Spoil Disposal The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 7) If any effluent fr,om the dredge material,s will flow into waters closed to the harvest ,of shellfish, a minimum of 24 hour prior notification shall be given to the Division of Environmental Health,Shellfish' Sanitation and Recreational Water Quality Section, so that appropriate temporary closures to the harvest' of shellfish may be put in place. All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. No spoil material shall be placed within 30 feet of the normal high water line. 10) General The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: NOTE: Future development of the permittee's property may require a modification of this permit. NARRATIVE DESCRIPTION: Project Setting The project site is a 4.1-acre tract adjacent to Hoop Hole Creek located at 1300 W. Fort Macon Rd. in Atlantic Field Investigation Report [Bogue Shores] September 23, 2005 Page 2 of 2 Beach in Carteret County. A 149-unit condominium complex with associated parking and infrastructure, a swimming pool, and a community pier and boat ramp to serve the owners presently occupying the site. There are 10 slips available on a "first come, first serve" basis. There is an excavated channel from Bogue Sound through Hoop Hole Creek to the project site that terminates in a basin serving three adjacent docking systems. The property is characterized by sandy soil and typical landscape vegetation. The average elevation on the tract is approximately +5' NHW. The property is serviced by a private septic tank and municipal water. State Permit #10-94 was issued to the applicant for the re-configuration of the docking system and ramp construction in 1994, and State Permit #121-97 was issued for the dock expansion in 1997. The tract is stabilized with a timber bulkhead. There is a fringe of Borrichia frutescens and Spartina patens approximately 6' wide at the location of the existing pier. This transitions to a fringe of Spartina alterniflora approximately 15'wide, before yielding to open water. The body of water is approximately 600' across at the project site. Bottom composition in the area is sandy, and does not indicate the presence of submerged aquatic vegetation in the immediate vicinity of the project. The waters of Hoop Hole Creek are classified as SA by the Division of Water Quality; the area is not designated Primary Nursery by the Division of Marine Fisheries; and the area is closed to the taking of shellfish. The Atlantic Beach Land Use Plan classifies the property as Developed, with those areas within CAMA Areas of Environmental Concern classified as Conservation, Project Description The applicant proposes to excavate a 40' x 40' area on the southwest corner of the existing ten slip dock, The existing water depths at NLW are -2'. The connecting water depths at NLW to the North side of the dock are -4' and these depths continue to the channel. The area to be excavated would have 2' of material removed (118.5cy) by hydraulic excavator and would offload the material from the barge and taken to an approved high ground location. The purpose of the excavation would be to give the dock slips a uniform depth on both sides so the entire dock could be utilized. 10. ANTICIPATED IMPACTS: The impacts from the excavation would be the removal of 118,5cy of sand from a 1600sf area of shallow water bottom of Hoop Hole Creek. Some turbidity could be expected during excavation, but should be short in duration once digging is completed, The spoils would have no impact as they are to be offloaded from the barge and disposed at an approved high ground site. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated October 5, 2005. The applicant, Bogue Shores, has applied for a Department of the Army (DA) permit to conduct dredging in a boat basin connectecfto Bogue Sound. The proposed work is being considered under Regional General Pennit # 198000291, a penniUprocessing agreement for work that has been approved 'pursuant to the North Carolina Coastal Area Management Aet (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 40 I, as amended; 16 U.S.c. 661.667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection offish and wildlife resources. Additional comments are provided regarding the District Engineer's detemlination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.c. 1531-1543). Project Ste, Proposed Actions, and Anticipated Impacts The PN contains the Field Investigation Report (FIR), dated September 23,2005, of the North Carolina Division of Coastal Management (NCDCM). The project site is on the north side of Bogue Banks, a barrier island. The site is an existing, 1 O-slip docking facility with a channel connecting to Bogue Sound. The area is not designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries. The FIR states that the bottom surrounding the dock is sandy and does not indicate the presence of submerged aquatic vegetation (SA V). The FIR states that the applicant proposed to dredge an area of approximately 40 feet square on the southwestern comer of the dock. The area to be dredged now has a depth of two feet at nomlallow water (NL W) while the other side of the dock (and water in the connecting channel) has four feet of depth at NLW. Dredging would be done by a hydraulic excavator which would apparently be mounted on a barge. The material (approximately 118.5 cubic yards) would be offloaded from the barge and taken to an approved high ground location. Project impacts would be limited to the removal of material from 1,600 square feet (ft2) of estuarine bottoms Federally Protected Species The Service has reviewed available infonnation on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed infonnation from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and A. 2 state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data fwm USGS quads provide the most project-specific information on species which should be considered in pern1itting this project. The project area appears to be in the Mansfield quad. The occurrence data of special status species within this quad can be obtained on the internet at < httn://www.ncsparks.net/nhp/CJuad.html >. Our review indicates that the only federally protected species likely to occur in the project area is the West Indian manatee (Triclzcclzus mallatus), a federally-endangered mammal. The species has been reported from Carteret County and there is a current occurrence record in the Mansfield quad. The shallow, estuarine waters of Bogue Sound provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may occupy waters one to two meters (3.3 .6.6 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. Based on infornlation in the FIR, water depths at the construction site appear to have minimal habit value for manatees. Furthennore, considering the small scale of the proposed work, dredging is likely to be concluded before June 2006. Therefore, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical11abitat deternlined that may be affected by the identified action. Scrvicc Conccrns and Rccommcndations Based on the infornlation given in the PN, the Service believed the proposed activities will not have significant adverse and/or irreversible effects on fish and wildlife resources. Therefore, the Service has no objection, from the standpoint of fish and wildlife, to the issuance of a DA pern1it for the proposed activities.
