plan or plans to re -stack, I am going to return his package sating he
does not need a permit base on threshold (zero0 animla population. He
will have to obtain a permit *prior* to any future re -stocking .
Please advise if you have gotten any further information on this one.

The Non -Discharge Permitting Unit has completed a preliminary review of the subject application. Additional information is
required before we can continue our review. Please address the following by April 26, 2003:
This office has a waste utilization plan dated March 12, 1996 on file with the permit application. Additional information was
requested on January 12, 2001 and March 28, 2001 with the following items:
1. An inspection of your farm made on 12-8-2000 noted that you were overseeding Bermuda fields with small grains
which is not specified in vour waste plan. Please revise your waste utilization plan to reflect the correct cropping
system in the field.
2. The field acreage on the map provided do not match with those on the waste utilization plan. Please provide a clearer
map that identifies (outlines or highlights) and shows the acreage for each field to be used for waste
application.
Please verify if you follow the same waste utilization plan to date. If so, please address the above two items. Otherwise please
submit copies of a more recent plan clearly reflecting current sites, crops and associated field maps.
Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist.
Please reference the subject permit application number when providing the requested information. All information should be
signed, sealed, and submitted in duplicate to my attention at the address below- The information requested by this letter
must be submitted on or before April 26, 2003 or the Division will return your application as incomplete in
accordance with 15A N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a
violation of North Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental
Management Commission.

Your animal waste management facility is scheduled to be issued coverage under the Animal Waste
Operation General Permits in the near future. The Division of Water Quality (Division) staff is currently
in the process of renewing the Animal Waste Operation General Permits and is scheduled to have the
permit reissued by early April 2003. Once the permit is reissued, your facility would be eligible for
coverage under the reissued permit.
The Division has published a public notice regarding these renewed general permits. A copy of
the draft animal waste operation general permits and fact sheets are available at the website

This is to acknowledge receipt of your permit application submitted on December 1, 2000. A site
inspection conducted by the Division of Water Quality indicated that your operation's animal population does not
exceed the number set forth by §143-215.108(1), and therefore does not require coverage under the Swine
Waste Operation General Permit.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of
wastes to the surface waters of the state will subject you to a civil penalty up to $25,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits
listed below, you will be required to receive approval and a permit from the Division of Water Quality prior to any
construction and/or stocking animals to that level. Threshold numbers of animals are as follows:

I received a phone call last week from Stoney Matthis of DWQ. He informed me that you still
dont have a permit for your swine operation. He mentioned that you advised him that our office
was in the process of devising a new Nutrient Management Plan for your operation. After
speaking with &II Norris, he informed me that this office has starred the process, but until you
provide us with information on your irrigation system, we cannot produce a Waste Management
Plan. I have advised DWQ of this situation.
If you still require our technical assistance, it is important that you contact this office with the
necessary information.

A letter dated January 15, 1999 was sent to advise you about concerns associated with Certified Animal
Waste Management Plans and the method by which the irrigated acres within the plans were calculated. Only
the acres that are wetted can be credited in the waste management plan as receiving waste application. Any
acreage within the plan that can not be reached by waste application equipment can not be used as part of your
plan.
An evaluation by Stoney Mathis on 9/10/99 was made to review the actual number of acres at your
facility that receive animal waste during land application. The evaluation of your facility has yielded one of
the following two results as indicated by the box marked with an "X".
Category 1:
The evaluation of your facility could not be completed due to a lack of information. Please
contact your Technical Specialist to assist in providing Stoney Mathis the necessary
information to potentially exempt your facility from undergoing a complete wettable acre
determination. Please submit this information to Stoney Mathis, at 127 Cardinal Drive
Extension, Wilmington, NC 28405-3845, within in 90 days of the receipt of this letter. If you
have any questions please contact Stoney Mathis at (910) 395-3900. If within 90 days you
are unable to provide Stoney Mathis with the information you are automatically
required to complete a Wettable Acre Determination as described by Category 2
below, within 180 days of receipt of this letter.

