After reviewing your application, we have detennined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. PROJECT SUMMARY: Robert and Pamela Hendrickson are requesting a CAMA Major Permit to construct a bulkhead an average of 14' waterward of normal water level and install a four-foot wide riprap alignment on the waterward side of the bulkhead. Robert and Pamela Hendrickson Field Report Page 2 PROJECT SETTING The applicant's property is an 8,147 square foot vacant lot located at 1909 Harbour View Drive (Lot 35, Section 0) in Colington Harbour Subdivision, Colington Island, in Dare County. Colington Island is a high-density residential waterfront community situated along the Albemarle Sound. Located on the west side of the property is the Albemarle Sound, on the east is Harbour View Drive, and on the north and south sides are dwellings. According to the application narrative approximately 13' of the applicant's bulkhead was damaged this year during a March storm. Over the next months subsequent storm events slowly worked on the structure, ultimately destroying the 43.9' alignment. Backfill from the bulkhead ~-was washed outexposing-a-Iayer-ofdebris on-the shoreline including concrete, rock, brick; rebar, and a remnant tieback piling system. Normal water level (NWL) is currently located an average of 14' landward of the original bulkhead alignment. The lots north and south of the site have bulkheads, and the natural weak point for erosion along the shoreline is at the applicant's property. Lots within the subdivision were created on remnant dune systems or dredge spoil. This lot appears to have been created on a mix of remnant dune with construction debris for erosion control. Vegetation on the site is sparse and limited to domestic grasses, weeds and a small amount of salt meadow cordgrass. There are no coastal wetlands or non-coastal wetlands located on the property. Albemarle Sound is classified as coastal waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Albemarle Sound, at the location in question, is SB (swimming). Additional review indicates that there are no unusual geological formations associated with the applicant's property. There are several identified archeological sites within the Colington Harbour Subdivision, but none within the immediate vicinity of the applicant's property. PROJECT DESCRIPTION _,.___. '_ .' u__. __.._ _' - .~---~ ._,-- According to the application, the applicants would like to recover land lost due to erosion over the last year, and restore the previous bulkhead alignment. The proposed bulkhead would be an average of 14' (maximum of 15') waterward of NWL. The proposal also includes installing riprap (with a base width of four-feet) on the waterward side of the bulkhead, to reduce scouring on the landward side during severe storm events. The long fetch across the sound creates high wave energy along the shoreline at the applicant's property. The use of the riprap is in an attempt to reduce over wash and scouring along the bulkhead. ANTICIPATED IMPACTS Based on the information provided, and a site review, the applicant's proposal will have the following impacts if approved: . A total of 790.2 square feet of shallow bottom (Estuarine and Public Trust waters) will be filled. . Approximately 658.5 square feet of high ground will be filled and elevated. . The placement of the riprap on the waterward side of the bulkhead will reduce the effects of scouring on the landward side of the bulkhead during severe storm events. . The' construction of the proposed bulkhead, and the placement of the proposed fill will encapsulate the construction debris that is currently exposed along the shoreline. . II " During the period of March 2005, the original wood constructed bulkhead at Mr. ' '-,.. oJ , Hendrickson's property (Lot 35, Section 0, Colington Harbour, Atlantic Township, Dare County) incurred damage to an approximate 13 linear foot section by westerly seas generated in the Albemarle Sound. During the westerly storms that occurred during the period of April 2-6, 2005 subsequent damage occurred, in that the wood construction bulkhead was carried-away by the seas and exposed the neighboring return wall constructions. The lack of the bulkhead allowed the Albemarle Sound to seek a new inshore water line, approximately fifteen feet from the original bulkhead line. Form DCM-MP-l (Section 3 (d.)) supplemental information Carolina Marine Structures expects that land disturbing activity will be conducted approximately twenty-nine feet from the proposed bulkhead alignment to accommodate the installation of the tie-back system as well as the place and compaction offill materials. Lot 35 Section 0 is a high energy area with very few instances of still water, therefore, accurately determining the NWL is difficult and is determined by the prevailing winds of any particular day. In addition, it is apparent that this Lot was used as a concrete and debris dump site at an unknown time(s) in the past. The installation of the proposed bulkhead would significantly change the current appearance of this property. In view of the aforementioned, both adjoining property owners and Mr. Hendrickson wanted the immediate installation of a new bulkhead along the previously established bulkhead line. Carolina Marine Structures, Inc. scheduled a site visit by CAMA representatives and was advised during the site visit that the proposed bulkhead installation, in relationship to the new water line mark, was beyond the scope of a CAMA General Permit and a Major permit would be required. Per discussions and , correspondence with the adjoining property owners, the adjoining property owners were insistent upon the installation of a bulkhead in the original line to provide system integrity. As an interim protective measure, both adjoining property owner return walls were repaired under a General CAMA permit until subsequent approval of the Major Permit. With regard to the proposed project, Carolina Marine Structures, Inc. desires to conduct the following installation methods, uses, operations and purposes along the original bulkhead alignment: Move existing small rip-rap from the original bulkhead alignment (rip rap to remain in the water and will be moved only a few feet to allow sheet and pile installation) Install a pile and heavy wale supported vinyl bulkhead that spans approximately 44' between adjoining property owner return walls. Install two ten foot return walls. Install rip rap material along the Sound side of the proposed bulkhead. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The alignment of the permitted bulkhead shall be as depicted on the attached workplan drawing labeled 1 of 3 entitled "cross section" dated revised 10/4/05. 2) The bulkhead shall be constructed prior to any backfilling activities. 3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 4) Any request to extend riprap more than 4' waterward shall require additional review from the Division of Coastal Management. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. Signed by the authority of the Secretary of DENR and the Chairman of the Coastal Resources Commission. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 8) No backfill material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead, without permit modification. ___ ___.._ ____ __.__._.______..._-'-c~_.~-____~_ --- ---. ~--.-.-------- -- 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. 11) The riprap material shall not extend waterward more than 4' from the new bulkhead. 12) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 13) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl or broken concrete.
