No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.

The docking facility and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel or deep water, then drawing a line perpendicular to
the channel line that intersects with the shore at the point where the upland property line meets the
water's edge.
Because of the close proximity to the northern most property owner's riparian conidor, and to ensure
compliance with Condition No.5 of this permit, an as-built survey shall be performed of the marina, and
copies of the survey provided to the Division of Coastal Management, within 60 days of completion of
construction of these portions of the project.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a maximum of 26 boat slips, which includes the lO-slips previously authorized.
At no time shall more than 26 vessels be moored or docked at the facility without permit modification.
The restriction on the number of vessels shall apply to all marine vessel types, including but not limited
to motorboats, sailing vessels and personal watercraft.

NOTE: The permittee is cautioned that boats utilizing the docking facility shall be subject to frequent
~ wavewash from passing vessels. The issuance of this pennit does not relieve the permittee from
'( taking all proper steps to ensure the integrity of the structure and the safety of moored boats.
~ The permittee shall not hold the State of North Carolina or the United States liable for any
damage to the structure or moored boats.

Approval of 401 Water Quality Certification (GC3400) with Additional Conditions
Dear Mr. Buck:
You have our approval, in accordance with the attached conditions, to shade 0.0126 acres of open waters
to add 16 slips to an existing 10 slip pier as described in your application received by the Division of
Water Quality (DWQ) 401 Oversight/Express Review Permitting Unit on September 16,2005. After
reviewing your application, we have determined that the Division of Water Quality (DWQ) General
Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to
General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition,
you should get or otherwise comply with any other federal, state and local requirements before you go
ahead with your project including (but not limited to) erosion and sediment control regulations and
CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 OversightlExpress Review Pennitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
3. Water Quality Certification
The proposed proj ect must comply with all of the conditions of General Water Quality
Certification (GC) 3400.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Pennit.
If you do not accept any of the conditions of this Certification (associated with the approved water
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition, which confonns to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

9. NARRATIVE DESCRIPTION:
Project Setting
John Buck, Jr. owns a tract of land at 601 Chinchilla Drive adjacent to the Bay River in
Bayboro, Pamlico County, North Carolina. The property is 5.5 acres in size and is approximately
5' above MSL. The site is currently used as a full service commercial marina. The site has a
large shop for boat repair, office trailer, and a parking/dry storage area, which covers the majority
of the high ground on the tract. There is an area of coastal wetlands approximately 210' - 240' in
width between the high ground and the Bay River. Giant cord grass and black needle rush are the
predominant species found in the coastal wetlands on the site. A 230' channel extends from the
Bay River and terminates in the high ground area of the tract where a travel lift is located for the
launching and retrieval of the boats serviced at the boat yard.
The existing 10-slip docking facility was permitted under DCM permit 161-02. The existing
dock layout consists of a 6' wide by 520' long access over coastal wetlands, which runs parallel
to the basin and turns to the north where it runs parallel with the river for the last 70'. It leads to
a 6' wide x 30' long fixed pier leading to an 8' x 140' floating pier. A floating platform at the
end of the pier forms a "T" and is 9'wide by 175' long. The existing dock is 76' from the
federally maintained Bay River channel. There are no other docks in the immediate vicinity of
the project site. A proposed expansion to a 30-slip marina was reviewed under the SEPA process
and received a Finding of No Significant Impact on September 6,2004.
The waters of Bay River are classified as SC Swamp and Nutrient Sensitive Waters and are
closed to shellfish harvesting. The Bay River is not classified as a primary or secondary nursery
area by the N.C. Division of Marine Fisheries. Bay River is approximately 620' wide in the
vicinity of the project. The federal channel in the Bay River is 150' wide and it was originally
excavated to -10' below NWL. There is a 46' setback from the channel. The water depths in the
project area range from approximately -2' below NWL at the shoreline to approximately -7.0'
below NWL at the end of the docks. No submerged aquatic vegetation was observed in the area
of the project at the time of the site visit.
Project Proposal
The applicant proposes to add 16 slips to the existing 10 slip docking facility in conjunction
with a full service commercial marina. The slips would be created by constructing twelve 2.5'
wide x 11' long finger piers perpendicular to the existing pier and eight 2.5' wide x 11' long
finger piers on the landward side of and perpendicular to the existing platform. A mooring piling
is also proposed at 19' from the end of each finger pier and one at each end of the existing
platform for a total of 22 mooring pilings. The slips will extend a maximum of 30' from the
existing structure. All proposed construction is within the footprint of the existing docking
facility and landward of the 46' federal channel setback as required. The two slips closest to the
shore will be in approximately -4' of water with the slips closest to the channel in approximately
-6' to -7' of water. The boats to be docked at the marina are projected to be 30' to 40' in length.

Anticipated Impacts
The installation of the finger piers and platforms for the 16 additional boat slips will not
result in the usurpation of any additional square footage of the Estuarine Waters and Public Trust
Areas of the Bay River, as all proposed construction is within the footprint of the existing
docking facility. It will result in the shading of an additional 550 square feet of shallow water
bottom habitat. A temporary increase in turbidity can be expected during the in-water
construction portion of the finger piers, platforms, and mooring pilings. There will be a 160%
increase in boating use at the facility.

The following is a Finding of No Significant Impact (FONS!) for the proposed Hurricane
Boatyard Marina in Pamlico County. The proposed development, as outlined in the Environmental
Assessment (EA), includes the expansion of a 10-slip marina to a 30-slip facilty in Bayboro, Pamlico
County.
This EAlFONSI are prerequisites for the processing of a Coastal Area Management Act
(CAMA) Major permit application by the Division of Coastal Management.
It is concluded that the proposed project will not result in significant impacts to the
environment provided that it can be permitted and subsequently developed consistent with the
State guidelines in the Rules of the Coastal Resources Commission and the avoidance/mitigation
measures contained in the EA. An Environmental Impact Statement (EIS) will not be prepared
for this project.
