Notice of Intent to Issue a NPDES Wastewater Permit
The North Carolina Environmental Management Commission proposes to
issue a NPDES wastewater discharge permit to the person(s) listed below.
Written comments regarding the proposed permit will be accepted until
30 days after the publish date of this notice. The Director of the NC Divi-
sion of Water Resources (DWR) may hold a public hearing should there be
a significant degree of public interest. Please mail comments and/or infor-
mation requests to DWR at the above address. Interested persons may vis-
it the DWR at 512 N. Salisbury Street, Raleigh, NC to review information
on file. Additional information on NPDES permits and this notice may be
found on our website: htta://dea.nc.gov/about/divisions/water-resources
/water -resources -permits wastewater-branch/np.des-wastewater . ublic-
notices,or by calling (919) 707-6301. KBI, LLC has applied for renewal of
NCO047091 for Silver Maples Mobile Estates WWTP in Cabarrus County.
This permitted facility discharges treated wastewater into Rocky River;
Yadkin -Pee Dee River Basin. Currently total residual chlorine is water
quality limited. This discharge may affect future allocations in this portion
of the watershed.

Data Review -- Reviewed BIMS data from 2014 through present. There have been numerous
enforcements since the last permit renewal in 2014, all occurring in January and May of 2017. All
violations are limit violations which all proceeded to civil penalties. In 2017, the facility requested
remission of civil penalties, but the request was denied. Historical rainfall events took place during the
time of the violations, causing flooding and making it impossible to distinguish wastewater and
floodwaters. This facility was remitted of penalties for similar reasons in the past, but no rainfall data or
USGS flow data was provided with the remission request for this penalty. The facility was planning on
connection with a local municipality by the end of 2016.
