Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Subdivision Access Road I ) Unless specifically altered herein, this permit authorizes only the access road, including two pile supported bridges and six culverts, to provide access to the individual subdivision lots, as is expressly and specifically set forth in the pen-nit application and depicted on the attached work-plan drawings. Any additional land disturbing activities and/or construction shall be evaluated on a case-by-case basis by a representative of the Division of Coastal Management (DCNI) to determine additional permit requirements. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. 2) Prior to the initiation of construction, the permittee shall schedule an on-site meeting with a representative of the Division of Coastal Management. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. An,, maintenance work or project modification not covered hereunder requires further Division approval. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. PROJECT SUMMARY: This project involves the construction of a 2,400-foot long, 12-foot wide asphalt or gravel driveway to provide access to 4 existing residential parcels off of Colington Road in Dare County. The driveway access will include two pile supported 12-foot wide bridge structures and six 15-inch culverts. David A. Deel, Palmetto Point, Dare County FIELD INVESTIGATION REPORT Page 2 Proposal Site Setting Palmetto Point is located in Dare County off of Colington Road. The site is at the end of Beasley Lane and is a 37.85-acre peninsula on Little Colington Island. This peninsula is approximately 800 feet wide, extends northward from Colington Road into Kitty Hawk Bay and is bounded by Dog Point Creek to the west and Colington Creek to the east. This property is owned by David A. Deel. The property contains approximately 6.53 acres of upland area, which is primarily configured on three ridges running in an east-west alignment spanning the entire peninsula. These ridges (as well as scattered pockets of high ground) consist primarily of sandy Fripp soils. These ridge elevations range between 4 feet to 10 feet above the surrounding wetland and shoreline grades. Separating these ridges are areas of USACOE Section 404 jurisdictional wetlands, and in some areas, CAMA jurisdictional coastal wetlands. Palmetto point has been legally subdivided into three separate parcels consisting of 10.30 acres, 11.45 acres, and 16.10 acres. Currently, this site has no vehicular access and can only be accessed by boat from the surrounding waters, or by foot at the end of Beasley Lane through an existing 45-foot long access easement across an adjacent property. This easement crosses wetland and upland terrain and was purchased/granted from William Tabb to F. Warren Meekins and David A. Dee[ on June 17, 2004. The F. Warren Meekins tract consists of 9.63 acres and is located between the Tabb and Deel tracts. Palmetto Point is covered in a combination of maritime forest and wetlands, including Quercus virginiana, Pinus taeda, Acer rubrum, Quercusalba, Juniperus virginiana and Myrica cerifera in the existing upland areas. Wetland areas are vegetated in Spartina patens, Spartina cynosuroides, Juncus roemerianus and Typha spp., as well as Borrichia frutescens, Baccharis halimifolia, Iva frutescens, Myrica cerifera, Magnolia virginiana, Salix nigra, and of course, Saba/palmetto minor. True to the peninsula's name, palmetto is very abundant. The waters of Kitty Hawk Bay, Colington Creek, and Dog Point Creek connect to the Albemarle Sound. The Coastal Resources Commission (CRC) has designated the waters of the Albemarle Sound as Public Trust Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the designation of the CRC, the Coastal Shoreline AEC extends 75 feet landward from the NWL in this vicinity. Coastal wetland areas that receive tidal flooding from estuarine waters have also been designated as Coastal Wetland AEC's by the CRC. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Albemarle Sound as Coastal Waters. Development Proposal The purpose of this proposal is to provide vehicular access to four residential tracts that are isolated immediately to the north of the end of Beasley Lane. Multiple routes were explored. The proposed route represents that route with the least square footage of wetland disturbance. A David A. Deel, Palmetto Point, Dare County FIELD INVESTIGATION REPORT Page 3 The proposed access will consist of an approximate 2,389-foot long, 12-foot wide driveway with a serpentine route. To minimize wetland impacts, even though it will result in a longer driveway, the route is aligned through upland areas when possible thatwill avoid significant trees. Three passing areas are planned within existing upland areas. Two culverts are planned that will be positioned off of the driveway route. These are positioned to provide individual access