❑ Your facility has been identified by the Department of Environment and Natural Resources
as a facility that may have overestimated the number of acres actually receiving animal
waste. Therefore, some or all of your fields may be exceeding the allowable loading rates
set in your Certified Animal Waste Management Plan.
In order to resolve this issue, please contact a designated Technical Specialist to have him
or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must
be one that has been approved by the Soil and Water Conservation Commission to conduct
Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension
Service, the Soil and Water Conservation Districts, the Natural Resources Conservation
Service, and the Division of Soil and Water Conservation have received this special
designation. You may also contact a private Technical Specialist who has received this
designation, or a Professional Engineer.
All needed modifications to your Animal Waste Management System must be made and
the Wettable Acres Determination Certification must be returned to DWQ within the next
180 days. If the needed modifications are not made and if the form is not returned within the
required time, DWO will be forced to take appropriate enforcement actions to bring this facility
into compliance. These actions may include civil penalty assessments, permit revocation,
and/or injunctive relief.
Once a Wettable Acre Determination has been completed, a copy of the attached Wettable
Acre Determination Certification must be submitted to the address listed on the form. Please
note that both the owner and the Technical Specialist must sign the certification. A copy of all
the Wettable Acre Determination documentation that applies to your Waste Utilization Plan
must be kept at your facility. DWO and the Division of Soil & Water Conservation Staff will
review all documentation during their annual visit of your facility. An additional copy must by
kept on file at the local Soil & Water Conservation District Office. Please note that if you install
or modify your irrigation system, a designated Irrigation Specialist or a Professional Engineer
must also sign the Wettable Acre Determination Certification.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

On December8, 2000,1 inspected youranimal operation andthe animal waste management system
serving this operation. During this visit, several items listed below were noted requiring immediate attention
and clarification. These involve deficiencies to the certified animal waste management plan that this facility
operates under as a deemed permitted facility pursuant to-15A NCAC 2H .0217 and North Carolina G.S.
143.215.1.
1. Inadequate Lagoon Marker
During the inspection it was observed that the lagoon marker -was inadequate because it was not clearly
discernible from the dock structure housing your recycle pumps. This marker needs to be replaced with a
marker in plain sight. Please note that your certified animal waste management plan requires correct
markers. Each marker should be straight, allow liquid level reading down to the stop pumping level,
accurately portraythe liquid level, and have the required freeboard and the stop pumping level to be clearly
delineated. Please note each marker should be lagoon specific based upon the lagoon design.
2. Failure To Have Components of CAINMP
During the inspection it was observed that you failed to have the following components of your certified
animal waste management plan: Farm Certification, Lagoon Design, Irrigation Design, Accurate Waste

According to you, your irrigation system was installed in 1997, therefore, a full system design is required by
NRCS rules for systems installed after September 1, 1996. You will need the design or have the system
described as installed to meet wetted acres with a matching waste plan. You have a design from 1996 for
a solid set system which was never installed and your current waste plan is based on it. Currently, you are
claiming more acreage on irrigation records than your waste plan indicates. You need to obtain a copy of
your lagoon design from. the district office and place in your records. You also need to obtain a copy of
the farm certification completed by the district most likely during 1996 or 1997.
3. No Carps or Wrong Crops in fields Listed in Waste Plan
During the inspection it was observed that you were not following your certified animal waste utilization plan.
You have been oveiseeding the bermuda fields with small grain without it being listed.in the waste plan.
Aiso, it is unclear whether the currently bare field should be fescue. Plan needs to amended appropriately
by a technical specialist.
This -plan was constructed for your facility to adequately address the amount of animal waste produced by
utilizing it on planted/managed cover crops on specific fields. This plan must always be followed without
exception. If you would like to change your cropping system, then a technical specialist prior to making any
cropping changes must amend your waste utilization plan.
4. Record Keeping
During the inspection it was observed the following problems with record keeping at your facility: Using PAN
(nitrogen) value from soil report notwaste utilization plan, inadequate waste samples, claiming more acreage
on records.than in waste plan.(needs.plan revision)
Irrioation'Records--'Daily spraying activities should.be recorded on IRR-1forms and:must.be used when
using cornp!AO-F.generated IRR-2 forms. -Nitrogen balances should be maintained on separate forms (IRR 2)
for: each crop cycle 'based on.the,certifed waste utilization plan. 'Records can'be kept by -field if spray zone
or.pullirdgaledJsindicated ,in-marginsoron:IRR-1 forms..Ideallyrecondsshould be'kept�byspray�pulI-or
zone with:acreage�shown on IRR-2 forms -as that covered .by the pull or'zone. Facilities with irrigation
designs or.layouts-should follow .them:using-the.appropriate,acreage-assigned to each -routine. 'Nitrogen,
balances should, be updated at least.monthly,,but more frequently for low'PAN crops or when.balances are
,approaching•:PAN;limits to avoid over -application.
Waste Ariaj�Les--- A -dated waste -analysis report for each lagoon that irrigation occurs from is required within
60-days of any -irrigation event. -Forexample, waste reportis dated March1 st,-then.applications can be made
•until"May l 5t or backwards to January 1st. Waste can. be applied prior to having an updated report'such as
spraying on February 1 stand using:the-PAN listed on a,report on -March 1 st of a sample taken"February 20.
However, the grower is cautioned, against: applying too often without .knowing -the nitrogen content of the
lagoon on low PAN crops (like overseeds) or when nitrogen balance (PAN) is nearly used up for a crop to
avoid over -application. It is highly recommended that samples betaken every 90 days (3 months) beginning
in January to always have a valid sample report. This also allows for a 30-day period of report overlap where
the grower can use the lowest PAN value of the two reports on the IRR-2 nitrogen balance records.
5. :No Operator -in -Charge
Priorto or during,the-inspection it was noted that.DWQ has no record of an Operator -in -Charge (OIC) listed
-for .yourfacility.:Each facility. is -required to have.an•actively licensed OIC designated. Please complete the
form left on -site and mail to the address indicated within 15 days of your receipt of this notice. Back-up OIC
designees can.be listed on the same form or on another copy of the form, but please indicate name identified
is the back-up operator.

