the bulkhead is constructed, the
basin will be filled with clean, debris free sand from a nearby sand mine. The basin will be filled slowly
,
and the water will be allowed to flow over the newly constructed bulkhead as the basin fills up. Please
note, the 67 feet of new bulkhead will have to be water tight or lined with a geo-textile fabric (or other
approved filtering mechanism) capable of filtering sediments (sands, silts and clays) from entering the
Pantego Creek. No discharge of sediments into the Pantego Creek will be allowed.
The replacement bulkhead will be constructed a maximum of two feet water ward of the existing
bulkhead and subsequently the old bulkhead will be removed if necessary and then backfilled. It is
estimated that 387 cubic yards of material will be required to backfill the replacement bulkhead.
Grading, Excavation and FilV Stormwater:
Proposed fill activities include the backfill of 13,066 square feet of boat basin and the backfill of the 653
linear feet of replacement bulkhead. Based on water depths collected in 2004, the average water depth in
the basin is 5.0 feet. The bulkhead height above the normal water level is approximately three feet
during normal water. The basin is proposed to be filled to existing grade. It is estimated that 3,871 cubic
yards of material will be required to fill the basin and 387 cubic yards of material will be required to fill
the replacement bulkhead.
Sedimentation and Erosion Control Plan:
To control sediments from entering the Pantego Creek, the 67 feet of new bulkhead will be constructed
across the basin first. Subsequent to construction, a geo-textile fabric will be installed that will be of
sufficient design to filter any sediments from entering the Pantego Creek. Once the bulkhead and fabric
are in place, the basin will be filled with clean sand and the water will be allowed to flow through and
over the top of the bulkhead into the Pantego Creek in a controlled man!1er. Once the basin is backfilled
and graded the 13,066 sf area will be seeded and stabilized.
Potable Water and Wastewater:
Potable water is available on site via the Town of Belhaven. Waste water at the site is also handled by
the Town of Belhaven.

and the adjacent riparian notification letters will be submitted once an initial review has been conducted.

Authorizing development in Beaufort County at Pantego Creek, 432 Water Street, Town
of Belhaven , as requested in the permittee's application dated 10/11/05, including the
attached workplan drawing (1), dated 10/6/05.
This permit, issued on January 10,2006 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below, Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead and Basin fill
1) The alignment of the permitted replacement bulkhead shall not extend more than 2 ft. waterward of the
existing bulkhead,
2) The 67 ft. of bulkhead to be placed across the upland basin shall be constructed consistent with the
alignment indicated on the attached workplan drawing.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
Signed by the authority of the Secretary of DENR and the
Chairman of the Coastal Resources Commission.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance,

ADDITIONAL CONDITIONS
3) The bulkhead shall be constructed prior to any backfilling activities.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
shall be required for the construction of the bulkhead wall, riprap, dead men cables, etc. This permit
does not authorize any excavation waterward of the approved alignment.
6) The backfill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.'
8) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
11) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Stormwater Management
NOTE:
This project may require a Stormwater Permit from the Division of Water Quality. Contact a
Representative from the Division of Water Quality at 252-946-6481 for this determination.
General
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina, No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

ADDITIONAL CONDITIONS
13) In order to address concerns of The Division of Water Quality, Stormwater Permitting Section, and
Department of Cultural Resources concerning high-ground development, any future development
plans shall require coordination with appropriate review agencies and a modification of this permit.
14) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that shall be required.
NOTE: The permittee is advised that, in accordance with the rules of the Environmental Management
Commission, many non-water dependent activities are not authorized within 50 feet of the
normal water level or landward edge of any coastal wetlands. Contact the Division of Water
Quality at (252) 946-6481 for this determination.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 05-1969), which was issued on 12/16/05.
NOTE:
The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
