This permit, issued on June 8, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
I) Due to resource agency concerns, and in accordance with a request made by the permittee, the
excavation of the area between the two borrow ponds is hereby deleted from the proposed project.
Any such reference to this excavation in the attached permit application forms and attached workplan
drawings is hereby deleted.
Shoreline Stabilization
2) The alignment of the permitted bulkhead shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall
require the alignment to be restaked by DCM within a maximum of 30 days prior to the new
expected start of construction.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.

ADDITIONAL CONDITIONS
3) The bulkhead shall be constructed landward of all vegetated wetlands.
q) The bulkhead shall not extend waterward of the normal water level at any point along its alignment at
the time of construction.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This pennit does
not authorize any excavation waterward of the approved alignment.
8) The fill material shall be clean and free of any pollutants except in trace quantities.
9) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Docking Facilitv
10) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
pen-nit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
11) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other stricture, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust
Waters without permit modification.
12) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel or deep water, then drawing a line perpendicular to the
channel/deep water line that intersects with the shore at the point where the upland property line meets
the water's edge.
13) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.

14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
15) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
16) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
17) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
18) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
19) This permit authorizes a maximum of six boat slips.
Sedimentation and Erosion Control
20) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
t diversion swales or berms, etc.).
22) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
23) The permittee understands and agrees that, if future operations by the United States requires the
f removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
renim A or alteration.

24) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that, in accordance with the
Rules of the Environmental Management Commission, many non-water dependent activities are
not authorized within 50 feet of the normal water level.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.
041855.

Reference the application of Robert P. Waldrop for a Department of the Army permit to
excavate wetlands and construct a pier and boat slips, on property located off State Road 1764,
adjacent to Jordan Creek, near the Community of Winsteadville, in Beaufort County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the proposed wetland
excavation activity between the existing ponds not be authorized.
In addition, we recommend that the following conditions be included in the State
authorization for the proposed pier and boat slips:
1. No excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, in such a manner as to impair normal flows and
circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands.
2. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.

3. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the pemiittee's discovery of the violation.
4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
6. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.

Dear Mr. Waldrop:
On July 24, 2000, we renewed General Permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the State
of North Carolina.
A review of your application received November 29, 2004, for Department of the Army
(DA) authorization to excavate wetlands and construct a pier and boat slips, on property located
off State Road 1764, adjacent to Jordan Creek, near the community of Winsteadville, in Beaufort
County, North Carolina, indicates it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your application will be accomplished by
the North Carolina Division of Coastal Management. Comments from Federal review agencies
will be furnished to the State.
If your application must be withdrawn from this general permit process for any reason, you
will be informed regarding its further management. If there are no unresolved differences in
State-Federal positions or policies, the final action taken on your application by the State will
result in your receiving written notice from us that your application is consistent with the general
permit and you may commence your activity. Only after receiving such confirmation should you
begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed
a memorandum of agreement (MOA) establishing procedures to determine the type and level of
mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This
MOA provides for first, avoiding impacts to waters and wetlands through the selection of the
least damaging, practical alternative; second, taking appropriate and practical steps to minimize
impacts on waters and wetlands; and finally, compensating for any remaining unavoidable
impacts to the extent appropriate and practical. To enable us to process your application in full
compliance with this MOA, we request that you provide the following additional information:

a. Permits for work within wetlands or other special aquatic sites are available only if the
proposed work is the least environmentally damaging, practicable alternative. Please furnish
information regarding any other alternatives, including upland alternatives, to the work for which
you have applied and provide justification that your selected plan is the least damaging to water
or wetland areas.
b. It is necessary for you to have taken all appropriate and practical steps to minimize
wetland losses. Please indicate all that you have done, especially regarding development and
modification of plans and proposed construction techniques, to minimize adverse impacts.
c. The MOA requires that appropriate and practical mitigation will be required for all
unavoidable adverse impacts remaining after all appropriate and practical minimization has been
employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or
wetlands or provide information as to the absence of any such appropriate and practical
measures.
This information is essential to our expeditious processing of your application and it should
be forwarded to us by December 15, 2004. Also, a copy of this information must be sent to the
North Carolina Division of Environmental Management to enable them to adequately evaluate
your application for a Water Quality Certification pursuant to Section 401 of the Clean Water
Act.
Your application, pursuant to Section 10 of the River and Harbor Act and Section 404 of
the Clean Water Act, has been assigned Action ID No. 200510058 and will be coordinated by

