NCAC 2B.0267) Authorization Certificate
Dear Mr. Dischinger:
You have our authorization, in accordance with 15A NCAC 02B .02 and the City of Mebane's Jordan Lake
Riparian Buffer Protection Ordinance and any conditions listed below, to impact approximately 1,817 ft' of Zone 1
and 1,239 ft2 of Zone 2 of the protected riparian buffers for the purpose of clearing and grading at the subject
property as described within your application from May 2', 2019, received by the City of Mebane. In addition, you
should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with
your project including (but not limited to) Erosion and Sediment Control, Non -discharge regulations.
This authorization certification is for the purpose and design that you described in your application. If you change
your project, you must notify the City and you may be required to submit a new application. Note that this
authorization is for the following: Impacts #10. If the property is sold, the new owner must be given a copy of this
authorization letter and is thereby responsible for complying with all conditions. This authorization requires you to
follow the conditions listed below.
The Additional Conditions of the Certification are:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications governing the
proper design, installation and operation and maintenance of such Best Management Practices in order to
protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and
Erosion Control Planning and Design Manual.

b. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of the
North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased
borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated,
and maintained in accordance with the most recent version of the North Carolina Surface Mining
Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with
the requirements of the Sedimentation Pollution Control Act.
No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre -Construction Notification (if required). All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards, statutes, or
rules occur.
4. No Sediment & Erosion Control Measures within Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters without prior approval by
the Division. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
design and placement of temporary erosion control measures shall not be conducted in a manner that may
result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of
the above structures. All sediment and erosion control devices shall be removed and the natural grade
restored within two (2) months of the date that the Division of Land Resources or locally delegated
program has released the project.
5. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities
through the protected stream buffers and will not re -concentrate before discharging into the stream as
identified within 15A NCAC 2B .0267(8).
6. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these boundaries
approved under this authorization shall be clearly marked with orange warning fencing (or similar high
visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior
to any land disturbing activities to ensure compliance with 15A NCAC 2B .0267.
7. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent modifications, the
applicant is required to return the attached certificate of completion to the City of Mebane, Planning
Department.

Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and
protective buffers in order to assure compliance for future wetland, water and buffer impact. These
mechanisms shall be put in place at the time of recording of the property, or of individual lots, whichever is
appropriate. A sample deed notification can be downloaded from the 401/Wetlands Unit web site at:
http://portal.ncdenr.org/web/wq/sM/ws/401/riparianbuffers. The text of the sample deed notification may
be modified as appropriate to suit to this project. This information shall be included on the final plat of the
water quality basin and shall include the maintenance and access easement.
Any disputes over determinations regarding this Authorization (associated with the approved buffer impacts) shall
be referred in writing to the City of Mebane within thirty (30) days of receipt of this notice for a decision.
You can contest the City of Mebane's decision as provided in the City's Jordan Lake Riparian Buffer Protection
Ordinance. This Authorization shall expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0267 and
the Jordan Lake Riparian Buffer Protection Ordinance. If you have any questions or would like a copy of the buffer
rules, please call Josh Johnson, PE at (336) 226-5534. This letter does not authorize any impacts to either Waters
of the United States or Waters of the State. Please contact the US Army Corps of Engineers (USACE) or NC
Division of Water Resources (DWR) if any impacts are proposed to either of these waters.

Section C. REQUIRED ITEMS CHECKLIST
The following checklists outline submittal requirements. Initial in the space provided to indicate the
following submittal requirements have been met and supporting documentation is attached.
General Requirements:

