PROJECT SUMMARY: The applicant proposes to construct residential and commercial development that includes 2 hotels, 5 condominiums, 22 single-family residential lots, retail shops, and to perform maintenance dredging of an existing marina basin, entrance channel, and slip area. PROJECT SETTING The site of the development proposal is a 21.6-acre tract located in the Town of Manteo in Dare County between Fernando Street to the north and Greenville Street to the south with Manteo Middle School property and Uppowoe Street (unimproved) to the west and Shallowbag Bay to the east. The property currently has an operating commercial marina that consists of a man-made basin with an entrance channel, a bulkhead, docks within the basin, a fuel dock, travel lift piers, dry stock storage both enclosed and open, an open water docking facility in Shallowbag Bay, a marina office, a boat ramp and parking area. The marina is located in the approximate center of the property. The marina has a capacity of 62 wet slips and approximately 100 dry stack storage spaces. The basin is approximately 180 feet by 100 feet with water depths that range from -5 feet to -8 feet. The entrance channel is approximately 300 feet by 100 feet with water depths that range from -3 feet to -9 feet. The water depths around the existing open water docks range from -5 feet to -8 feet. The water bottom consists of sand and silt sediments. Vegetation at the marina area consists mostly of yard grasses and is maintained. To the south of the marina is a Coastal Wetland marsh vegetated with Juncus roenterianus. The marsh fronts Shallowbag Bay and is approximately 600 feet wide. Landward of the salt marsh, the property consists of upland that is vegetated with red bay, willow, pine, and indigenous grass. The transition fringe between the salt marsh and the uplands is vegetated with common reed. The northern portion of the property has four single-family dwellings and the vegetation is dominated by pine and yard grasses. There is a 42,421-square foot pond and wetland area located near the shoreline in this section of the property. Vegetation in this area consists of pine, red bay, and Juncus roenierianus. The shoreline in this area has a sandy beach. The soils on the property to the north consists of a Coastal Wetland marsh that is owned by the Town of Manteo. This property has a boardwalk and an access walkway from the water to Fernando Street. The adjacent property to the south is Greenville Street, which is a town maintained street with houses along the south side. The elevation of the property varies from + 1 foot above Normal Water Level (NWL) in the marsh to approximately +4 feet in the upland areas. The property has approximately 1000 feet of shoreline in the marsh area, approximately 1300 feet of shoreline that has a bulkhead and includes the marina basin, approximately 150 feet of the shoreline that has a sandy beach, approximately 450 feet of bulkhead in front of the applicant's home, and approximately 200 feet of breakwater bulkhead in front of a wetland fringe located at the northeast property line. DEVELOPMENT PROPOSAL The development proposal includes the removal of all existing buildings and the construction of 22 single- family residential lots (7,500 square feet), three condominium complexes (6,000 square feet) with four units each, two condominium complexes (10,000 square feet) with 12 units each, four retail lots with apartments located on the second floor (ranging from 4,011 square feet to 6,011 square feet), two 30- room hotels (6,600 square feet each), six retail shops with upstairs apartment living (1,500 square feet), and up to six town homes. The development will also include the necessary infrastructure (utilities, roads, and stormwater management system necessary for the project). The applicant proposes to construct multiple stormwater impoundment areas that total 12,302 square feet. The proposed development will utilize the existing basin, channel, marina slips, moorings, and bulkheading. The development proposal includes dredging the bottom of the basin, channel, and slip area to a water depth of -8 feet. All spoil material, estimated to be 2,850 cubic yards, will be deposited on site within a 10,000-square foot diked impoundment area if a dredge is used, or on three designated spoil sites near the basin that total 22,813 square feet in area if an excavator with a barge is used. All spoil material will be used on site for site elevation fill. An eight-foot wide wooden boardwalk is proposed to be constructed along the waterfront and parallel to the existing shoreline bulkhead. This structure and the associated accessways will total 2,447 linear feet and will be deeded over to the Town of Manteo as a public access, according to the application. To connect the proposed boardwalk with the Town of Manteo's existing boardwalk, the applicant proposes to construct a 36-foot by 16-foot platform that will connect to an existing 24-foot by 24-foot platform located over the water in Shallowbag Bay. An additional bulkhead/retaining wall is proposed to be constructed approximately 30 feet landward of the NWL for site grading purposes and soil retention. The applicant proposes to disturb approximately 14 acres of upland and bring the existing average of +4 feet above NWL elevation to +8 feet above NWL