This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the
surface waters of the state will subject you to a civil penalty up to S10.000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed
below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level.

Subject: Designation of Concentrated

Dear Mr. Compstock:
This letter is to notify you that the Circle C Hog Farm
Swine Operation is hereby Designated as a Concentrated
Animal Feeding Operation in accordance Title 15, North
Carolina administrative Code 2h .0123, and adopted Federal
Regulations 40 CFR 122.23. The designation of your swine
operation was based on inspections conducted on December
17, 1991 by DEM staff of the Washington Regional Office,
Water Quality Section. The inspection showed that you had
established a concentrated animal feeding operation
requiring such designation based upon the following facts:
1. Discharges occur via a pipe in the second stage
lagoon wall.
2. This operation houses aproximately 650 hogs.
3. Cattle and several horses have access to the stream.
4. Discharges occur to an unnamed tributary to
Kendricks Creek which is classified as SC waters.
A National Pollutant Discharge Elimination System (NPDES)
permit is required for discharges of waste to the surface

Ho*f.ever, if you can permanently eliminate the discharge by
implementing changes within sixty (60) days of your
receipt of this notice, including, but.not limited to,
modifications to lagoons and the implementation of a final
waste plan, a permit application will not be required.
If compliance has been achieved, you must notify us
in writing within sixty (60) days describing, in detail,
the changes or modifications you made.
If the discharge to the surface waters of the State is not
permanentaly eliminated within sixty (60) days of receipt
of this notice, an NPDES permit application must be
submitted within that time.
Permit applications should be submitted, in duplicate, to
the Director, Division of Environmental Management, P.O.
Box 29535, Raleigh, N.C. 27626-0535. Assistance, if
desired, can be obtained by contacting Mr. Roger Thorpe,
Water Quality Supervisor, P.O. Box 2188, Washington, N.C.
27889, phone number 919/946-6481. The application should
be accompanied by construction plans for the
non -discharging animal waste system.
For your information, the following items are enclosed:
1. One copy of the Federal Register -Concentrated
Animal Feeding -Operations, 40 CFR 122.23.
2. Three copies of NPDES Discharge Permit application

If you need advice or technical assistance with regard to
managing animal waste, you should your contact your county
extension chairman or North Carolina University's
Department of Biological and Agricultural Engineering at
(919)-737-2675.
If you wish to contest this Designation, you must request
an administrative hearing within thirty (30) days of your
receipt of this Notice. This request must be in the form
of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with the Office
of Administrative Hearings, Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. A copy of this
Petition should be filed with this office.
If you do not request an administrative hearing, this
Designation will become final in thirty (30) days.

Dear Larry:
To design an animal waste lagoon we give considerations to the
following areas:
1) Design treatment volume,_sometimes called permanent storage is
figured at 1 cubic foot per pound of animal. For a feeder pig
operation we use 522 cubic feet per sow For 'your operation the
design treatment volume is 104409.6 fD
2) Sludge accumulation should be designed for 5-10 years. The figure
we use for sludge accumulation is 42 ft /year -sow. In your design
I did not figure a volume for sludge accumulation.
3) Temporary Storage:
a. Pumping cycle - for your design I figured a 180 day pumping
cycle.
b. Rainfall less evaportation is also figured.
c. 25yr.-24hr. rainfall is figured which is 7.2 inches.
We also look at waste management. In your design you have the acres
required for nitrogen disposal which is 5 acres. The acres required
for P205 and K20 disposal is also listed. This is the amount of land
required if the waste is applied on Tifton 44 bermuda grass. You also
have the time that waste can be applied.
Your existing storage ponds can be used but work will be needed to
improve the dikes. The dikes need to be as a minimum with a 10 foot
top with 3 to 1 side slopes. The banks need to be grassed and maintained.
Cows need to be kept off the dikes. Maintenance needs to be carried out
as needed. If you use your existing storage ponds you may need to pump
every thirty (30) days. You should apply animal waste only on an actively
growing crop.

I see that you need to come up with some additional land area to apply
waste on. You cannot apply waste on your pasture year round without
planting a rye cover crop and getting a stand of bermuda.

