On July 22, 2005, the DWQ received an amended permit application for the proposed project. As the submitted additional information did not address items in the above mentioned additional information request, we are returning your application as incomplete in accordance with 15A NCAC 2H .0506. Project Description and Impact Justification As noted above, you have not provided any description of the type of project to be constructed on this site. Furthermore, your submitted plan provided no construction details related to the project itself (such as cross sectional details of the proposed culverts, proposed headwall impacts, proposed flow dissipation impacts. Please note that we cannot review your application for avoidance and minimization of impacts, nor stormwater management, as required in 15A NCAC 2H .0506(b). You have not demonstrated why Biggerstaff Branch must be culverted for a length of 150 linear feet because no alternatives analysis can be conducted due to the lack of project details. We cannot determine how the site constraints affect your project, and therefore whether you have minimized adverse impacts to surface waters. Should you desire to pursue this project, you must provide a thorough description and plan drawings of the development plans for this site, and clearly illustrate how the two properties are related on the site. Additionally, please indicate proposed lot layout as overlays on the site plan. 2. Mitigation 150 feet of compensatory stream mitigation is required for this project because of cumulative impacts associated with the two properties, unless you can make a compelling case that these are two distinct, separate and complete projects, and the Corps of Engineers agrees to treat the site as two separate and complete projects. Please provide a compensatory stream mitigation plan. The plan must conform to the requirements in 15A NCAC 2H .0506(h) and must be appropriate to the type of impacts proposed. You have the following options for satisfying the mitigation requirement associated with this project: a) Payment into the North Carolina Ecosystem Enhancement Program (EEP), if the EEP will accept the responsibility for conducting this mitigation work, or b) Preparing and implementing a stream mitigation plan with a minimum of a 1:1 restoration component for 150 feet of impacts. If you decide to propose use of EEP in lieu of developing your own stream mitigation plan, you will need to contact Ms. Suzanne Klimek with the EEP at (919) 733-5208 to see if they will accept the project. If I do not hear from you by the end of the week about these projects, I will assume they can be withdrawn and withdrawal letters will be sent out on these projects. At no point have you provided information which would show that these projects were independant of one another. * As these are one project, you have submitted an application for a cumulitave total of 150 linear feet. As such, this project is subject to mitigation. The cumulative impacts must be less than 150 linear feet of impact in order for there to be no mitigation required. * In response to your reference that the application has spent more time in my office than anywhere else, the project was received on November 23, 2004. It was reviewed in Raleigh (Central office) and placed on hold January 11, 2005 due to being incomplete. On March 14, 2005, you called Mr. Jim Reid regarding the status of this project, and were once again told that there was an outstanding additional information request and the project remained on-hold. This project remained on hold until July 22, 2005 when you submitted some of the additional information requested. 15A NCAC .2H .0507 (a) requires the DWQ to make a decision on a project within 60 days of receipt of a complete application. As you second submittal did not include all of the information requested during the site meeting, nor requested in the Additional Information request. As the submitted information is incomplete, and had been on-hold for such a long time awaiting additional information, we were left with no choice but to return the application as incomplete. As the application return package stated, should your client decide to pursue thier project further, a complete application, which includes a discussion about stormwater management for the life of the project, addressing the jurisdictional stream running down the bank at the west end of the property, and any of the other information requested onsite and in the additional information request, along with a new processing fee, to the DWQ 401 Central Office, in order for the DWQ to proceed. As of August 15, 2005, this project is no longer processable by the DWQ. It should be noted that a directive from the Deputy Director of the Department of Environment and Natural Resources instructs us to contact the consultant via e-mail or fax, and to return the package if no response has been received within 3 business days. The DWQ has been plenty gracious holding your package for greater than six months, but will be unable to offer this in the future. Please contact the U.S. Army Corps of Engineers Asheville Regulatory Field Office at (828) 271-7980 and ask them to determine which Nationwide Permit will be applied to this work. You should also request that they determine the boundaries of the "single and complete project" on this site. 3. Plan Details a. Please provide a better location map for the project. The map provided lacks a scale, north arrow, clear labels on the road, or any crossroads to provide a frame of reference for location. Furthermore, it is unclear which of the circled boxes refers to the site at hand, and it is unclear where the site is in comparison to the vicinity map on the grading and drainage plan. Please provide a vicinity map which includes a scale, north arrow, labeled roads, and a site location which matches the vicinity map on your grading and drainage plan in order to facilitate location of the site. b. Please provide original plans, profiles and cross sections of Biggerstaff Branch and depict clearly the impacted section, including all fill slopes, dissipaters, and bank stabilization on the site plan. Please note that bank stabilization measures, such as rip rap, must be included in your impact calculations. Please provide a clear illustration of how the stream impacts associated with the two properties will be matched up or joined. c. Please provide details of any dissipaters on upstream and downstream side of the culverts for the properties/site. Please indicate the location of the protected buffers as overlays on the site plan. d. You should note that Biggerstaff Branch is classified as C Tr. Since this is a trout stream, please indicate all pre-and-post construction impacts to trout buffers on the site plan. e. Please provide cross section details showing the provisions for aquatic life passage. f. Section XI of the Pre-Construction Notification requires that you provide the existing and proposed impervious surface area for the site in order to stormwater management needs to be determined. You noted that "No final site plan has been worked up on this site." As discussed earlier in this correspondence, we cannot issue a 401 Water Quality Certification for which no specific project details have been provided. Please specify the percent of project imperviousness area based on the estimated built-out conditions. If this percentage exceeds 30%, you will need to include a site-specific stormwater management plan designed to remove 85% TSS according to the latest version of DWQ's Stormwater Best Management Practices manual at a minimum. Additionally, in watersheds that are classified as trout waters (Tr), the Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed according to latest version of the NC DENR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan when a site-specific stormwater management plan is required. g.