prior to the construction of any of the proposed buildings. Two areas of 404 wetlands are proposed to be filled for the construction of entrance roads. The combined area of fill at both sites is 0.095 acres. One site is located on the northern property line and connects the project to Fernando Street. The second site is located at the southern property line and connects the project to Greenville Street. Near this area, the applicant proposes to construct a pile supported 1,616- square foot gazebo and walkway over adjacent 404 wetlands. ANTICIPATED IMPACTS The development proposal will have many impacts with the majority occurring outside of CAMA permitting jurisdiction. The impacts will include the following: Harry B. Schiffman (Historic Manteo) Field Investigation Report Page 4 1) The proposed platform will shade 576 square feet of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AECs). 2) The maintenance excavation/dredging of the basin, channel, and dock area will result in bottom disturbance of 76,787 square feet and the removal of 2,850 cubic yards of bottom material, consisting of sand and silt, affecting PTA and EW AECs. 3) The proposed site supported gazebo will result in the shading of 1,616 square feet of 404 wetlands. 4) The total proposed building coverage within the Estuarine Shoreline AEC is 38,700 square feet and the total paved area within the ES AEC is 12,355 square feet for a total of 51,055 square feet, which represents 23 percent impervious coverage. This includes all companion or accessory structures (pool, pool pad, playground equipment, etc.). 5) The proposed 8-foot wide public boardwalk and accessways, which include a 6-foot wide walkway connected to Fernando Street, will shade approximately 4,700 square feet of Coastal Wetlands AEC and 21,000 square feet of ES AEC. 6) Of the existing 21.6 acres, 14 acres that represent all of the upland areas, will be disturbed either by the addition of fill material to bring the elevation to +8 feet above NWL or to create stormwater retention areas. Approximately 90,000 square feet of this area is located within the ES AEC. 7) The amount of impervious surface proposed for the upland area outside of the ES AEC is approximately 232,000 square feet. Temporary water turbidity will occur during construction and during the dredging of the water body involved. Population density for the area will increase and public pedestrian access will be increased by this project. Submitted by: Frank A. Schiffnan, and is operated as a full service marina and dry stack boat storage facility. The proposed project name is currently Historic Manteo. Enclosed with this correspondence are the applicable forms, DCM-MP-1, DCM-MP-2 and DCM-MP-3, two plaaview-plats that depict the overall development proposed, a copy of the Division of Cultural Resources request for archaeological assessment, copies of the riparian adjacent property owner notification letters including return receipts and reply, and the following project narrative that provides a description of the proposed overall development. Based on concerns expressed during the April 8, 2004 scoping meeting by the NC Division of Marine Fisheries (DMF) and the National Marine Fisheries Service (NMFS) related to Secondary Nursery Area (SNA) and Essential Fish Habitat (EFH) in proximity to the project area the applicants have requested that Quible prepare a Major CAMA Permit Application for the proposed upland development that utilizes the existing marina and slips that currently serve the Salty Dawg Marina and dry boat storage facility. Please note, no marina development is proposed at this time. PROJECT NARRATIVE Site Conditions/Proposed Development Overview: The proposed development discussed herein is located south of the Manteo waterfront with frontage along Shallowbag Bay centered approximately around 35° 54' 19.2" N latitude and 75a 40' 14.4" W longitude. The 21.6 acre property is bordered by Fernando Street to the north, Greenville Street to the south, Dare County Middle School to the west and Shallowbag Bay to the east. Proposed development includes the construction of single family residential units, multifamily units, retails shops, hotels, an elevated boardwalk and associated infrastructure. Enclosed with this correspondence are two plan view plats (Attachment 1) that accurately depict the project as proposed. The Town of Manteo (Town) has issued a Resolution (Attachment 2) declaring their support for this project. In addition, the project has been approved by the Town Board and is considered an extension and enhancement of the existing Manteo waterfront. Historic Manteo Major Cama Permit Application Currently, the site is operated by the property owner, Harry B. Schiffman, as a commercial marina and dry storage facility known as the Salty Dawg Marina. Once the master plan has been implemented, the dry storage facility will be eliminated and the existing marina will be used to provide moorings and slips for both resident and transient vessels that utilize the group development. The waterfront development will include boardwalks and a docking area for the general public and the waterfront will be deeded over to the Town to insure public access to Shallowbag Bay. As planned, the development should decrease the total number of boats using the marina. The subject property