The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where the waste is to be applied. This waste utilization plan uses nitrogen as the limiting nutrient. Waste should be analyzed before each application cycle. Annual soil tests are strongly encouraged so that all plant nutrients can be balanced for realistic yields of the crop to be grown. Several factors are important in implementing your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infiltration rates, leaching potentials, cation exchange capacities; and available water holding capacities. Normally waste shall not be applied to land eroding at greater than 5 tons per acre per year. With special precautions, waste may be applied to land eroding at up to 10 tons per year. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not allowed under DEM regulations. Wind conditions should also be considered to avoid drift and downwind odor problems. To maximize the value of nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied to bare ground not more than 30 days prior to planting. Injecting the waste or disking will conserve nutrients and reduce odor problems. The estimated acres needed to apply the animal waste is based on typical nutrient content for this type of facility. Acreage requirements should be based on the waste analysis report from your waste management facility. Attached you will find information on proper sampling techniques, preparation, and transfer of waste samples to the lab for analysis. This waste utilization plan, if carried out, meets the requirements for compliance with 15A NCAC 2H.0217 adopted by the Environmental Management Commission. RECEIVED ! Page 4 REQUIRED SPECIFICATIONS Animal waste shall not reach surface waters of the state by runoff, drift, manmade conveyances, direct application, or direct discharge during operation or land application. Any discharge of waste which reaches surface water is prohibited. Z There must be documentation in the design folder that the producer either owns or has an agreement for use of adequate land on which to properly apply the waste. If the producer does not own adequate land to properly dispose of waste, he/she shall provide a copy of an agreement with a landowner who is within a reasonable proximity, allowing him/her the use of the land for waste application. It is the responsibility of the owner of the facility to secure an update of the Waste Utilization Plan when there is a change in the operation, increase in the number of animals, method of utilization, or available land. Animal waste shall be applied to meet, but not exceed, the nitrogen needs for realistic crop yields based on soil type, available moisture, historical data, climatic conditions, and level of management, unless there are regulations that restrict the rate of application for other nutrients. 4 Animal waste shall be applied to land eroding less than 5 tons per acre per year. Waste may be applied to land that is eroding at 5 or more tons, but less than 10 tons per acre per year providing grass filter strips are installed where runoff leaves the field. (See FOTG Standard 393 - Filter Strip). Odors can be reduced by injecting the waste or disking after waste application. Waste should not be applied when there is danger of drift from the irrigation field. When animal waste is to be applied on acres subject to flooding, it will be soil incorporated on conventionally tilled cropland. When applied to conservation tilled crops or grassland, the waste may be broadcast provided the application does not occur during a season prone to flooding. (See "Weather and Climate in North Carolina" for guidance) 7 Liquid waste shall. be applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. The potential for salt damage from animal waste should also be considered. 10 Waste nutrients shall not be applied in Fall or winter for spring planted crops on soils with a high potential for leaching. Waste nutrient loading rates on these soils should be held to a minimum and a suitable winter cover crop planted to take up released nutrients. Waste shall not be applied more than 30 days prior to planting of the crop or forages breaking dormancy. 11 Any new swine facility sited on or after October 1, 1995 shall comply with the following: The outer perimeter of the land area onto which waste is applied from a lagoon that is a component of a swine farm shall be at least 50 feet from any residential property boundary and from any perennial stream or river (other than an irrigation ditch or canal. Animal waste other than swine waste from facilities sited on or after October 1, 1995), shall not be applied closer than 25 feet to perennial waters. (See Standard 393 - Filter Strips). 12 13 14 15 16 Animal waste shall not be applied closer than 100 feet to wells. Animal waste shall not be applied closer than 200 feet of dwellings other than those owned by the landowner. Waste shall be applied in a manner not to reach other property and public right-of-ways. Animal waste shall not be discharged into surface waters, drainageways, or wetlands by discharge or by over -spraying. Animal waste may be applied to prior converted wetlands provided they have been approved as a land application site by a "technical specialist". Animal waste shall not be applied on grassed waterways that discharge direcfly into water courses, and on other grassed waterways, waste shall be applied at agronomic rates in a mannerthat causes no runoff or drift from the site. Domestic and industrial waste from washdown facilities, showers, toilets, sinks, etc., shall not be discharged into the animal waste management system. Page 6 REQUIRED SPECIFICATIONS (continued) 17 A protective cover of appropriate vegetation will be established on all disturbed areas (lagoon embankments, berms, pipe runs, etc.). Areas shall be fenced as necessary to protect the vegetation. Vegetation such as trees, shrubs, and other woody species, etc., are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible. Berms and structures should be inspected regularly for evidence of erosion, leakage or discharge. 18 If animal production at the facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution and erosion. 