Director Division of Water Quality March 11, 2005 DWQ# 04-1816 Cleveland County DENR - WATT APPROVAL of 401 Water Quality Certification with Additional Conditions, Ecosystem Enhancement Program Dear Sir or Madam: You have our approval, in accordance with the attached conditions and those listed below, to impact 172 linear feet (If) of unnamed tributary to Buffalo Creek in order to construct the Case Farms Feed Mill in Cleveland County, as described in your application received by the Division of Water Quality (DWQ) on November 9, 2004. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3402, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. The General Certification allows you to use Nationwide Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted Certification will expire when the associated 404 permits expire unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. In addition to the requirements of the certification, you must also comply with the following conditions: 1. The Mooresville Regional Office shall be notified in writing once the approved activity/construction has commenced. 2. We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP) in order to compensate for the impacts to the streams. In accordance with 15A NCAC 2R.0402 and 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h) and 15A NCAC 2B .0233(10). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program), the stream impacts shall not occur. For accounting purposes, this Certification authorizes the impact of 344 linear feet of perennial streams in the Broad River Basin, Cataloging Unit 03050105, and 344 linear feet of stream mitigation is required. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes are installed in a perched manner, the pipes shall be removed and re- installed correctly. Use of native vegetation and other soft streambank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be placed in the stream bed, unless approved by the DWQ. 4. Stormwater discharge structures shall be constructed in a manner such that the potential receiving streams (of the discharge) at the site will not be impacted due to sediment accumulations, scouring or erosion of the stream banks. 5. A final written stormwater management plan shall be approved in writing by this Office prior to the construction of any permanent facilities at the subject site. The stormwater facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater facilities shall be made without written authorization from the Division of Water Quality. 6. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities shall be performed so that no violations of state water quality standards, statutes, or rules occur. 7. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within two months of the date the Division of Land Resources has released the project. 8. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401iWetlands Unit of the NC Division of Water Quality. Please send photographs of the upstream and downstream sides of each culvert site to document correct installation, along with the Certificate of Completion form. 9. Continuing Compliance. Case Farms of N.C., Inc. (Case Farms) shall conduct its activities in a manner consistent with state water quality standards (including any requirements for compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify Case Farms and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to Case Farms in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. ... The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 211.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Plan Details a. Please indicate all buffer impacts on the site plan. b. Please indicate the location of the protected water supply buffers as overlays on the site plan. 2. Stormwater a. Please provide the location of any proposed stormwater management practices as required by 15A NCAC .0215 (3)(b)(ii)(B). b. Please provide detail for the stormwater management practices as required by 15A NCAC 02B .0215 (3)(b)(ii)(B) Critical Area for Water Supply III. c. Because your site is located in the critical area (intake) for a stream classified as water supply III 15A NCAC .0215 (3)(b)(ii)(B) states that a project with greater than 12 percent impervious utilize stormwater controls to control 1 feet of runoff. Furthermore a 100 feet vegetative buffer applies to all high-density projects (impervious cover greater than 12%). No new development is allowed in this buffer. THE LARGE CREEK IS PART ONSITE WORK AND THE SMALL STREAM IS PART OF THE RAILROAD WORK. CASE FARMS OWNS THE 39 ACRES AND THE SPUR LINE WORK IS WITHIN THE CSX RAILROAD RIGHT- OF-WAY. WE ARE ENCLOSING CALCULATIONS FOR THE BUILD OUT DENSITIES OR IMPERVIOUS AREAS. CLEVELAND COUNTY STAFF INFORMED US THAT THE BUFFER REQUIREMENTS FOR COMMERCIAL SITES IS 24%. THE PROPOSED ON-SITE (39 ACRES) IMPERVIOUS AREAS TOTAL OUT TO BE +/-16%, WELL WITHIN THE SET LIMIT. THE PROBLEM OCCURS ON THE PROPOSED WIDENING OF THE AREA NEXT TO THE EXISTING RAILROAD TRACK AND CONSTRUCTING THE NEW RAILROAD SPUR LINES. THERE ARE VERY SMALL AREAS OF THIS WORK IN THE STREAM LOCATIONS BUT IF YOU CALCULATE THE ENTIRE LENGTH AND MULTIPLY SAME TIMES THE WIDTH THE AREA BECOMES LARGE AND THE IMPERVIOUS AREAS, ALL STONE, BECOME LARGE, GREATER THAN 24%. 201 W. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The project application is not entirely clear; but it appears that the company proposes to enlarge an existing feed mill operation and construct three (3) railroad spur lines. It appears that the company prepares and mixes animal feed. Activities include loading and unloading of trucks and railroad cars. Total impacts from a 48" and a 30" pipe will be 172 linear feet of perennial stream. Due to time constraints, we have not visited the site. Based on our review of the submittal, we will not object to the project; however, we encourage stormwater permitting and management as well as spill prevention plans to reduce stormwater issues related to this manufacturing operation. Petroleum and biological oxygen demand may be issues of concern. Mitigation may be appropriate for perennial impacts as well as any previous jurisdictional impacts associated with the site. Where practicable and feasible for aquatic life passage, culverts 48 inches diameter or larger should be buried a foot into the streambed and culverts less than 48 inches diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. If stormwater ponds are proposed, we recommend the attached planting suggestions. Pure Live Seeds (PLS) per acre. * When possible on slopes less than 3:1 use Switchgrass instead of lespedezas and on slopes greater than 3:1 use Orchard Grass or Creeping Red Fescue. Other native species maybe appropriate depending on soil, slope, and region. Korean lespedeza maybe appropriate in colder geophysical areas. We do not recommend Sericea lespedeza. Native plants and warm season grasses are preferred over exotic plants. Depending on elevation and region, other native species may be appropriate. Note that mowing should be limited to late winter or early spring. Mowing should only occur as needed to prevent unwanted tree growth on a 2-3 year schedule. The provision of shade around impounded waters can significantly reduce thermal impacts. Trees and shrubs (1 year bare root seedlings) should be planted randomly at a minimal rate of 100 trees per acre on the top and upper portions of the structure and at a minimal rate of 150 per acre around the normal water elevation and littoral shelf area.
