Kennedy. I have been in discussion with the folks from DWQ regarding the memo and specifically your request to add the ntentioncd 25% additional waste to fescue hay and pastureland. The consensus is that this 44iII not be aIIowed for several reasons: 1. As this is a sludge cle:uaout, the waste contains inuch higher nutrient and heavy metals than typical lagoon waste — this could adverseh, affect the growin- craps immediately and into the future. 2. In reviewing the provided CNMP there is ample land for the anticipated clean out volunies so that spreading additional volurne is not necessary for plan compliance. 3. The me no and intended purpose was to primarily assist with [mvering % SI) levels in the critical eastern portions of the state where excessive rainfall event(s) over the past few weeks has caused the potential for over- topping the clams. If the lagoon has a designed sludge storage volume, see notes at end of the worksheeL The dimensions of the lagoon as measured and the side slope are needed for calculations of sludge volume and of total treatment volume. If the lagoon is a standard geometric shape, the sludge volume and the treatment volume in the lagoon can be estimated by using standard equations. For approximate volumes of rectangular lagoons with constant side slope, calculate length and width at the midpoint of the layer, and multiply by layer thickness to calculate layer volume, as shown in the example. For irregular shapes, convert the total surface area to a square or rectangular shape. For exact volumes for lagoons with constant side slope, the "Prismoidal Equations" may be used. The dimensions of the lagoon as measured and the side slope are needed for calculations of sludge volume and of total treatment volume. It the lagoon is a standard geometric shape, the sludge volume and the treatment volume in the lagoon can be estimated by using standard equations. For approximate volumes of rectangular Lagoons with constant side slope, calculate length and width at the midpoint of the layer, and multiply by layer thickness to calculate layer volume, as shown in the example. In one of their rotations, they are applying waste onto fescue hay (year-round with an allowable PAN of 152-186) and millet hay (April 1-September 1) whereas the email refers to Bermuda and millet. The guidance also specifies a max of 100 lbs. Nacre and Applefield is using an allowable PAN of only 65-87 lbs./acre depending upon soil type. Applefield's realistic yield expectation is based on 50% of the yield expected for millet alone. The application windows and rates seem ok to me. Keith and Joe, any differing thoughts? There are some very specific requirements that must be followed in order to do this, including a modification to the WUP. There has been some talk of extending the crop window for Bermuda application. In talking with NCDA, they are not interested in providing a blanket exemption for fauns. They are willing to review a farm's crops on a case -by -case basis and determine if an extension is warranted. This will also require an amendment to the WUP, and the farmer must have PAN available, If a farmer wants to make either of these modifications, they need to act immediately. There is a requirement to plant the overseed by Oct. 15 in order to Follow the 100 lb. procedure. I understand that there is actually a lot of demand for small grain seed, and that it may be difficult to get it planted by the 15t'. NCDA may be able to work with folks on that date, but probably not for long. Any Bermuda extension would likely only be until mid/late October, so if a farmer wants to pursue that, they also need to be making contact with NCDA or a crop advisor ASAP. Failure to obtain the required removal or management plan is a violation of the General Permit. During the inspection, staff also observed that the spillway of the upper lagoon was severely eroded due to excessive traffic around the spillway and that soil had been added to help contain the waste. DWQ Facility I.D. # 75-3, Dear Mr. Faucette, During our last conversation, you and I discussed the current cropping program at Applefield Farm. You had several questions about your land application program, more specifically about the waste application windows shown in your plan. By this letter i hope to clarify certain points about when animal waste can be applied. This letter should be put in Applefield's Certified Animal Waste Management Plan (CAWMP) folder and kept for reference. The Applefield Farm CAWMP being,discussed is dated 9-2-98. A. supplement to this plan was also sent to DWQ on December 24,' 1998 that, explains in detail the process of using'a broadcast type wagon.for non -irrigated areas .oflyour fields. The information below refers to all land, application events (i.e. irrigation or broadcast) but will most often reference irrigation for simplicity. As I recall you were particularly interested in any new information that has been published with regards to responsible waste application timing since the Applefield Farm CAWMP was written. Since I am the certified technical specialist who wrote the current CAWMP for Applefield harm, this letter shall serve as an official clarification to that plan and may be used as needed for selecting when to apply animal waste. This letter primarily•addresses•the•timing•of=irrigation•events- and does not change the amount of Plant Available Nitrogen (P.A.N.) you can apply. Your existing CAWMP is not being altered by this letter, only clarified. Acceptable Irrigation Months The intensity of each irrigation event will be tempered by many short term factors such as recent rainfall, local weather forecasts, lagoon water levels, crop conditions, operator convenience, etc. However there are two basic long; term criteria for irrigating animal waste. These are: 1) the farmer must have a