To correct these deficiencies, please submit a Plan of Action to the Wilmington Regional Office
of the Division of Water Quality that describes the actions to be taken to comply with your certified
animal waste management plan. The Plan of Action should include the following:
A list of actions to be taken in correcting each noted deficiency.
A list of any and all modifications needed to ensure there are no future deficiencies. Include a
timetable for completion of those.modifications.
The proposed written Plan of Action must be received by this office within fitteen-(15) working
days of the receipt of this notice. Upon approval and implementation of the plan, you must notify this
office when the corrective actions are complete. Contact your Service Company, county Soil & Water
district office, or county extension office for -any assistance. they may be able to provide.
If the deficiencies are not corrected, the Division of Water Quality may issue a Notice of
Violation and pursue additional actions including civil penalties, injunctive relief, or revocation of your
deemed permitted status.

an Animal Waste Operation General Permit. Upon receipt of this letter, your farm has sixty (60) days to submit the attached
application and all supporting documentation. In accordance with Chapter 626 of 1995 Session Laws (Regular Session
1996), Section 19(c)(2), any owner or operator who fails to submit an application by the date specified by the
Department SHALL NOT OPERATE the animal waste system after the specified date. Your application must be
returned within sixty (60) days of receipt of this letter. Failure to submit the application as required may also subject your

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i_e. IRR1, IRR2, DRY1, DRY2, DRY3, SLURI, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all mcordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

This letter is being sent to with regard to the main irrigation line that is crossing Pasture Branch Stream
on your farm. As was discussed during your annual inspection on March 16, 2001, this is a potential .
disaster waiting to happen and should be addressed.
Currently, this line is not encased for protection and is in the stream flow during moderate or high flow.
While there is no specific NRCS or state requirement to encase the line in such a crossing, any qualified
irrigation specialist that designs systems would highly recommend it for any open air expanse whether it
be a stream, ditch, or on the ground. By encasing the main line, it protects it from UV light that will
deteriorate the PVC material leading to potential failure and protects it from impact damage caused by
cattle, mowing equipment, or floating debris.
Further complicating your situation, is the fact that this line has no downstream support and is bowing 2-3
feet from elevated stream flow. This can cause the line to break at the joints or at a hydrant connected
on either end. A crossing of the distance you have does require that it is supported from underneath
which It currently has in place.
I would highly recommend that you look to remedy this situation as soon as possible. This letter and the
inspection report from March 2001 serves as your warning about the situation. A discharge due to this
situation will leave you liable and can carry a considerable civil penalty (usually $6,000 +).