consists of several parcels owned by Harry B. Schiffman. As discussed earlier, the central portion of the property is being utilized as a full service marina offering dry stack storage, boat repair, and retail sales of gasoline and diesel fuels. Structures on site include the dry stack storage building, the marina store and a one story waterfront home. The southeastern quadrant of the tract is dominated by undeveloped coastal wetlands and a section 404 wetlands fringe that is dominated by Phragmites australis, an invasive species. The Schiffman home site is located on the northern upland portion of the tract and is dominated by a mature pine forest. Proposed upland developments on the subject property for which this Major CAMA Permit Application package is required, currently include 22 single family residential lots (7,500 sf.), three condominium complexes (6,000 sf.) with four units each, two condominium complexes (10,000 sf.) with 12 units each, four retail lots with apartment(s) located on the second floor (ranging from 4,011 sf. to 6,011 sf.), two 30 room Hotels (6,600 sf. each), six retail shops with upstairs apartment living (1,500 sf.) and up to six town homes. The development will also include the necessary infrastructure (utilities, roads, and stormwater management system necessary for the project). The proposed development will utilize the existing marina slips, moorings, bulkheading and proposes an additional 8 foot boardwalk (constructed of wood) along the water front parallel to the existing bulkheading. An additional bulkhead is proposed to be constructed approximately 30 feet landward of the normal water level for site grading purposes. A total of 0.095 acres of wetland are proposed to be filled for road crossings. Proposed mitigation of the wetlands fill is the contribution of $3,000.00 (0.25 acres) to the Ecosystem Enhancement Program, formerly the Wetlands Restoration Program. A letter requesting eligibility to contribute to the EEP was mailed to the EEP office on June 23, 2004. A copy of the letter has been included for your records. Please note, a determination as to the eligibility of the proposed mitigation through contribution has not been determined as of the date of this permit submittal. The areas of Section 404 wetland to be filled are outside the 75 feet Area of Environmental Concern. Impervious coverage within the 75 feet AEC will include buildings, concrete walkways, paved roads and parking areas. Based on calculations using the proposed development plats provided, impervious coverage within the AEC will total 23%. Impervious coverage on the residential lots will not exceed 30%. Please note, the boardwalk proposed will be constructed of pervious materials (slotted wood) and will be located within the 30 feet vegetative buffer required by LAMA. A 1,616 square feet gazebo is proposed to be constructed within the Section 404 wetlands on the southern portion of the property. The entire 30 feet vegetative buffer extending from the northern property boundary to the southwest corner of the main marina channel will be deeded over to the Town of Manteo at the conclusion of development activities to insure public access to the waterfront. i P 2 r ^r Historic Manteo Major Cama Permit Application AUG OF '2004 Grading, Excavation and Fill/ Stormwater: ELIZABETH C, i Y Current elevations at the site range from less that one foot near the normal water level to nearly 11 feet, but on average the overall site elevations are between four and five feet above sea level. The finished elevations for the proposed development will vary from and average of three to nine feet. Excavation required to create Stormwater impoundment areas is estimated to be approximately 750 cubic yards. It is also estimated that 89,614 cubic feet of fill material will be required to achieve the final elevations of the proposed development. The estimate of the amount of soil excavation needed to create the stormwater impoundment areas was calculated using the area of impoundment (12,302.5 sq. ft.) times the existing average depth (5.0') minus the lowest elevation required to construct the impoundment area (3.0'); equaling 24,605 cubic feet (-912 cubic yards). The amount of fill required was calculated by assuming a uniform fill depth of 4.0' (average proposed elevation of 8.0' minus the existing average elevation of 4.0') times the area of upland development (609,957 sq. ft.); equaling 90,364 cubic yards. A detailed site specific stormwater management plan is being prepared for the project. The site specific stormwater plan will show the engineered elevations necessary for proper containment and treatment of stormwater and runoff. In general, Stormwater and runoff will be directed away from Shallowbag Bay to a series of retention ponds and treated on-site to applicable NC Division of Water Quality (DWQ) standards prior to discharge. To date a Stormwater Management Plan has not been submitted. Sedimentation and Erosion Control Plan A sedimentation and erosion control plan will be submitted to the NC Division of Land Quality to control sediments and erosion during the construction phase of the project. To date a Sedimentation and Erosion Control Plan has not been submitted. Potable Water and Wastewater: Potable water will be supplied to the project by Dare County and wastewater services