to future home building sites set off of the driveway. The route will begin near the end of Beasley Lane and will follow a deeded easement across the F. Warren Meekins property. The alignment will continue in a northeastern direction to near the center of the peninsula. The proposed driveway route will cross 6 freshwater/404 US Army Corps of Engineers (USACOE) jurisdictional wetland areas and 2 coastal wetland/CAMA jurisdictional wetland marsh areas. The applicant has proposed to install six 15-inch culverts to provide access across the freshwater wetland areas and two 12-foot wide pile supported bridges across the coastal wetland marsh areas within the alignment, respectively. The overall route width will range between 14 and 24 feet. The 24-foot width will be used through freshwater wetland areas allow for a 3-foot, 6-inch shoulder on each side of the driveway. These shoulders will be constructed at a 3 to 1 grade. The route width through upland areas will be only 14 feet. The route will result in 42,059 square feet of upland and wetland disturbance. This figure also includes 2,856 square feet of coastal wetland shading.. Culvert installation will result in the filling of 20,163 square feet of freshwater wetland fill, and on February 11, 2004, via of Action ID 2004411144, this impact was delineated by the USACOE. The bridge structures will be located on the "Meekins" tract (bridge #1) and Parcel A (bridge #2). Bridge #1 will be 164 feet and bridge #2 will be 140 feet in length. The bridge structures will be 12 feet in width, be elevated 3 feet above the existing marsh grade and will include bulkhead-retaining wall structures on both bridge end abutments. A culvert will be located on the Tabb and Meekins tracts and 2 culverts will be placed on each parcel (Parcel A and B). As referenced above, one culvert on each of these parcels will be placed outside of the driveway alignment and will be used to provide individual driveway access at a later date to separate home sites. The driveway grade through freshwater wetlands will include 1 to 2 inches of fill in combination culvert placements. The culverts will be placed slightly below grade and will include the placement of rock riprap at both culvert ends. This project will not result in the fill, construction within, or shading of any public trust area or estuarine waters. David A. The F. Warren Meekins Tract consists of a 9.63 acre pie-shaped tract located immediately to the south of Palmetto Point which also spans from Dog Point Creek to Colington Creek albeit with minimal frontage on Colington Creek. This tract contains a similar mixture of upland and wetland as Palmetto Point with the upland being concentrated in the southern portion of the property. As with Palmetto Point, there is currently no vehicular access to the site which may be accessed by boat from the surrounding waters or by foot from Beasley Lane through wetland and high ground along an existing 45' access easement. Proposed Access As noted above, the purpose of this application is to provide vehicular access to four residential tracts which currently are isolated immediately to the north of the end of Beasley Lane. Multiple routes were explored with the route proposed on the enclosed plans being the scenario which represented the smallest disturbance of wetland (smallest disturbance to both coastal wetland and 404 wetland independently). As shown on the plan, the driveway is serpentine in sections; following high ground where possible in order to minimize wetland impact. Within the access easement there is added flexibility due to the easement width in order to allow routing of the roadway in the field around significant trees, etc. as necessary. The access driveway is proposed to be 12' in width (minimal width required for a single lane) with passing areas constructed within high ground, surfaced with either asphalt or gravel. Construction within the USACOE Section 404 Wetlands is to consist of the 12' wide driveway placed on F - 2' of fill (depending on the soil suitability) with 3:1 tie off-slopes from the driveway edge to natural grade. Construction within CAMA Jurisdictional Coast Wetlands is to consist of a 12' wide elevated timber bridge with adequate clearance underneath for continued growth of wetland species and movement of wildlife. Future Construction Palmetto Point represents an extremely low density approach to residential development. There are three residential homesites on 37.85 Acres of land resulting in a density of 0.079 units per acre, or 1 residential unit per 12.6 acres. Additionally, a fourth large residential parcel (9.63 acres) is provided access via the proposed driveway - at this time, only a single residence may be constructed on this parcel. When the Warren Meekins Tract is included in density calculations, the resulting density is 0.84 units per acre, or 1 residential unit per 11.8 acres.