My recommendation to you is as follows: .
Have the Onslow Soil & Water District office conduct a complete GPS mapping of the farm
including existing hydrant locations ASAP.
2. Have the District office or Onslow County Cooperative Extension conduct a Wetted Acres
Determination for your existing irrigation system. I think that you will come up short based on
hydrant locations and spacing.
3. Consult with the District and a qualified irrigation specialist or professional engineer about the
best, most cost effective course of action. This could include current system modification
addressing the stream crossing and increased access to the fescue fields or installation of a
completely new system. Cost share money may be available to you for either option or both and
can be addressed by the District office. I know you already have a design for a solid set system
completed several years ago.
You should consult with the Onslow County Soil & Water District office, Onslow County Cooperative
Extension office, the NC Division of Soil & Water Conservation, and Neuhoff Farms for any assistance
they can provide. If you have any questions regarding this matter, don't hesitate to contact me or Mr.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on
Agricultural Waste, was enacted by the North Carolina General Assembly on June 21, 1996. This bill
requires that a certified operator be designated as the Operator in Charge (OIC) by January 1, 1997, for each
animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more
horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management
system Our records indicate that your facility is registered with the Division of Water Quality and meets
the requirements for designating an OIC.
A training and certification program is available for animal waste management system operators. For
information on the training programs please contact your local Cooperative Extension Agent. Operator
certifications are issued by the Water Pollution Control Systems Operators Certification Commission
(WPCSOCC). For information on the certification process, please contact the Technical Assistance and
Certification Unit at (919) 733-0026. The type of training and certification required for the operator of each
.system is based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat
the animal waste. There are two types of animal waste management systems, type A and type B. Type A
animal waste management systems are generally- used to treat waste generated by monogastric animals
which produce a low -fiber waste. Type B animal waste management systems are generally used to treat
waste generated by ruminants and other animals which produce a high -fiber waste. The type of training and
certification an operator receives should correspond with the type of system(s) they intend to operate. For
more information on the classification of your system please contact the Technical Assistance and
Certification Unit.
As the owner of an animal operation with an animal waste management system, you must designate an
Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not
intend to operate your animal waste management system yourself, you must designate an employee or
engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge,
whether yourself or another person, must possess a currently valid certificate of the appropriate type.

On July 18, 1997 the run off in question Was a mistake with the reel coming to close to the
entrance road. The waste water ran down the road Into the drainage path. The run off was contained,
pumped out into two Darnels and dumped hack into the lagoon. The waste water was approximately
fifty to sixty gallons.
The records for 1997, when I was at the certification c4a5s, I understood that the records and
certification of the farm, would start January 1.1998 along with a waste water plant. That was an
overnight on my part.
I have retaken the class in August and will take the test In September, hopefully In Kenansrllle_
Ive also spoke with Wayne at Eastern Agricultural Systems about the exact rates on inioatiott
equipment, and charts for records. I have also spoken with Timmy Grant at Newhoff Farms about
a oertifwd operator to help with the correct application of the waste water, until I will be able to get
my cer#ifcation.

In response to a complaint, staff from the Wilmington Regional Office of the Division of Water
Quality inspected your animal operation and the lagoon serving this operation on July 18, 1997. It was
observed that wastewater had run off from your spray field into a drainage path that is classified as waters
of the State. Although the waste was confined to a small area in the drainage path, any rainfall event could
result in a discharge. In addition, it was observed that you had no spray application records for 1997 and
that a non -certified operator had applied waste at your facility.
As we discussed during the inspection, the waste must be immediately removed from the drainage
path. In addition, waste must.be applied on your spray fields in a responsible manner that ensures no future
runoff occurs. Also, you must start keeping records whenever you apply waste. All registered and certified
facilities were required to start keeping spray application records beginning this year. These records should
include the location, time, and amount sprayed. Finally, when waste is applied, it must be done under the
direct supervision of an operator who is certified with the State to spray. We suggest that you contact your
service company, local NRCS office, or Soil and Water District office for any assistance they may be able
to provide to correct these situations.

You were notified by letter dated November 12, 1996, that you were required to designate a
certified animal waste management system operator as Operator in Charge for the subject facility by
January 1, 1997. Enclosed with that letter was an Operator in Charge Designation Form for your
facility. Our records indicate that this completed Form has not yet been returned to our office.
For your convenience we are sending you another Operator in Charge Designation Form for your
facility. Please return this completed Form to this office as soon as possible but in no case later
than April 25, 1997. This office maintains a list of certified operators in your area if you need
assistance in locating a certified operator.
PIease note that failure to designate an Operator in Charge of your animal waste management
system, is a violation of N_C.G.S. 90A-47.2 and you will be assessed a civil penalty unless an
appropriately certified operator is designated. Please be advised that nothing in this letter should be
taken as absolving you of the responsibility and liability for any past or future violations for your
failure to designate an appropriate Operator in Charge by January 1, 1997.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

On August 3, 1995 Staff from the Wilmington Regional Office of the Division of Environmental
Management inspected your animal operation and the lagoon(s) serving this operation. It was observed
that your waste lagoon had insufficient freeboard.
NRCS guidelines for Best Management Practices require a minimum of one foot seven inches of
freeboard. This is based on the amount of storage space needed to contain a 25-year storm event of 24
hours duration.
To remain a deemed permitted facility, all corrective actions must be made within seven (7) days.
Failure to do so may result in the facility losing it's deemed permitted status and being required to obtain
an individual non discharge permit for the facility.
Please be aware it is a violation of North Carolina General Statutes and Rules to discharge