crop that is growing or is within 30 days from emerging (or greening), and 2) the farmer must have an annual crop yield that matches the nitrogen applied according to published data on crop nitrogen uptake. These are separate issues but both must be satisfied in order to continue applying animal waste to crops. Your latest CAWMP shows Applefield Farm as growing fescue grass in the cool months of the year and overseeding the fescue with pearl millet for growth during the warm months of the year. The existing CAWMP shows expected conditions based on average values. The existing plan was developed based on 1998 rules and regulations, tempered with my personal experience. Tables 21 through 24 and Tables 27 through 30 of this plan show a possible land application routine for each irrigation pull at your farm. P.O. The common thinking of the Natural Resources Conservation Service (MRCS) and the Division of Water Quality (DWQ) in 1998 was to avoid applying nitrogen to crops in November, December, and January. However, I know that in mild winters fescue grass stays green and exhibits some growth. This is why I put the above mentioned foot -note under selected tables. I intended to give you the flexibility of applying animal waste in these months if the fescue was growing and weather conditions were favorable. Recently, a slight change of thinking has occurred in the regulatory community so that the land application of animal waste on a cool season crop like fescue is no longer prohibited in mid -winter. An example of this change in thinking is attached to this letter as Exhibit f and is titled "Animal Waste Application Windows For Common Crops Which Receive Animal Waste". You will note that the months of possible animal waste applications onto fescue grass is between August i and July 31, or "Possibly" 12 months of the year. I think in most years the weather in Piedmont NC is suitable to apply animal waste to fescue grass in November. I would still recommend that the amount of animal waste applied to fescue in December and January be none or minimal, mainly because these months tend to be wet. Also, if December and r �V January are severely cold, I would not recommend any waste application. if you applied nitrogen lightly �QS in the early fall and have not met the 12 month limit described in your CAWMP, I think it is usually acceptable -to.apply_I0 ta.20:pouMs:of NT .acre.E'MVernber'and possibly apply IO:to_I 5-p2undsrof - N_per_acre•per month:diaring De ember_and JanuaryZ�ut again, I stress the importance of preventing run-off and not irrigating unless all conditions are favorable. I would recommend you try to get you nitrogen applied by the end of November and avoid applying in December and January most years. In order to not exceed the annual nitrogen application recommendations you will have to cut back an nitrogen applications during the fall and spring if you plan to apply waste during November, December, or January. Similarly, I would caution you about applying nitrogen to fescue grass (without pearl millet) during June, July, and August since hot and dry weather can cause the fescue to become dormant. I would recommend limiting nitrogen applications qo-a'fescue-only"crop:during,]une,.]tily,.and.August;ta_abotit Iafpoundd `per-acre-per-m� Each year will be different s❑ you must take crop growth into consideration. If pearl millet has been planted over the fescue, use the tables in your CAWMP to estimate N applications during its growth season. Do not exceed the amounts of N mentioned in your plan for either fescue or pearl millet. Remember that adding nitrogen to fescue in mid -summer or mid- winter does not allow you to increase the overall annual nitrogen budget for that crop. Planting pearl millet as a warm weather crop is a good safety valve to help guarantee suitable waste application windows for the summer. This assures there will be a growing crop if the weather gets hot and dry, In addition, the pearl millet allows you to remove more nitrogen than the fescue alone. Applefield Farm would need to carefully review its harvest records (i.e. annual tons of crop produced vs. annual nitrogen production) in order to determine the appropriate acres of fescue and pearl millet combination to grow. You can account for 45 to 50 pounds of nitrogen per ton of fescue hay harvested and up to 100 pounds of nitrogen per acre of pearl millet, assuming; you have at least 2 tons per acre of pearl millet yield. More than 2 tons of pearl millet hay yield will not allow you to apply more nitrogen on the millet. However, you are allowed to take credit for all fescue hay tonnage produced. It may be that you could select only certain fields to receive pearl millet and still have the nitrogen removal potential necessary to match your nitrogen production, Be careful not to cut the pearl millet acres too close since we can have unusually hot weather from May to September. Remember that holding the animal waste for 4 to 5 months without irrigating can be tricky during wet years. Matua Grass You mentioned growing Matua grass at Applefield Farm. Matua grass is a cool season grass that is reported to be a very good feed for cattle. Its nitrogen uptake potential is reported to be greater than fescue or bermudagrass. If a farmer averseeds matua onto bermudagrass it can be difficult to manage since it can shade out the bermudagrass in the spring and early summer. Planted by itself I understand it is much easier to manage. NCSU and others are looking at Realistic Yield Expectations (R.Y.E.) for matua grass on different type soils. I hope there will be a guidance document sent out on matua sometime before the end of the year. Since the official information on matua may be going to change, I would prefer not to send you any specific information about matua at this time. However, depending on the R.Y.E. for matua grass on Applefieid's soil types, we "might" be able to revise your plan to put in matua in the place of fescue and leave out the pearl millet. If you would like to discuss this more, please let me know. Conclusions As 1 said earlier in this letter, you must continue to follow the existing CAWMP guidelines in terms of nitrogen application amounts. By this letter I am clarifying the waste application windows for your plan. • The existing; CAWMP for Applefield Farm allows for applying animal waste ontoUescue-grass -im �—rnid-winter._ However, the tables d❑ not specifically address an amount of nitrogen that might be applicable for the months of November,_Deceinber;7 and -JJ nuary:y The information in this letter should help clarify the CAWMP tables. 