17, 2004. According to our rules [15A NCAC 2H.0507 (A)], if final action is not taken within 60 days, the
Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has
waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described
in your November 17, 2004 application materials.
However, if additional impact occurs or your development plans change, this waiver is no longer valid and
a 401 Water Quality Certification will be required.

Project Setting
The 3.5-acre project site is situated in a residential subdivision located in eastern
Beaufort County off SR 1777 on Jordan Creek off the Pungo River near Belhaven, North
Carolina. The highground adjacent Jordan Creek is developed as a single waterfront lot
with a single septic system supporting one mobile home. The project site has a total of
three existing septic systems. Lots in this residential subdivision are 50' wide. The
dominate feature of this project site is two oval shaped relic borrow ponds approximately
40' wide x ±400' long each, separated by a earthen plug that once held a culvert pipe
allowing drainage from the most landward pond. This culvert pipe was washed out
during Hurricane Isabel. Currently the two ponds are connected by a 5' wide x 8" to 12"
deep opening where the culvert once existed. Water depths in the ponds range from 5' to
7' deep: It appears that the ponds were once Coastal Wetlands excavated prior to permit
requirements during early development of the subdivision. A ±4' wide x ±80' long strip
of Coastal Wetlands separates the relic borrow ponds from Jordan Creek. There is a 5'
wide by 8" to 12" deep connection through the coastal wetland strip to the relic borrow
pond adjacent Jordan Creek. Tidal flow has been observed through this connection to
Jordan Creek as well as between the two relic borrow ponds. A small area of Coastal
Wetlands (±100 ft2) exist in the relic borrow pond adjacent Jordan Creek. This area of
Coastal wetlands is located at the landward end of the pond next to the connection
between the ponds. The Coastal Wetland vegetation consists mainly of Spartina
cynosuroides and includes Distichilis sspicata and Juncus roemerianus. Other 404
wetlands fringe the borrow ponds with varying widths vegetated with Phragmties
australis, baccharis halimifolia, and Carex sp.
The shoreline at the project site has a landward curve forming a small
embayment. There is a 40' long deteriorated bulkhead that extends from the property line
on the upstream side. Jordan Creek Marina is the adjacent property downstream. The
adjacent property upstream is developed as a single-family residence situated on two 50'
wide lots. Both the Marina and adjacent residential lot have piers in excess of 170' in
length. The adjacent property upstream has two piers, one with mooring piles within the
project site's riparian area. Water depths 100' offshore the project site are +3' deep.
Jordan Creek is classified as SA NSW by the Environmental Commission and
Inland Waters by the Wildlife Resource Commission and is closed to shellfishing at this
location. Jordan Creek is also classified as an Inland Primary Nursery Area.
Project Description
The applicant is proposing to excavate between the two relic borrow ponds
30'wide x 70'long x 4' to create a navigable connection between the two ponds. The
applicant reasons that the Coastal Wetlands between Jordan Creek and the adjacent relic
borrow pond will eventually erode opening the borrow ponds to navigation.

The applicant also proposes to construct a 6'x 184' pier with an 8'x 12' L-head platform
and 3-3' x 15' finger piers accessing six proposed slips. The existing bulkhead is
proposed to be replaced and extended 110' landward of Coastal Wetlands into the relic
borrow pond adjacent Jordan Creek.
Anticipated Impacts
The excavation of the earthen plug between the two relic borrow ponds will result
in some localized short-term turbidity. Excavation of the earthen plug will increase the
volume and rate of discharge of storm water and tidal flow from the ponds to Jordan
Creek. These flows may hasten the erosion of the Coastal Wetlands between the relic
ponds and Jordan Creek. Also, these higher flows may enlarge the existing non-
navigable channel to Jordan Creek. The pier will shade ±1,245 ft2 of Jordan Creels
bottom. The project will provide an increase in the number of moorings available for
recreational boaters in Jordan Creek and their associated impacts.