I have received 2 copies of your letter concerning designation
of concentrated animal feeding operation. I have cemented the opening
in the pipe in the second stage lagoon wall. This will prevent any
discharges to occur. This process was completed on December 23, 1991.
Mr. Rufus Croom came out to the farm on January 21, 1992. At this
time he had not received a copy of this letter. He read my letter and I
showed him what had been done to correct the problem. He said he
would get back in touch with me. I have not heard from him as of this date.
We also use the manure from the hog operation as a fertilizer on
our 10 acre pasture. This is done several times a year.
At this time, I am waiting for Rufus Croom to contact me for other

Circle C Hog Facility

On October 8,1992, Robert Tankard, DEM Staff of the Washington
Regional Office, visited the Circle C Hog FACILITY. The purpose of
this visit was to determine whether or not the aforementioned
facility was in compliance with its CAFO Designation effective
January 14, 1992.
As a result of this inspection it has been found that the Circle C
Hog Facility was in compliance at the time of inspection. It
should be noted that Mr. Compstock reinforced his lagoon dikes and
also terminated the PVC pipe that was allowing the discharge by
filling the pipe with concrete.
Mr. Compstock is working with the Ag agent in reworking his hog
lagoons. At the present time, there were no discharges, but there
was less than 6 inches of free board in his lagoon.

INTRODUCTION:
The purpose of this memo is to request that the Circle C
Hog Farm Swine Operation be designated as a Concentrated
Animal Feeding Operation. A summary of the investigation
conducted on December 17, 1991, by Patrick Towell, Dem
staff, is enclosed as follows:

Description of Facility Location:
This facility is located off Hwy 64 aproximately 3 miles
North of Roper, N.C. in Washington County.
Type of operation (Examples: farrow to finish, topping,
dairy, swine, cattle, chickens -layers or broilers, turkey
production, ets.):
This operation is a farrow to finish operation that
normally houses 150 sows and 500 pigs during the year.
Number and type of animals units:
This.facility houses aproximately 650 swine total.
Length of Time Animals Have been, Are, or Will Be Stabled,
or Confined and Fed or Maintained in Any 12 Month Period:
The animals are housed greater than 9 months during
any 12 month period.
Are Crops, Vegetation Forage Growth, or Post -Harvest
Residues Sustained in the Normal Growing Season Over Any
Portion of the Lot or Facility?
No crops are grown on any portion of the hog lot.
There is also a cow pasture surronding the operation.
Description of Other Animal Operations in Immediate
Vicinity or Proximity to Same or Other Surface Waters:
There are no neighboring animal operations.
Proximity of Facility to Neighboring Houses, Wells, etc.:
The nearest home is located 1500 feet from the
operation.
Approximate Depth of Groundwater Table in the Area of the
Facility or Discharge:
The seasonal high water table appeared to be
• approximately 3-4 feet.
Proximity of Facility to Surface Waters (provide name and
class of surface waters):
The facility drains into an unnamed tributary to
Kendricks Creek and is classified as SC waters.
Are Pollutants Discharged into the Waters of the State?
If so, How? (directly or by man-made ditch, flushing
system, or other similar man-made device):
Animal waste was discharged via a plastic pvc pipe
to a ditch that flows into the ut to Kendricks Creek.
Do or Have Discharges Occurred in Response to a Storm
Event of Less Than a 25-year, 24-hour Intensity? (if yes,
include a brief listings of incidents and suspected
causes.):
Discharges of animal waste occur regardless of rainfall
Type of Waste Management (Examples: type of confinement,
free stall barns, sheltered or limited shelter dirt lots,
paved or dirt open lots, swine houses, pasture: type of
waste handling -direct spreading in solid form, slotted
floors with lagoon or pit, single or multi -cell lagoon,
aerated lagoon, land application of liquid manure, spray
irrigation, contractor disposal, etc.)
All swine houses utilize a recycle flushing system. Mr.
Compstock pumps his lagoons twicw per year on adjacent
pasture but this area is subject to periodic flooding
in the spring. There is no other land available.
Condition of Waste Management Facility (rate as poor -good,
no discharge, sufficient freeboard in lagoon, etc.
Include weather conditions during inspection.)
This facility is very poor. Mr. Compstock also has
cattle at this site and the investigation revealed
that they had access to the stream.

sampling, field measurements, visual observations and
slope and vegetative cover of land adjacent to water,
extent of rainfall and other factor relative to the

No field measurements were taken.
Recommendations Made to Owner/operator:
Mr. Price has cemented shut his discharge pipe, but there
is still a problem with his cattle having access to the
stream and there is no land suitable for land application
at this site. He was encouraged to contact his local-SCS
office for help.