10-7,0 + In most years, you can apply animal waste to fescue in the month of November at a rate of 10 to 20 pounds per acre. DWQ Facility I.D. # 76-03. Dear Ms. Rosebrock, On January 16, 2001 I visited the above referenced facility to obtain information related to the questions and concerns posted in the Notice of Violation letter from DWQ dated November 13, 2000. This meeting was attended by Mr. Vincent Jessup, Mr. John Gardner, Ms, Robin Cox, and myself, In addition l have recently talked to Mr. Jerry Apple and Mr. Philip Faucette about the same issues. Below I will list the responses to your November 13 letter in the order presented. I. The cracks you saw in the hog house foundations have been repaired. According to the farm manager (Vincent Jessup) the cracks were caulked and then concrete placed on the outside walls where each crack was found. I did not inspect each repair but the ones I viewed were not leaking, It is my understanding you will be visiting the houses again to view this repair for yourself. If there is anything I can do to assist with this repair or future verification please let me know. 2. Applefield Farm has had some changes in personnel over the recent past which has likewise resulted in some duty changes associated with farm operations, At this time the certified operator for the Applefield Farm animal waste system will be Mr. Philip Faucette, one of the farm owners. However, this designation is expected to change in the near future. The owners of Applefield Farm are hoping one or more of their farm employees will take the certification course and obtain their certification. When this happens you will be notified of the change. So for now the certified operator will be Mr. Faucette. 3. As stated in my last letter to your office (i.e. addressed to Mr. Larry Coble), from now on a waste analysis of the lagoon effluent will be conducted within 60 days of the application of animal waste. I am told the farm manager did sample the lagoon effluent close to the 60 day window, but not actually within the window. If this was the case 1 doubt that the lack of sampling within this window greatly affected the actual nitrogen application amounts. Without drawing this issue out, the farm owners and manager are aware of this sampling requirement so I trust this will not happen again. 4, Field # 10 is shown on Exhibit 6 of the Revised Swine Utilization and Irrigation Plan developed for Applefield Farm (dated 9-2-98). It was shown on this Exhibit mainly for identification. Field # 10 was mentioned within the plan as being available for the land application of animal waste (e.g. for sludge application) if ever needed, but no specific application amounts were given for this practice. Field # 10 was not used in the crop production or nitrogen removal tables presented within the P.O. BOX 426, ABERDEEN, N.C. 28315 - PHONE (910) 944-1648 - FAX (910) 944-1652 plan since it was only a reserve field. In other words, it was mentioned as a resource s❑ the farmer and DWQ would be aware of its existence. So there is no confusion, Applefield Farm personnel told me they have not used Field # 10 for the application of animal waste since the plan was written. In order to simplify your concerns over Field # 10, 1 am withdrawing this field as a candidate for the land application of animal waste. If Field # 10 is ever scheduled for use Applefield Farm will need to amend their plan to show waste application methodology, waste application amounts, cropping scheme, etc. 5. The farm manager has installed a "top of dam" marker in the lower lagoon as requested by DWQ. I saw this marker during my on -site visit but I did not check its level with a transit. 6. From now on, the farm manager will check and record lagoon freeboard readings weekly, 7. 1 discussed the difference between the pull acres used in calculating Plant Available Nitrogen (PAN) and the pull acres shown in the plan with Ms, Robin Cox during our meeting. As you likely know, Ms. Cox organizes and helps keep records for Applefield Farm, According to Ms. Cox, she had mis-typed a value on one of the record keeping forms for one of the pull lanes, thus throwing off the calculated irrigation coverage for that month. I believe Ms. Cox mentioned this to you on the day of your inspection. If you have additional questions about this issue please tali Ms. Cox but I believe she has corrected this typing. mistake. 8. Applefield Farm has removed the bailed hay mentioned in your letter. As one final point, Applefield Farm is now reviewing their overall farm cropping patterns to see if they need revising at this time. Once they make some decisions about existing crops vs. changes, we may need to revise the agronomic portion of their waste management plan. If this occurs 1 will send DWQ and the NRCS a revised copy. Otherwise the plan will stay as is. I trust this information satisfies DWQ's request for a reply. I would appreciate a call or a letter acknowledging DWQ's closure to this Notice Of Violation issue so we are not left unsure of future action required by the farm.