This project proposal abandons the excavation of an access channel in the designated PrimaryNurscry areas that
triggered the requirement for a NC SEPA document for processing of the application.
PROJECT:
The proposed project will provide shoreline stabilization, provide a pier and docking for the property and its owners.
and connect the two ponds which already have connected naturally from the effects of hurricanes and natural wind tide
flow.
Four boat slips are provided for each of the four heirs to the property and 2 additional slips are provided in two lots can
be created out of the southernmost parcel. If subdivision of the southernmost parcel is not possible because of county or
other restrictions, the parcel will remain and be utilized by the Waldrop family.
The excavation between the two relic ponds is requested because of the following reasons.
• Currently, hurricanes and heavy rains produce heavy flow volumes which continually bypasses the culvert,
erode the side slopes, produce frequent siltation of the surface waters, still manage to reach Jordan Creek
with or without the excavation proposed.
• A connection already exists between the two ponds and also to the creek., so the excavation will not produce
a connection which does not already exist
• The connection should provide a greater volume of water to promote better circulation within the relic ponds
and allow for improved flushing
• A desire to provide a stable side slope configuration that will prevent perpetual siltation of the surface waters
as the natural opening continues to enlarge naturally
• To provide an opening of sufficient size to navigate between the two relic ponds.
• As the coastal wetland plug at the northernmost edge of the ponds continues to erode, natural connection of
the northern relic to Jordan Creek is inevitable. As this connection occurs, the tidal wind tidal velocities and
volumes through this existing connection will increase, producing increased erosion of the hourglass shaped
area proposed for excavation. The excavation will simply produce a connection in the time and place as
chosen by the applicants and coordinated with the aid of the regulatory official guidance and oversight.

• The end result would be that the two ponds would eventually become another tributary of the Jordan River
as the connection becomes better established through the natural erosion of the coastal wetland plug at the
creek. The relic ponds will then provide an approximate 1.25 acres of additional water habitat for the frnfish
species present in the area and will be an excellent promulgation area for the bait species and the prey
species that depend upon tributaries for their survival. This connection will then be open to the all fishery
species, not just those contained within the fresh water dominated'ponds.
• As the saline content of the water in the relic ponds increases with the eventual erosion of the coastal
wetland plug, the pond side slopes are likely to become vegetated with increasing amounts of coastal
wetland plant species.
• By establishing the connection under the guidance of regulatory officials the siltation can be minimized
reduced by requiring that a tubidity curtarpA a in place during the excavation, and remain so until such a
time as the slopes are stabilized betwce to two bonds.
• This project will undoubtedly improve the fishery diversity and potential in the relic ponds. The excavation
will also provide areas of topographic diversity available to the finfishes for spawning and predator
avoidance. The excavation and natural erosion of the coastal wetland plug will eventually create additional
1.25 acre tributary and fishery producing habitat on Jordan Creek in a time in which most applicants for
permits are requesting filling of coastal water habitat and wetlands. The Waldrops are hoping to provide
additional habitat available to these species and at the same time provide water access between the relic
ponds.
The applicants propose the following development activities to meet these goals:
• Construct a 184 LF X G ft wide pier in Jordan Creek
• Construct three 3' x 15' wooden finger piers
• Construct one 8' X 12' wooden platform with seating
• Install 4 mooring pilings
• Repair/Replace existing 40 LF wooden bulkhead and 9 LF return wall
• Construct 110 LF wooden Bulkhead as shown (portions of which will be constructed in uplands, landward of
coastal wetlands -see plat) Coastal Management to stake bulkhead alignment prior to construction
• Create spoil disposal area greater than 30 ft from NWL with securely installed silt fence border
• Remove the washed out culvert between the two ponds (with and excavator)