19 Waste handling structures, piping pumps, reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks and spills. A regular maintenance checklist should be kept on site. 20 Animal waste can be used in a rotation that includes vegetables and other crops for direct human consumption. However, if animal waste is used on crops for direct human consumption it should only be applied pre -plant with no further applications animal waste during the crop season. 21 Highly visible markers shall be installed to mark the top and bottom elevations of the temporary storage (pumping volume) of all waste treatment lagoons. Pumping shall be managed to maintain the liquid level between the markers. A marker will be required to mark the maximum storage volume for waste storage ponds. 22 Waste shall be tested within 60 days of utilization and soil shall be tested at least annually at crop sites where waste products are applied. Nitrogen shall be the rate - determining element. Zinc and copper levels in the soil shall be monitored and alternative crop sites shall be used when these metal approach excessive levels. pH shall be adjusted for optimum crop production and maintained. Soil and waste analysis records shall be kept for five years. Poultry dry waste application records shall be maintained for three (3) years. Waste application records for all other waste shall be maintained for five (5) years. 23 Dead animals will be disposed of in a manner that meets North Carolina regulations. Klimek, RE, Director Division of Water Quality This is to notify you of violations to Swine Waste Management System General Permit AWG100000 issued on October 1, 2004 under Certificate of Coverage AWS710043. On November 2, 2004, Mr. Chester Cobb from the Wilmington Regional Office of the Division of Water Quality performed a compliance inspection of the Pridgen Farm Site #2. During the inspection, Mr. Cobb noted several violations. The following violations were noted: 1. Waste management system needing improvement On December 8, 2003 a Notice of Violation was issued for several violations, which included inadequacies with the irrigation system. Then on January 29, 2004, a meeting was conducted with the owner, Division of Water Quality, Division of Soil and Water Conservation, and the Integrator to discuss issues at the farm. At that time, it was noted that a new irrigation system would have to be installed or the present irrigation system modified to cover the fields as designed. On the November 2, 2004 inspection, Mr. Cobb noted that the proposed irrigation system had not been installed as previously discussed. This is in violation of Condition No. I1. 14. that states "The facility must have at least one of the following items at all times: (a) adequate animal waste application and handling equipment, (b) a lease, or other written agreement, for the use of the necessary equipment, or (c) a contract with a third party applicator capable of providing adequate waste application." Land application site needing improvement During the inspection on November 2, 2004, it was noted that stump piles were still present in the sprayfields. This is in violation of Condition No. II. 1. that states "The collection, treatment, and storage facilities, and the land application equipment and fields shall be properly operated and maintained at all times." In response to these violations, this office must receive the following information within fifteen (15) working days of the receipt of this notice: a. A written explanation of the violations. b. A written description and timetable of the actions taken or to be taken to bring the violations back into compliance and to prevent their recurrence. You may wish to contact your County Soil & Water Conservation District Office, County Extension office, a qualified technical specialist, and/or a professional engineer for any assistance they may be able to provide. On January 22, 2004 Mr. Chester Cobb and Mr. John Famell performed a follow up inspection to the violations observed by Division staff on December 3, 2003. During Mr. Cobb and Mr. Famell visit, several violations were documented. The violations are listed as follows: 1. Inadequate freeboard level On January 22, 2004, Division staff observed the freeboard level of the "New" lagoon to be twelve (12) inches. The lagoon design for the "New" lagoon on file at this office lists seven and one-half (7.5) inches for the 25-year, 24-hour storm event. Therefore, the required freeboard level of the "New" lagoon is nineteen and one-half (19.5) inches (12 + 7.5 inches). This is in violation of Condition V. 3 of the General Permit that states in part; "At a minimum, maximum waste level for lagoons/storage ponds must not exceed.the level that provides adequate storage to contain the 25-year, 24-hour storm event plus an additional 1 foot of structural freeboard." 2. Failure to notify The Wilmington Regional Office was not notified of the inadequate freeboard level. Either the heads were •► relocated to the drier areas of the fields adjacent to the farm structures or the system has several locations with damaged lateral lines, risers, or leaking riser plug4ns resulting in wastewater loss during operation of the system elsewhere when th system is pressurized. I observed no evidence that control valves are installed to allow the unused laterals to be shut down when not in use to vent waste loss from faulty plug4ns or broken lines, thus I would assume that the entire field or system is pressurized an any irrigation occurs. Without the isolation valves it is nearly impossible to tell where the leaks may be located due t expansive area where waste is ponded including higher vegetation and saturated soil conditions. AND Replace every plug-in valve with a foxed riser system that either always has a spray head attached or can have a head prior to use. OR Remove and clean every plug-in valve and replace all damaged or leaking valves. The freeboard level gauge in the newer lagoon has been pushed over probably by the. floating pump dock. It is slanted approximately a 45 degree angle, thus an accurate reading is not possible. A new , easier to read marker needs to be Mailed in a