will be provided by the Town of Manteo via their central wastewater treatment plant. Please note, copies of the certified mail receipts and response from one of the adjacent riparian property owners have been included as Attachment 3. A letter from the Ecosystem Enhancement Program (EEP) accepting payment for riparian wetland impacts associated with the required wetlands fill for road crossings has been included as Attachment 4. In addition, a letter form the North Carolina Department of Cultural Resources (NC- DCR) recommending a comprehensive archaeological survey of the properties has been included as Attachment 5. An archaeological contractor has not been contacted to perform the survey as of the date of this letter. However, an archaeological survey will be performed as suggested by the NC-DCR. An aerial photograph taken post Isabel of the area has been included as Attachment 6 as a reference for the coastal wetlands boundary as discussed in our July 13, 2004 meeting on site. A majority of the wetlands on site are coastal wetlands and are therefore not eligible to be considered as mitigation through preservation by conservation easement. The Nationwide 14 Fill Permit application proposes to fill 0.095 acres of Section 404 Jurisdictional Wetlands. The fill is required to connect roads that already exist and are maintained by the Town to the roads that will service the new development. There are not enough remaining Section 404 wetlands on the parcel to mitigate the proposed fill through a conservation easement at an acceptable ratio (10:1). Therefore, it is proposed that a one time 0.25 acre contribution ($3,000.00) be made into the EEP as mitigation for the proposed wetlands fill at the site. The 21.6 acre tract fronts Shallowbag Bay and is comprised of three parcels currently owned by Mr. Harry B. Schiffinan. Proposed future development will be an extension of the Town of Mantco waterfront, which will include retail shops, hotels, condominiums and up to 22 single family home sites. The development plan has been given preliminary approval by the Town of Manteo. A resolution entitled Resolution 2004-04, Water Access supporting this type of development was adopted by The Town of Mantco on March 3, 2004. Please find enclosed a vicinity map and a conceptual site plan overlain on an aerial photograph showing the water front expansion. A review of our files indicates that there are no recorded archaeological sites in the proposed development area. However, the property has not been subject to survey by an experienced archaeologist. Based on survey information from nearby areas, combined with the well-documented presence of early colonial and Civil War period activities, the project area is considered to have a high probability for containing potentially significant cultural resources. Therefore, we recommend that a comprehensive survey be conducted by an experienced archaeologist to identify and evaluate the significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. Two copies of the resulting archaeological survey report, as well as one copy of the appropriate site forms, should be forwarded to us for review and comment as soon as they are available and well in advance of any construction activities. A list of archaeological consultants who have conducted or expressed an interest in contract work in North Carolina is available at www.arch.dcr.state.nc.us/consults. The archaeologists listed, or any other experienced archaeologist, may be contacted to conduct the recommended survey. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. In order to protect juvenile fisheries resources, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management. -2- 4. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. 5. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 6. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters outside of the authorized areas. 7. The Permittee shall mitigate for 0.095 acre of wetland impacts associated with this project by payment to the North Carolina Ecosystem Enhancement Program (NCEEP) in an amount determined by the NCEEP sufficient to perform 0.18 acre of riparian wetland restoration mitigation in the Pasquotank River Basin (HUC 03010205). Discharge into wetlands on permitted projects shall begin only after the Permittee has made full payment to the NCEEP, and the NCEEP has made written confirmation to the District Engineer, that it has received payment and agrees to accept responsibility for the mitigation work required, pursuant to Paragraph IV.D of the Memorandum of Understanding between the North Carolina Department of Environment and Natural Resources and the U.S. Army Corps of Engineers, Wilmington District, dated November 4, 1998. 8. Excavation will not exceed -8 feet below the elevation of mean low water (MLW). 9. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. 10. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 11. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work, which may be caused from existing or future operations undertaken by the United States in the public interest. 12. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. -3- 13. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 14. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 15. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