DWS 1. Sheets shall be no larger than 36" x 24" plan and profile paper.
DWS 2. Minimum text size shall be 1/8".
DWS 3. Scale on plan view shall be no smaller than 1" = 50'; scale on profile view shall be
no smaller than 1" = 50' horizontally and 1" = 5' vertically using a grid showing F
intervals.
DWS 4. All drawings to be in North Carolina State Plane coordinate system.
DWS 5. Provide a legend indicating existing and proposed lines, features and symbols.
DWS 6. All elevations shall be given in relation to mean sea level; elevations in profile view
shall be labeled in 10' intervals on the heavy lines (Ex. 350, 360).
DWS 7. Plan views shall have a north arrow on each drawing.
DWS 8. All drawings sealed, signed and dated by a NC Professional Engineer or Landscape
Architect.
DWS g. A signed and sealed statement on the plans certifying that the Buffer Disturbance
shall comply with the City's Jordan Lake Riparian Buffer Ordinance.
DWS —.10. Plans shall show label the buffer, buffer disturbance, and active minimization
measures taken. Plans shall show the reason for the buffer disturbance and include
disturbance totals and type of disturbance.

sewers, drainage structures, driveway pipes, water mains, sanitary sewer mains, etc.
All available elevations shall be shown on the profile view. Direction of flow shall
be shown on plan view for all sanitary sewers and storm drains. Materials and pipe
sizes shall be labeled.

DWS 13. Existing utility lines shall be shown and labeled on plan view and indicated in the
legend.
DWS 14. Plans shall show final proposed locations and dimensions of all water, storm drain,

calculations, invert elevations for all inlets and manholes and profiles of sanitary
sewer lines.

You have our approval for the impacts listed below for the purpose described in your
application dated April 25, 2019, received by the Division of Water Resources (Division) April 29,
2019. These impacts are covered by the attached Water Quality General Certification Number
4133 and 4139 and the conditions listed below. This Certification replaces the Certification
issued on November 6, 2018. This certification is associated with the use of Nationwide Permit
Numbers 12 and 29 once they are issued to you by the U.S. Army Corps of Engineers. Please
note that you should get any other federal, state or local permits before proceeding with your
project, including those required by (but not limited to) Sediment and Erosion Control, Non -
Discharge, and Water Supply Watershed regulations.

3. The proposed project must comply with the Town of Mebane local water supply
ordinance approved by the N.C. Environmental Management Commission (EMC) as
required under the Jordan Lake Water Supply Watershed: Protection and Maintenance
of Riparian Areas (Jordan Buffer Rule) 15A NCAC 02B .0267. No impacts to the stream
at the road crossing shall occur until the Permittee has secured a Buffer Authorization
from the Town of Mebane.
4. Any additional impacts to streams and/or wetlands as a result of future roads, buildings,
driveways, utility lines or other development related activities within this subdivision
will require a modification of this 401 Water Quality Certification approval. [15A NCAC
02H .0506(4) and 15A NCAC 02H .0501 and .0502]
5. All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the
construction area on the project site shall be clearly marked (example- orange fabric
fencing) prior to any land disturbing activities and must be maintained on the property
until the project phase is completed. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A
NCAC 02H .0507 (c)]
6. As requested by the NC Wildlife Resource Commission, tree clearing activities shall not
occur during the maternity roosting season for bats (May 15 —August 15).

7. The permittee shall report to the Winston Salem Regional Office any noncompliance
with this certification, any violation of stream or wetland standards [15A NCAC 02B
.02001 including but not limited to sediment impacts, and any violation of state
regulated riparian buffer rules [15A NCAC 02B .0200]. Information shall be provided
orally within 24 hours (or the next business day if a weekend or holiday) from the time
the applicant became aware of the circumstances. A written submission shall also be
provided within 5 business days of the time the applicant becomes aware of the
circumstances. The written submission shall contain a description of the noncompliance,
and its causes; the period of noncompliance, including exact dates and times, if the
noncompliance has not been corrected, the anticipated time compliance is expected to
continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of
the noncompliance. The Division may waive the written submission requirement on a
case-by-case basis.
This approval and its conditions are final and binding unless contested. [G.S. 143-215.5]
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH) within sixty (60) calendar days.
A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information. A petition is considered filed when the original
and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal
office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state
holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.