safer location ASAP. 5. There is NO cover crop currently on either field. Most of the fescue field was deep plowed during the summer ccording to the owner and no crop is currently present. No evidence that a summer annual was planted in the other field its year -- some of this field has also been deep plowed. The plowing may have damaged the irrigation system. Owner tated that the farm is too be sprigged with Bermuda in the spring and cattle & fencing have already been removed. if the wner wishes to graze or feed cattle in the non wetted area of the fields, then this is completely acceptable. In order for lermuda to survive at this 4wet7 site, field drainage must be improved. I observed that the either there is no culvert under ie farm entrance to allow the ROW ditch to drain the fields or it is completely covered up -- this must be addressed. The original field ditches along the outside of both fields have not been maintained with numerous trees, roots, snags, and ebris plugging them. These need to be cleaned out and perhaps deepened to help lower the field's water table and onvey storm water off the field. Appears that additional ditches once lined the farm path which borders the inside of both elds, but these have long since been allowed to fill in naturally or was done intentionally. These should be replaced to assist in lowering the water table an conveying storm water off the field. This is required by the General Permit under Part Ill. Monitoring & Reporting Requirements; Section 4. Forexample, waste report is dated March1st, then applications can be made until May 1st or backwards to January 1st. Waste can be applied prior to having an updated report such as spraying on February 1st and using the PAN listed on a reporton March 1st of a sample taken February20. However, the grower is cautioned against applying too often without knowing the nitrogen content of the lagoon on low PAN crops (like overseeds) or when nitrogen balance (PAN) is nearly used up for a crop to avoid over -application. It is highly recommended that samples be taken every 90 days (3 months) beginning in January to always have a valid sample report. This also allows for a 30-day period of report overlap where the grower can use the lowest PAN value of the two reports on the IRR-2 nitrogen balance records. Soil Samples -- A dated soil sample report for each spray field in the waste utilization plan is required once per calendar year (annually). This is required by the General Permit under Part III. Monitoring & Reporting Requirements; Section 3. Fields greater than 10 acres should be broken up into smaller fields for sampling purposes to obtain the most useful information. It is highly recommended that samples for pastures and hay fields betaken during the summerto obtain a report in a timely manner. Grower is cautioned against waiting past October 1st because report may not be dated and returned by the end of the year. It is recommended that a separate soil sample be taken from areas where cover crops are struggling to be maintained; indicate this is from a problem area on the paperwork for a more thorough soil analysis to be completed to find possible source of a problem. In addition, lime must be applied at the rate recommended by the annual soil report for amounts 1 ton/acre or greater to meet the requirements of Part It. Operation & Maintenance Requirements; Section 3. 2. No Operator4n-Charge Priorto the inspection it was noted that DWQ has no record of an Operator -in -Charge (OIC) listed for your facility. This is a violation of the General Permit under Part V. General Conditions; Section 2. Each facility is required to have an actively licensed OIC designated. Ms. Beth Buffington with DWQ Training & Certification indicated that you are scheduled to take the exam for the 3'd and final attempt to pass on December 13, 2001 at James Sprunt Community College. Wetted Acres Determination Yourfacildy received a letter on October20, 2000 requiring that a Wetted Acres Determination be completed for your facility prior to April 18, 2001. To date, this item has not been completed and must be completed as soon as possible to avoid additional enforcement action. Irrigation records indicate that 2 to 3 acres are being claimed for each 10 spray heads which appears to be overstating.the amount that can be covered with the system. It is possible that the millet was over -applied to this year due to overstating the acreage. Also, the flow rate is unknown for the system. The Wetted Acres process will clarify these issues. It is highly recommended that the new waste utilization plan based on the results of the Determination be written by spray zone to aid in keeping records correctly. To correct these violations, please submit a detailed Plan of Corrective Action to the Wilmington Regional Office of the Division of Water Quality that describes the actions to be taken to address these violations of Animal Waste Permit AWS 710043. ELIGIBILITY FOR A SPECIAL AGREEMENT: As per Senate Bill 1217 which was ratified on June 21, 1996, the Environmental Management Commission (EMC) may enter into a special agreement with an operator who registerdd by September 1, 1996 with their local Soil and Water Conservation District office and who makes a good faith effort to obtain an approved animal waste management plan by December 31, 1997. This special agreement shall set forth a schedule for the operator to follow to obtain an approved animal -waste management plan by a date certain and shall provide that the EMC shall not issue a notice of violation for failure to have an approved animal waste management plan so long as the operator complies with the special agreement. Operators who did not register by September 1, 199E with their local Soil and Water Conservation District office or who can not document that they made a good faith effort to obtain an approved animal waste management plan by December 31, 1997, will not receive a Special Agreement from the EMC. These facilities will be subject to civil penalties, criminal penalties, injunctions and all other enforcement tools available to DWQ. 011 1. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty.
